A&a- 1151 Claim
Berta, On Aug 30,2011 I filed an 1151 claim, I had it on this Forum at that time. I haven't heard from them, as you all know. But my Question is, would it interfer with my 1151 claim if I applied for A&A, plus for increase in other area of my disability? Also, a friend applied for pes planus, and was denied because they said that he had this when he went in service. If he did he didn't have any problem with his feet until he went in the Navy,going up and down those ladders on the ship. Should he re-apply???Been years. ** Possible Triggers**symptoms In Service, But Not Diagnosed, Or Treated
Hello To All, I have been reviewing all of the denial SOC's that I've received from the VA to date since I am still waiting on this appeal, but I am hoping someone can help me out here with an argument in their statements that VA has made over and over which is confusing me further with the information I've been able to find on here from past posters. I went to what was the military clinic of the day with complaints of depression and anxiety, but I was not diagnosed, not sent for an evaluation, nor treated, even as the notation was made about my complaints of the symptoms. Dmii And Sleep Apnea
Is there a relationship between DMII and sleep apnea? I have read that those with DMII are three times as likely to get sleep apnea as those without DMII. Does this mean there is cause and effect relationship of just coincidence?

Wat To Do
I posted earlier todad but my post is gone. In Aug 30,2011, I filed a claim under 1151. Now need to file a claim for A&A plus for increase in my disability . Would that slow down my 1151 Claim??? Also I have someone who filed a claim in 1997,for pes planus and was denied,becase the that it was pre-exiting to his service. He served over 4 years in the navy, but the constant up and down on those ladders has caused problems with his feet. He did not follow up on his claim. What should he do? Refile? Was the law changed about pre-exiting condition???

Comp&pen "effective Date" Changed. Why?
Hey all, I'm new to the site and have a question regarding the "Effective Date" for my compensation. I've been receiving 70% for about 6 months now, which is fine and dandy, but in November I logged into ebenefits to download my Award letter again because I had to get a new computer. It wasn't there and there was a note saying your letter will be re-uploaded on December 12th. So, I let a month or so go by and just checked it tonight. It is there, but my effective date changed from June 1st, 2011 to December 1st, 2011. Why would that be, and why was my letter taken down in the first place? Just seems kind of strange, please let me know if any one has any answers about t…

More Than A Little Confused!
The background: I am 20% on my back and I put in for an increase in May of 08. It was denied in Jan 09 and I appealed. It took until Nov 10 for the BVA to get it. Anyway I got a decision letter a few days ago and it said they remanded it, they wanted some more tests done on my back. Ok, now I received a letter saying that they received my claim and they are working on it. But there is nothing on the letter telling me where it is now? Can anyone give tell me where it is? Did they send it back to Michigan for them to get more evidence? I am so confused! Thanks

Question About Defered Rateing On Multiple Sclerosis?
I was contacted by the actual RSO and they told me they would give me a defered rateing for ms at 30%. And back pay for 15 months. But then she stated i need multiple qtcs for my other contentions and have the doctors say its from ms or being caused by ms or something completely different. Then they also stated that all the other symptoms would have to average out to higher than 30% for an in crease past the defered 30. I was wondering if this is good or bad!!! And is that process even right? Ms alone just for a dx is 30% so if my other 9 items average 30 put together then my rateing stays the same??? Also how long do yall think it will take them to send the back pay lol.…

So after 4 years of my appeal sitting there in the NY regional office, it has been moved to decision phase on 12/7/11, I elected a Decision review Officer (DRO). I went to the C&P eval and they gave me a GAF score of 47 and from what I understand that is pretty bad, I have looked up some figures and it shows that this GAF score equates to roughly a 70% rating, can anyone verify that? Anyone know anything about the decison phase for appeals and how long it takes? I got off the phone with a person on the 800 # and they told me for original claims that they are averaging 76 days and then the notification phase is an additional 18 days.

tdiu Tdiu - Any Ideas
I wanted to see if anyone had any suggestions/comments on my TDIU claim....... I filed for TDIU in 10/08/2010 b/c of recommendations by 2 Neurosurgeons (non VA), my primary care doc, & my pain management doc (both VA) & the 24/7 pain that i am in. I am currently rated at 70% & my service connected injury to my back plus secondary conditions have deteriorated to the point that I can no longer work. I was medically discharged in 2005 and my condition has continued to only worsen since my injury. Can anyone tell me the course and appeal takes, here is why I ask Claim with VSO 11/25 Claim with VLJ 11/29 Claim with VLJ counsel 11/31 to? Claim with VLJ 12/12/11 Anyone know what counsel does? Am I getting close to a decision here, this is an old claim. Thanks

This Years Xmas Dinner Will Be Turcrowen!
Last spring when I found Hadit I was abit cocky about my claim. I felt it was a No Brainer on the conclusion. Some of the folks here tried to shake me to wake up, but I stuck to my guns. I mean, I had no Hepatitis C before my colonoscopy which required a transfusion and the very next time they took blood out of me(about 6 months later) I had Hep C. Looked like a open and closed case of a claim. Unfortunately my Dr lied to me and told me I had no recourse against the VA or the surgeon. This was 1997.
