Question Concerning 2nd C & P After Nod To Va
I had my first C & P exam in Aug of 08. I was rated in Oct 08 with a 10% rating on my back for: Residuals, back surgery with degenerative arthritis I submitted a Notice of Disagreement in Nov 08 and had a secondary C & P in Jan 09. I recently requested a copy of the C & P notes for both exams, (I had no idea I had a right to a copy). There are some big differences between the 2, and am curious what those differences translate into. Can someone tell me what the results of the second exam will mean in regards to my rating, or a best guess. Thanks in advance. 1st exam Review of system: no radiation of pain, gradual onset of pain, constant duration of pa…

ptsd Claim For Ptsd
I really need some assistance. I am a service connect Veteran and I discharged from the Army in 1986 with 10% SC for my back and 10% SC for my ankle. I fell 50 feet off the side of a cliff when the repelling rope broke and I broke my back and crushed my ankle bone. I know I was young and stupid (20 when discharged). I have off and on fought for more disability throughout the last 20 years. As of April 2008, I was upgraded to 40% -20% for my back and 20% for my ankle. I have been unable to sustain gainful employment for almost 10 years and in October I was diagnosed by the VA Psychiatrist with PTSD. I have been seeing a social worker and Psychiatrist through the VA …

Last C&p Exam
Jan 20th 2009, when I went up for an exam for my recurring headaches. The doctor asked a few questions about the frequency and how bad they were. I discussed this for about 10-15 minutes with him. After I got home and about two weeks later I asked for the exam results and received them a week or so ago. This doctor did not touch me except he shook my hand after we were done talking. The exam he wrote up says he took my blood pressure, temp, weight, height, pulse, respiratory rate, motor exam, sensory exam. How is it he could do all that by talking to me for about 15 minutes and shaking my hand on the way out? How can I prove none of this took place? This is the only disa…

Compensation & Pension Exams
I filed a claim for fibromyalgia back in 2006 and it was denied no c & p exam nothing, I have multiple complaints of in service muscle pain, fatigue, headaches and a viral infection. I am already service connected for mood disorder claimed as (depression, Fatigue, and sleep disorder). The base of their decision was I was not currently diagnosed with fibromyalgia, the rating decision said, the doctors alleged I probably have fibromyalgia but was not diagnosed with it. I then sent in a progress report from my current rheumatologist that diagnosed me in 2000, another diagnosis in 2007 and my PCP primary care provider diagnosed me with fibromyalgia in 2007. Then I fina…

Depression C&p
I went to a C&P for my depression the other day. I do not think that it went that good at all. I have considered that all of my service connected disabilities have caused my depression and my depression is getting worse. The Psychiatrist did not want to hear about all of my service connected illnesses and why they caused me to be depressed. I was even stopped several times while I was describing my problems to him. He told my in the end that he was going to only look through my military records for signs of depression, and that was all that he was going to consider. I could not get it through his thick head that I would not be so depressed if I was not disabled …

ptsd My Gaf
I would like an opinion on my situation...I am confused with what is going on. I had seperate C&P exams....got rated 10% for my BP and 10 for Tinitus. All the other claims were shot down...I will be appealing. The kicker...my PTSD and depression were defereed and I was sent paperwork to fill out. They want a statement and letters or statements form others to prove that it(the incident..yrs of harrasement) happend (not in my SMR's). From the C&P exam the Doc rated me at Axis V GAF : 45 (current) 48 ...is this number in my favor? Is it normal to have to prove or give statements..then combine them with the GAF to get my rating? I have been seperated since 06…

Filed For An Increase
October 08', I filed for an increase. The VA sent me to my local VA doctor and he put me through some tests. ROM was included. He also measured my legs again. I developed Sacroiliac Dysfunction while on active duty. My left leg was 1/2 inch shorter than my right. Currently, My left leg is a full inch shorter. I've just been diagnosed with IDD. (Internal Disc Disruption in the L4,L5 in my back) This is the reason that my left leg gives out and I fall. My neurosurgeon says that it's probable that the IDD stemmed from my Sacroiliac problem. I'm currently rated at 30% for this. Does me developing IDD warrant an increase? My surgeon has me going to physical therapy 3 times a w…

Range Of Motion And Another Question
Have a quick question about the C&P range of motion. Are you supposed to stop when you feel pain? What if the examiner asks if you can go farther, do you? Even though it hurts? If the examiner misses some questions should you politely call him on it? My examiner acted like my best friend and screwed the heck out of me by his notes.
