A covered entity is permitted, but not required, to use and disclose protected health information, without an individual’s authorization, for the following purposes or situations: (1) To the Individual (unless required for access or accounting of disclosures); (2) Treatment, Payment, and Health Care Operations; (3) Opportunity to Agree or Object; (4) Incident to an otherwise permitted use and disclosure; (5) Public Interest and Benefit Activities; and (6) Limited Data Set for the purposes of research, public health or health care operations.18 Covered entities may rely on professional ethics and best judgments in deciding which of these permissive uses and disclosures to make.   3. I would get a second opinion on the lumbar strain, you likely have a bigger problem, especially that they rated you 40 for it. The va likes to put the wrong diagnostic codes on ailments to deny you care and manipulate data.
  4. OK I finally got the MRI I had been begging for going on 3 years. I later get a letter from my dr stating no additional action needed and the results of the MRI were interpreted as contradictory to what 3 previous doctors had reported. I messaged my primary and requested to speak with the Radiologist who actually read the MRI. A phone number was provided via my health e vet and I called the doctors office and was transfered to the actual doctor whom read the MRI, or indicated that he read the MRI. I told the dr I wanted to discuss the findings he had concluded abt MY Mri. I was immediately told that he could NOT discuss MY Mri results with me, due to HIPPA laws. This doesnt sound right, They are MY results, I am the veteran, why cant the doctor who read my MRI discuss his findings> I made a complaint to the chief of staff and await a call back so we shall see what they do.
  5. Brother, can I ask you if you have thought of getting off of alot of the medications and see how you feel. Maybe ask to go in a controlled enviorment, like inpatient supervision, and just try it,. psyche drugs are very powerful . Maybe think abt it. They had me on some tramadol a while back it it made me have horrible nightmares. Im not trying to play doctor, but sometimes drugs actually start to do the opposite of what they initially do when taken for long periods.

    I was talking to a guy who was CIA, here in Texas, and he told me we had been In Laos and cambodia since the mid 50s/. I often wonder why the United States didnt shut down the ho chi min trail. All of chinese weapons and supplies coming thru on bicycles, donkey carts, ect, it seems we could have blown craters the size of stadiums in the trails or set it on fire or something. Ho Chi Minn himself said that if we had shut down the trail, they would not have been able to sustain fighting very long at all. I know we werent supposed to be in Laos, but why not stop the trail cold at the border.. Just thinking outloud as I was still in my dads testicles until 67.
  7. RB.. you cant believe ANYTHING the VA reports as far as stats . They lie so much, they cant even figure out themselves what the real numbers are. So please dont base your own investigation on what VA reports. Also, once the RO denies and it goes to appeals the claim is no longer in the VA bean count even though the veteran is still not taken care of, they can say the claim is complete. How on Gods green earth can any accuracy be even REMOTELY possible , when they are finding file cabinets full of unadjudicated claims, boxes of claims found hidden in the woods behind ROs, ect. The VA s reporting of claims reminds me of a news program I saw during the second IRAQ invasion. The american reporter was interviewing an Iraqi official who was one of Saddams goons. The officials were trying to stall the coalition forces as long as possible by telling the Iraqi troops to hold on and dont run, while Saddam high tailed it out of Iraq with a suitcase full of 100 dollar bills. While the reporter was speaking with this Iraqi official, the official said " there are absolutely no coalition forces in baghdad and we are still in complete control and will fight and defend mother Iraq to the death". A few seconds after he said that, an american M1 abrams rolled by behind him, waving an american flag,.. The VA leadership is the same way, they deny , lie, and conceal, and try to say they are making progress, when all tangible proof shows otherwise.
  8. We need to keep our focus on change. what we really should be pushing for now, is open communication between us and our RO. So many things could be easily cleared up, but the question is, do they really want the correct information, because they know its going to result in ALOT of higher ratings and compensation. THE VA HAS BEEN GETTING OVER ON VETS FOR A LONG TIME. Well the party is over, They will have to figure something out because information spreads like wildfire nowadays and the lies are being exposed.
  9. like me, I fell ill with kidney cancer and had to get surgery quick, after recovery I filed a claim. It was service connected eventually but they didnt pay me temp 100 percent for the cancer. I would think thats an inferred claim. even though I didnt file a claim until after surgery. (they are trying to screw me on this one as well)

