TDIU Form 21-4140-1 Questions?

Hello,

 Is TDIU Form 21-4140-1 required to be filled out and filed with VA each year or did VA really reportedly rescind it?

 If TDIU Form 21-4140-1 is still required each year by VA, then will it have to be filled out each year for the rest of the disabled veterans life or does TDIU eventually become permanent so that the disabled veteran doesnt have to fill it out anymore at some point?

Until you get a letter from VA stating you don't need to send in the 21-4140-1. (keep that letter in a safe place)

   Then if your getting TDIU you better fill out the form each year.  Jan of each year is a good start that way you got it behind you all year.

''Note'' don't wait for the VA to send this form to you...find one the internet print you some and send it in.  via  your designated ''Claims Intake Center''  with  return sign receipt

I been TDIU 14 years and on or about my 10th or 11th year I did get a letter from RO stating I don't need to send in the form....I stopped sending it in  but after a couple years I started back  resent it in...I can't find that letter the RO sent me  so better to be safe than sorry and face a reduction.

so I sent one in last year 2015

I'm glad I did now because they used the 21-4140-1 in my recent claim for PTSD as evidence.  they named the form as 21-4140-1

After you have  had TDIU 20 Consecutive years  then your safe

Although there is a 5 year and 10 year safe limit but comes with no guarantee

 Okay thanks for that info, so apparently the TDIU Form 21-4140-1 is still in effect then thats good to have verification, for some reason there are some misinformed veterans that think its been rescinded and apparently that is not the case.....

 To be safe I think that after the 1st of each year sending out 2 TDIU Forms 21-4140-1 filled out and signed using certified mail just in case would be the best way to go.....

Scarecrow, do you currently have an SC Rating, are you IU?

IU Ratings are always temporary, even when the T & P No Future Exams is indicated on the Award. If after being Awarded IU, a Vet were to maintain SGI+$$ ($12,400 or $11,400 if 65+) level of employment for 12 Continuous months, the IU rating would be up for a Reduction back to the Vet's pre IU SC Rating. That's 12 months straight, no interruptions.

When a Vet hits 69, the annual VA IU Date, Employment/Earned Income verification form is no longer required. Prior to turning 69, failure to file could get a reduction, why chance it.

 Yes I have several VA SC's with high ratings and several irons in the fire but playing the hurry up and wait game like most everyone else.....

b.  Monitoring Changes in Employability Status

Changes in the employability of Veterans for whom IU is established is monitored through the

 

·   annual release of VA Form 21-4140 via the Hines Information Technology Center (ITC), and

·   Income Verification Match (IVM).

c.  When Monitoring Changes in Employability Status Is Not Required 

Monitoring changes in employability status is not required when the Veteran

 

·   is 69 years of age or older

·   has an IU rating that has been in effect for 20 continuous years, or

·   has had an IU rating replaced with a 100-percent schedular evaluation.

Interesting

I am TDIU P&T & over 55 , had this for 14 years. 100%

I filed another claim in 2015 for PTSD got 70% SC

They inferred the SMC-S And was put as a 100%rating.

an extra 347 month.

On ebenefits there's a blue circle with 100% sign in the middle.

However if I am still TDIU P&T...I will still send in the form 21-4140  every year until I get a letter from VA telling me Its not necessary to send in this form.

Better to be safe than sorry,(send it in) why do you think they never send the form to the veteran?  so it can give them a chance to reduce us.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
