  1. BCMR These guys can be decent or real bastards in my experience. There is no benefit of doubt. You are dealing with mostly hardass military types. I went through a couple of BCMR appeals. I won two and lost a few. Right after and during Vietnam is was not that hard to get a discharge upgraded. After that it got real hard IMO.
  2. Not worried about backpay since I 100% already.
  3. Marine Corps.....if I am approved now I would get retro in 2026 most likely. I am trying to cover myself in case of stroke, heart attack, etc. I want to make sure that if I die due to an HBP disease my wife get DIC.
  4. Dusty.....I am not yelling at you. I will sort it out. I had a lawyer when I pursued a CUE at the Court of Vet Appeals. He did the best he could, but we both got sandbagged by the whole system. I was asking for 30 years of retro on my TDIU. I have not used that lawyer in about 8 years. I agree the VFW,, DAV, Al are pretty lame.
  5. So I don't have to send VA paperwork about who is or is not representing me? IF that is so why send the dumb letter to me.
  6. I have filed other claims without all this bs. I have an attorney and they notified him. He does not represent me anymore. Now the VA starts up with all this notification stuff when I filed 5 claims before this and not a word about representation. I am going to call the VA regional office and get an answer. Send me a F**king form. I have a 21-22 and 21-22A already. I wrote all over them that I don't want representation. Is that enough or is there more bs I have to go through? I won a claim for increase a year ago and no fuss over these issues. I will send them all this shit and be done with it. I filed online to make it easy and it is not easy. The claim is straight forward and presumptive.
  7. The form is 21-22 which has been changed to a 21-22A. It is for choosing a representative. I don't want a representative since it is a presumptive claim. However, I will send it in to the VA, but it shows to me the incompetence of the VA. This will probably delay my claim. I am not that worried since it won't mean money. I am just annoyed. Nothing we do with the VA is easy and straightforward.
  8. I very recently filed a claim online to the VA for a HBP claim via Agent Orange Presumptive. I got a letter today dated January 12, 2021 saying the form I used online at Ebenefits is no longer in use. They already received my claim and scheduled an exam for this month. Are they just stupid or are they delaying claims again on any pretext?
  9. VA so under treats pain! They claim it is subjective so hard to rate. PTSD is subjective but they manage to treat and rate that. Early on the VA just dropped a boat load of dope on those suffering pain. Now they don't want to prescribe at all for a bunch of reasons. It is true that narcotics just be constantly adjusted but that is the job of the VA doctors. Now if you complain that your pain meds no longer work the VA sees that as an opportunity to just cut your current dose. They offer almost nothing in return. This is malpractice IMO. They are forcing vets to look elsewhere for pain relief such as medical pot or street drugs. They then come down on you and refuse to prescribe for you. The VA mixes politics with medicine and politics always wins. They are deathly afraid of the DEA and would rather see a patient die or commit suicide than stick their necks out one inch.
  10. Does loss of use mean total loss of use? Both my feet are 40% each but I can still use them to an extent. My left foot is getting worse, but must I have it amputated to get loss of use?
  11. The VA under medicates those with chronic pain now days. A few years ago they were over medicating and now they under medicate.
  12. Some of these docs are so timid about doing paperwork that would help a vet. They are afraid of the feds even if they work for them. When I got an on the job injury I could not find a doc to help me except one guy who was a crook, but he helped me. The so-called honest docs would not life a finger to help. It is the same with Vet benefits and paperwork.
  13. Yes, the VA will ignore your presumptive claim until you file on it.
  14. Max If you currently have high blood pressure then you are presumptive since you are a Vietnam vet. I have high blood and I just filed a claim. I did not have high blood in service. Do you get any treatment from VA? If you get C&P for high blood then they will find you have high blood and that is it. File today for high blood! If you have any current medical records for high blood that is all you need. You may not get much of a rating but high blood leads to stroke and heart problems. Those would be secondary conditions to high blood.
  15. I just filed for high blood pressure due to AO exposure. We will see how fast they can act since all my records are at the VA hospital.
  16. I got DMII and 40% PN for each leg and 30% and 40% for both arms. Mine is AO related and has been getting worse for 20 years. When you get your DMII exam you must tell them about your PN symptoms. I think what they really look for is numbness because that often leads to skin lesions and can lead to infection and amputation. Are you not already 100%? You may be able to get housebound with 100% plus 60%. I can really feel for you and your foot problems. You need to get exams for your eyes as well as your feet. DMII has a host of secondary conditions including heart disease, kidney disease and blindness. I take two shots of insulin a day. Pain in the ass but your sugar can spin out of sight quickly and you may not feel a thing until something bad happens. I ended up in intensive care due to my glucose going way up two years ago. I was totally unaware.
  17. They won't raise the cola more than official rate of inflation and probably much less. You just can't win in the inflation game. My costs have gone way up and not just gas and groceries. Everything has gone up including all my insurance premiums, utilities and even NetFlix. Housing costs in Florida where I live are out of sight.
  18. I have DMII and if my eyes started to go bad I would file ASAP. I am P&T for 21 years but I still file claims.
  19. The lawyers want in-the-bag claims. They want to get paid. CUE claims are tricky. The system is rigged in favor of the VA. I won a CUE and lost a big one with a lawyer helping me. I was asking for 30 years of back pay. I lost on the old technicality rule. Go to court or BVA on a CUE you better bring your own lube because you will probably need it. My CUE was obvious to anyone but the VA.
  20. I would say that if VA wants you to go to an exam then go! If you don't you will probably be denied or delayed for years. If a cop pulls me over and wants my documents OK. If he wants to search my car he better have a search warrent.
  21. VA will accuse you of doctor shopping and yet they do it all the time.
  22. VA medical does not make house calls as far as I know. How are housebound vets supposed to get to C&P exam or medical treatment? How to get to grocery store? VA just cares about saving money at vet's expense. It is all about their budget and damn a vet. VA throws away millions and then denies a vet the proper compensation.