  11. Does the new rule mean that aside from other things, if you are hospitalized and notify the RO, it doesnt make it an inferred claim, and you must fill out a form before they will acknowledge it is a claim? like if you had an emergency surgery like cancer or something, ?

  14. Just the fact that the CP examiner asked me abt compensation and service connection, is a false CP exam, THAT SHOULD NOT BE THE CONCERN, the medical side of things should be the only concern.
  15. I believe it is a system with intentionally built in delays., to slow the flow of compensation. It is the most ridiculous system that I can think of on the planet.
  16. I believe alot of times the only reason for the CP is to give the VA the silver bullet to deny the claim , not approve it. The CP examiners and RO rsvr s are in frequent communication via telephone abt veterans claims regularly, I know this for a fact. I had a CP examiner tell me this, and tried to call them while I sat there. When I arrived for my exam, the very first question asked, was abt a long standing claim, that could be a whopper. I wasnt even there for that specific reason, I was there for other things. I believe that because the question was a the top of her list, and mind( SIGMOND FRUED)., That the question asked was a hopeful chance to screw me. Hoping I would say OHH my back is fine, it doesnt bother me anymore. I bet she would have broke the damned phone trying to call the RO, and get some brownie points. anyone who doesnt know, SIGMOND FRUED, was a doctor who proved that what is foremost on your mind, will be said. The very first thing that was asked, which had nothing to do with why I was there was WHY ARENT YOU SERVICE CONNECTED FOR YOUR BACK? my answer was,, WHY DONT YOU TELL ME? Why in the hell would she ask me that right from the start? she didnt do anything to help me at all, she downplayed everything, made several wrong statements and checked several wrong boxes. I have successfully challenged 3 cp exams, of which I got 2 more botched exams, which have been contested. Its a rat race people, it really is.

I would think that because if CP exams are done at VES that we cannot see until the claim is already rated, this is a problem., Also last I heard, veterans cannot see the results of CP exams done a VAMCs now either. This needs to change. The VA wants to do everything in secret and keep the vet out of the loop. OUR tax dollars pay for those exams, and they hide them from us. I feel that many times, the denials start long before the get to the RSVR.

If I has a Ranger tab, and was in 82nd, I would be ok with saying I was part of a special unit. there are several special forces, delta force, ranger battalions, hush units that you only know abt if your in one, , ect. I recall during NCO academy one of our instructors was a Ranger that jumped into Grenada and got shot in the leg.

Im sure he likely wasnt trying to mislead,, he was in 82ND Airborne , 82 is a special division, it is a rapid deployment division , ready to be boots on the ground almost anywhere on the planet in 36 hours. So in trying to connect with the homeless vet, I think he was just trying to get a rapport of brotherhood established to gain trust. this is my personal opinion.. Lets keep something in mind, people who have been terminated from the VA, by the hand of the new SEC, they are going to try and dig up any dirt they can to try and smear his name, lets not fall for that BS.

  21. I would not have confidence in the VA to gather evidence even though it is thier job. I would submit everything that could help my claim. if its redundant, its better than non existent in the C FILE. I recall being told by my DAV rep before I dropped them.. " they have everything, dont worry abt it"/ well surprise, they didnt have everything., whether it was intentionally omitted or just not stuffed down thier throats, I dont know, but now they get everything served on a green card.
  22. or go to your local friendly, helpful RO where theres a legion of helpful ctitters just waiting to assist you copy what you need.
  23. to add to this great info, I have read that the same level of expertise and comprehensiveness used to initially diagnose that granted,. should also be used to reduce or deny.
