Has anyone seen a response like below. Is court of veterans appeals CAVC or is it within BVA or did he mean to type BVA? I am confused by it. Va Incompetence Again
GAWD..........................what the heck is going on? Vet served in KOREA and his claim was denied cause he was inot in VIETNAM!! Amazing, so we tell them we never said VIETNAM, we said KOREA, did you read our paperwork? OK we got that settled and a decision was issued for the vet at 90%, but his ischemic heart disease was denied cause he did not make an appointment they had scheduled. OK the day of the decision we requested the exam be rescheduled cause the VA Decision Letter requested that we ask for a reschedule. How Do You Know Your Medical Evidence Is Adaquate?
In the most recent case, my focus on the vague comment "recent months" and the failure of the examiner to address the issue that there were known episodes of PAT triggered by exercise is no accident. I have previously made comparisons between the way claims are adjudicated under workman's compensation and the VA. What I learned when working workman's comp and civil cases is that when a doctor uses vague terminology or fails to address an issue it is no accident. Doctors are very capable of focusing on the issues and using clear descriptive terminology. Vague comments and avoiding issues are the way a defense report buries the truth. Va Inspector General
Many of you might have dealt with the VA OIG and probably receive OIG emails regarding their latest reports. Yesterday I filed a complaint with the IG's hot line on a matter VACO (OGC) failed to give me an adequate response on in the past and I am trying again to resolve that issue which could impact on others and reveal why the VA sent me a ludicrous letter last week. Pdrl Medical Discharge
I was found unfit through the MEB process. Before the PEB findings, the head physician found me fit and continue before he transferred to another state as civilian physician. However, when I saw another physician for a routine visit, he said that he'll do the NARSUM. Couple months ago from this writing, I am medically retired. I am O3E with over 21-years of combined service, and would like to know if I can appeal the decision.

The new Physical Disability Board of Review (PDBR) will examine each applicant's medical separation, compare DoD and VA ratings, and make a recommendation to the respective Service Secretary (or designee.) The military records will be corrected effective the original date of execution of the Physical Evaluation Board's separation action. This is the same rule for BCMR/BCNR corrections. Just Finished My C&p Exams Last Week
My main claim is for paranoid schizophrenia, the psych told me not to expect much, as i was in a good mood when i saw him, but when i went in to see the internal medicine doctor a couple days later i could not reconginze him, he said he saw me before, and i believe him, i just couldnt recognize him. He asked why i was seeing him again and i said i did not know, (i had not claimed anything that internal medicine would be involved with) then he said he knew and that it was because of my employability.
