My appeal is only one year old but I have never received a SOC or a Form 9. I sent a query to St Pete via iris about 6 weeks ago and got the return email saying they should get me an answer in 5 days or so. I have seen nothing since. I sent another query about the first query last week. Nothing. anybody else having trouble with iris?. Slowlane

Thank you marine0816 and asknod. I was at Bien Hoa 69/70 ..... smokes were $1.10 at the exchange and also made you look cool. My first cancer showed up in 2010 and I haven't touched one since. Keep up the great writing here and on your website asknod. I really appreciate your help. Welcome home -
I have a one year old appeal going for a head & neck cancer agent orange connected. Now, it appears that I have a new primary lung cancer that could be agent orange presumptive. The Question: Will the ongoing appeal cancel the new claim or screw it up somehow?????? Thanks in advance.....

New Respiratory Claim While Another Sits In Appeals.

I have a claim on appeal that was denied for service connection. It was originally approved and paid as an agent orange presumptive larnyx cancer. Then, denied and disconnected service connection as the VA determined it was base-of-tounge. I went DRO appeal....met with DRO....still denied with no statement of case or no explanation. So, I have been sitting on the appeal bench for a year with absolutly no word from the St Pete VARO. Now...I have a new cancer that has shown up in my lung......which is agent orange presumptive and also primary. MY Question is, is the VA going to cancel my claim by saying "SORRY, ONLY ONE RESPRIRATORY CLAIM AT A TIME". Or will they process this as a normal FDC?? Slowlane -

If you got on their shit list I dont care how many doctors you got they will find a way to delay and deny. Each time they make a administrative mistake it will cost you at least 2 years. And, God help you if you make a mistake. You cannot shame these people. When they deny your claim: 1. You may die........................................VA Wins. 2. You may get Alzheimers.....................VA Wins. 3. You may get discouraged...................VA Wins. 4. You will lose many years....................VA Wins. 5. You may appeal and win.........YOU Win. They run the game. They make the rules. All you have is a single vote. Change enough politicians and you will get some attention.

I flew one way 500 miles to St Pete for a DRO meeting. I presented 2 new pieces of evidence. They still severed my service connection. In their final paperwork they made a one line acknowledgement of the new evidence but, they totally ignored it's value. In my NOD I based my case entirely on the 2 new pieces of evidence and asked for a SOC that specifically addressed the new evidence. And that my friends is where it died. No SOC means no BVA........... Congressional letter still under construction.

I did not mean to change the subject. They can afford to fight a war in Afghanistan and bomb Iraq. They can also hire 300,000 employees to insure that your denials are pristine and up-to-date. Sadly they cannot afford to compensate Veterans. They will however, kill you for free with frustration, waiting lists and backlogs. Proof: the 400 pound Gorilla in the room is THE MERE EXISTENCE OF THE WOUNDED WARRIOR PROJECT. -

Kinda like the IRS..........YOU gotta buy the software and do your own taxes or hire someone...........Then the IRS gets to grade you on how well you did it. Hell, they are taking your money......seems like they would do your taxes. better yet, a point-of-purchase tax and get rid of the whole bunch. Same for the Va. -

I have informed the WACO ro that they are incompetent, unfair Dayaham Sierra, Bet they had no idea!!!!!!!!! Did they thank you for the wake-up call? I guess if all they gonna do is deny and lie......might as well get ugly with them.

This is a cut and paste from facebook: If you’ve been hiding under a log, it is possible that you have missed how badly VA is bungling the backlog issue. While some VA regional offices are actually getting the backlog down, others are still struggling to follow the law. One such office is the Indianapolis VA. There, Sergeant First Class Shelton Hickerson finally won his lifelong battle for benefits only after losing his life. Hickerson spent 20 years as a combat drill instructor after serving two tours in Vietnam with the US Army. Initially, Hickerson battled VA for years to only receive a 10% rating. The conditions are covered in the television interview, but they are numerous. Hickerson appealed and VA did not acknowledge his appeal for years. It finally provided him a full grant of 100% but then refused to provide payment. This means the initial decision was wrong by about 10000%. The justification given as to why Hickerson would not get his money right away was that VA needed to assess Hickerson’s competence. VA has a policy where they will not give a veteran his or her money if they are determined to be incompetent. If incompetent, VA forces the veteran to have a fiduciary. For Hickerson, he was in fact competent. However, VA ignored the reports and a previous requirement to file decisions in a timely manner. VA instead sat on the money for over one year. The delay lasted the remainder of Hickerson’s life. The day that he died, his family received the payment for over $370,000. VA had this to say about the Hickerson case: “The VA confirms they received their own competency report almost three months before Hickerson died… Unfortunately, we did not rate this case prior to the veterans death because the issue was intertwined with several of the Veteran’s other claims and due to our overall workload.” Source: WISH TV July 1 at 11:30pm ·

I dont know much about Gen Hickey but, they way she flipped her hair all night long was very distracting to me. It was almost like she was trying to swat a fly all night. Damn, get a friggin bobby pin.

Not like that.......I had an Admin Review showing in Ebenies for a few months....then closed.........no information.........got an IRIS generated about a week ago.......still waiting on results. -
