Veterans Affairs Failing Faster In Nearly All Areas, Monumental Problems

Hello All,

I have been watching the post from so many of our members , old ones and alot of new ones. Watching the hearings from both house and senate, numerous news agencies and I am also seeing the problems with so many areas within the Veterans Affairs.

After reading so many post from not just myself but members like Berta, Carlie, Jbasser, Boomer, Teac, Bronco, Asknod, 71m10, Sp4, Meghp0405 and many others who post specific articles and news links, I am seeing a terrible pattern.

One that I believe we all can look at and say , this whole VA system is corrupt. It is so far gone that their is no answer to get any of the problems fixed.

I am going to bring up just a few of the problems we are facing at an alarming rate with a downward spiral.

Arrogance, Elitist, criminal mindset, refusing to answer Congressional hearings questions, failing to comply with Office of Inspector General reports, GOA reports and recommendations and outright lies, coverups are expressed with non compliance and blatant ignoring the laws and regulations of our country and the Code of Federal Regulations. This is the Secretary , Assistant Secretary , Directors and VARO Service Managers that continue to operate with immunity. No one can touch them and we see everything getting worse. Responsibility and accountability are totally ignored and rewarded with more bonuses.

I am going to list just a few of the more recent problems within the last 6 months to a year from some of the news articles or past post with topics that are here at Hadit.

1. The incredible increase of the backlog

2. Inacurracy of the claims decisions process and its error rates especially from initial decisions to BVA remands process

3. Problems viewing Cfiles

4. Lack of Due Processs to Veterans and the Timelines faulty, error ridden decisions making Appeals nearly impossible

5. Failing to answer phone calls at most VAROS

6. VARO C and P exams not available to veterans or delayed more than one year

7. FOIA delays of information or non compliance at all

8. Dependents pay non-compliance and or long delays

9. VA arrogance on questions from House and Senate subcommittees, GOA, OIG reports

10.Fidicuiary Scandals

11. Legionaires Disease Coverup

12. Suicide Veteran Rate Increase

13. Lack of treatment for PTSD veterans

14 Homelessness of our Veterans

15. Paperless transitions for records inconsistancy between VAROs and VAMC, Clinics , dealing with MyhealthyVet, Ebenefits

16. Travel pay issues

17. Treating any correspondance with VAROS as a NEW CLAIM

I have used Hadit, and many news organizations, House and Senate reports, OIG, GOA and other agencies to bring up these points above.

Now I know I have missed alot of areas and these are just some of the more recent events and directions VA is taking and it is so evident by the huge number of Veterans that are posting on Hadit and viewing our topics.

You can see it in the tone of our topics and the Veterans and their wives and widows desparation. I have been a member here for over 6 years and the overall direction the Veterans Affairs has taken is absolutely out of control.

It has gotten so bad. I am so fearful for our Veterans that are just now coming into the VA claims and benefits process. That so many are going to fall thru the cracks and that the number of Veterans who will just say I quit and face prison, divorce or death or homelessness. That the number of Veteran problems now dominate our news agencies. Our courts and prisons are fast seeing an alarming problem with our Veteran community. We see it daily in our News reports.

That is why I have to just bring this topic up thats been on my mind for a long while, so that many of our Veterans can see that we all face some very dark waters ahead. And that is why I hope that every Veteran that comes to Hadit will say to each other....... NEVER GIVE UP. God Bless, C.C.

Folks, This whole week has revealed so much corruption from VA. The Senate Hearings were a fiasco filled with lies and more dead promises. Now the Florida Charity Scandal at Allied . The report from Bergmann and Moore and it just is now moving at high speed corruption . Moving faster than any of us would have dreamed. The terrible decision by Thomas Murphy, a VA hack deputy director and his C123 Agent Orange stance with an incredible denial that Agent Orange really does not cause any harm.......HUH..........

Alright ..... I have no choice but to file malpractice suit number 2 even before number one has settled and may be a press conferece. Lets just pull off the gloves and start name calling ....like who really handled my claim and the diseases I have and not been treated ....I have 2 of the DRO names , another decision rep and the Service Manager so lets just see what I can come up with in the next month or so. And I am going to specifically name them in this lawsuit FTCA Malpractice and what the snakes hissed. And I am fighting another hand infection so I am already like a grizzly bear with a bad tooth. Never poke at one of those. When that bear is hurting then he lashes out at everyone. That is probably how I feel this week. More paper work and waitiing on xrays and ct scans and then the lawsuit FTCA part 2 ...... Now I need a good news person that will sit down and listen and go after the scumline that runs Regional Office in Houston. It may make some mad but not as mad as I am. Stay tuned for part 3. God bless all of our troops and our folks here at Hadit. There is so much work that all of its member are trying to do the right thing but VA is gone beyond any concept of decency. if you find that news person as him/her if more names/stories are needed. many of us here purposely not diagnosed correctly and labled head cases by VA to be swept under the carpet...if that is how one expresses it, adjective finding isn't what it used to be.

i don't think the American Legion has visited Hadit.com for quite some time!, ya think? If General Shinseki has actually done a good job, then my only conclusion is the VA is close to a "mob organization" and it must have under-mined General Shinseki's good jobs.

All the good guys keep getting beat down by our gov. history keeps telling this story over and over...

the furlough, if it takes place will not effect the va employees. They will just continue to be the non-producing, over paid government employee's that will actually still have to go to work 5 days a week...

I just read an article in the Indy Star where a whistleblower has again come forward and is exposing some real heavy stuff. This may bring in some criminal people. It speaks of how the VA is deliberately covering up tests, and investigations into certain chemical exposures and talks about the burn pits and the unknown causes of the Gulf War deseases. But, it goes on to say that many tests that were supposed to done, were not done at all. This is serious. It shows the systemic on going corruption in the VA. For many of us who have pending claims I am scared how this investigation (which is being looked at by Congress) will effect our denials or awards. It could be positive, or worse yet very negative. I think this goes all the way to the top. This is turning into another Fast and Furious, Solyndra, and Bengazi. To view the article go to IndyStar.com. i don't think the American Legion has visited Hadit.com for quite some time!, ya think? If General Shinseki has actually done a good job, then my only conclusion is the VA is close to a "mob organization" and it must have under-mined General Shinseki's good jobs.

Lets get real. The Secretary is just a political figurehead who is powerless and is micromanaged by a higher authority.

This has been going on for decades and will continue. There has been nothing done.

A Veteran is a person who served this country. Treat them with respect.

A Disabled Veteran is a person who served this country and bears the scars of that service regardless of when or where they served.

Treat them with the upmost respect. I do. Rejection is not a sign of failure. Failure is not an option, Medical opinions and evidence wins claims. Trust in others is a virtue but you take the T out of Trust and you are left with Rust so be wise about who you are dealing with.

i would tend to agree. the Times story is more evidence supporting us veterans and what is said here at hadit.com. and what indyman referred to also. i have no hope anything will change, but at least the stories are getting out there.

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
