  3. ferris - I suggest you keep a daily diary of the effects/symptoms. It only takes about 10-15 minutes a day. Also you could photograph your hands daily w/a digital camera, for use as evidence. jmo pr
  4. You appear very knowledgable on VA matters, enough so that I'm guessing you're a VA employee sharing your knowledge here. Can you explain how the VA uses the Combined Ratings Table(CRT), once a claimant reaches 100%?? Also with reference to the 100%+60% "s" award?? Do they use the CRT in making that decision, even tho it penalizes the claimant "again" for the same disabilities?? Thank you for your time! pr
  5. pk - you may want to check your bank acct, daily, as frequently the money arrives before the letter. As to the decision, your VSO is notified of the decision, prior to its mailing, but since the decisions are subject to review, often don't tell the claimant. pr
  6. ferris7060 - unless you request a hearing within about 21 days (may be 30 days but I wouldn't chance it), from the date of the "proposal to reduce" letter, you will be reduced "automatically." The only way to delay or stop it is to have a hearing. The VA cannot proceed until after the hearing. I suggest you write your request for a hearing, today or tomorrow, and hand deliver it to your VARO on Monday, and get a date-stamped received copy to take home w/you. jmo pr
  7. Have you checked w/the NVLSP on the Nehmer claim? I believe they are doing an audit, on those awards, knowing the VA will try to shortchange the claimants. pr

  9. Why would she want to be added to the mortgage, period, yet alone later??? Makes no sense. Usually a second person is on the mortgage just to make it easier to secure. She can be added to the deed, at anytime, subject to any existing mortgages. pr
  10. It could be any day and should probably only be 3 months, for 7/1, 8/1 and 9/1 checks. Award date 5/18, w/no money for May. VA pays starting the first full month after the award date. So payment starts June 1st but you don't get June's payment until 7/1. Hope I explained that well enough. pr

  12. You can try getting the mortgage in strickly your name but I don't recommend it as any marriage could fail at any time and you'd be stuck for the whole thing and could have to give up half besides. jmo pr
  13. I, personally, believe the VA's general counsel has instructed them to use that "without resorting to speculation" phrase as a way to extend the period resolving the case and getting the claimant to give up in frustration. jmo pr
  14. Back in the day (70's) a claim for comp was a claim for pension and vice versa but I don't know if that continues. The VA will pay the higher benefit and it is your choice, which you can receive, if qualified for each. Pension is offset by other income. pr
  15. I'd file a claim now, listing the symptoms. You need not have an actual diagnosis, as you are not a doctor but should be able to list the symptoms. jmo pr

  20. It sounds as though you are already P&T. Call the VA and ask. If you have eligible dependents have them apply for ChampVA. pr
  21. Teac - just to clarify, that additional 60% need not be a single disability but can be additional disabilities totaling 60%. pr
  22. I, personally, recommend claiming all valid conditions. You can get SMC which is additional money. jmo pr
  23. I don't think the VA will change it. I recall seeing a case where the court refused to award 100% because the claimant was already TDIU and in essense already receiving the 100% rate. jmo pr
  24. Yes, absolutely!!! He'll switch to disabled and get his full retirement rate, a raise of about 30%. It should process fast, too! pr
  25. He may or may not qualify. It's currently about $985 a month and is income based, so it's adjusted based on other income and medical expenses. Have him apply and let them decide. pr
