  1. My advise would be that if you think by any stretch of imagination that you have ANY gulf war related ilness FILE A CLAIM NOW. Even though you may get a bullshit gulf war exam, by a bullshit Cp Doctor who is being told by the Va to opinion that you dont have gulf war ilness and manipulates your medical data, that doesnt mean you cannot go outide the Va and see a fair and impartial doctor who will tell you the truth and win your claim. DO NOT HESISTATE FILE BEFORE THE DEADLINE in 2016..... THERE IS A REASON THEY ARE TRYING TO CLOSE THE DOOR. !!! You may not live long enough to see the comp, but your spouse and kids might,,FILE TODAY!!!!
  2. DOD is now studying us gulf war test rats,,, WHY because they are afraid that present day soldiers are going to get gassed in the future/. They want to study us, but not compensate us. WHY praytell would they make the ilnesses presumptive if they didnt know it was real and common? WHY praytwll did Undersec Hickey attempt to have Gulf war veterans as a class be abolished and just called iraq war vets> THEY KNOW, !!!! The VA will dilly dally around until they think most of us are dead before they fully admit and compensate us, or until something similar to the Neimer actions take place, and the Govt gets sued into submission. Right now, the govt is playing slick... very slick, with the bullshit presumptive laws they can say they are doing the right thing, and avoid a Neimer type lawsuit and still screw the Gulf war vets over, because of the deceptive way they wrote the rules.. I would hope that in the VERY NEAR FUTURE that NVLSP will file suit and end this scam the VA is running on gulf war vets...

Berta that is why I try to encourage all vets to get as much testing done at the VAMC as possiblr like xrays, bloodwork, MRI ect, then go pay for an outside doctor to interpret them.. dont show them the report that the va doctor wrote,, just the Mri scans, xrays, blood results, ect.. private sector doctors have no dog in the fight and will not risk thier reputation or a malpractice suit to cover for a va doctor. Va doctors dont have to havew expensive insurance , they dont even have to be licensed. They cannot be sued, they wont be fired unless they get caught commiting a homicide in the act. The perfect job for a turd doctor. I had a doctor for one day and was told he quit 4 days after being hired.. that should tell ya something. I often wonder if the VA makes new docs sign confidentiality aggreements.

  6. yes I believe they call it 'THE APPEAL REDUCTION PROGRAM" which basically says that the VSOS are "encouraged "" to " confer' with the Rater before they ask for an appeal.
  7. your missing the big picture im my opinion.. im going thru something similar right now,,, once your licking at the 70 percent mark, they get very squirrelly, because they know at 70, your likely pretty broken up and would LIKELY qualify for TDIU... just as good as a hundred percent but sometimes easier to get. If you keep that service org representation, your likely not getting your full ice cream cone.. These people work in the same rooms as DRO s ect, and Ive seen this with my own eyes, and own these words.. The system is set up against the veteran, and when you get qualified veteran friendly help that is not under the heel of the VA . everything changes.. Also I have gotten several CP exams in the last several years, and not ONE was completly accurate. The modus opperandii seems to be that they expound on things that can hurt the vets claim, and minimise , or obfsucate things that can help the vets claim. The way my last CP exam was written up, there is no doubt in my mind that the denial were a collaborated effort between the VA and the CP examiner. There is just way too much cutting against my claims with the wordage used in a methidical way against my claims. its no coincidence.. When the whole CP exam is read, thhere is a clear pattern that keeps nipping away at the claim, until its like a 3 legged stool, once they chew away at one leg long enough., the stool comes crashing down.. thats what they do.
  8. its HIGHLY likely that many of your disabilities are lower than they actually should be.. Take close examination of what you are being rated for, and if it actually fits your condition. It seems the VA likes to decide what your disability should be, rather than what is actually wrong.. The va wants to term conditions to fit denials.. naturally progressing things like degenerative disk disease of the lumbar and cervical spine are a favorite./. because they can say its not service connected, its normal age related deteriorartion. I myself had, ans am still going to an outside doctor to get accurate diagnosis of my problems, and having the VA doc add these to my problrms list,.. another favorite the va uses is congenital defect.. they try to say you were a broken pot at birth, If you read radiology reports from your VA you will likely see many words such as,, minimal, miniscule, not in normal limits, moderate ,, slight, inconclusive, ect. ect.. The diagnosis and reports always seem to be on the ? de minimus"/ From personal experience it is my opinion that the doctors and radiologist are being instructed to downplay and deny injuries and ilnesses, for 2 reasons.. UNO... to save the VA money by denying the treatment of veterans inside the VAMC DOS'' to thwart compensation claims once they get to the RO In my experience if you get a CP exam at a VAMC you will likely get screwed. The closer you get to the 70 percent range, the more they roll stones down the hill.. They have figured out, that vets are getting educated, and they dont want you to be eligible for TDUI. If you have 20 percent, and go file for tinnitus, they will grant you 10 like it is a flu shot... but if your knocking on 70 and go apply for a 10 spot,, here comes the boulder rolling down to squash your ass. The VA IS LIKE WAKING UP TO A BUTT UGLY date after a hard night of tiny bubbles.. the more you see the uglier it gets.
  9. if you do a little research you will see that spinal injuries was the top ailment for a long time,,, " so what has changed" ? I dont think its that injuries are decreasing, its more that problems are not being acknowledged. The human body was not designed to carry 80 pounds of junk over long distances and jump out of planes and trucks with it on our backs with a 2 pound helmet on.
  10. Or is it just another stall tactic to delay the process, and maybe fatten the bottom line of outside contractors such as VES.? . I would be interested to know how much the outside contracted examiners make a year.. not the doctors but the contracting entitys.. The cockroaches refuse to pay me 10 percent for a undisputable, service connected painful scar, yet they happily pay 4 different medical personell to examine the scar.. what a system huh"

I believe the requests for CP exams is a cover thier ass move,,, The VA loves to pass the buck , so I would imagine when they are asked, why hasnt ANYTHING been done on the vets claim in 2 years,, a quick answer would be,,,, uhhhh we need current exams, and were trying to schedule them now..Im going thru the same bullshit... In 2 years ive had a SCAR examined 4 times, by 4 different examiners.. its really getting old..
  12. im surprized they arent dumping the Tramadol down your throat,, thats cheap, synthetic, trash, prison grade medicine.. It gave me very primal nightmares of seeing dead rotting bodies and bones and life like horrific dreams.. when I told my doctor abt it,, his answer was... " that doesnt surprise me"'' well if they know it does this, why the hell do they give it to veterans.. Heres something to check into.. real doctors in real hospitals now use lasers to deaden the nerves that are getting pinched. very small hole, then they identify the nerve being aggravated, and burn it,, BUT nerves do grow back., so the treatment is chronic.. like every 6 months or one a year,. VA knows abt these things but its expensive.. not the treatment, the EXPERTISE .. Its hard to find good doctors who will work for the VAMC... ( veterans ambulatory medical Circus)..

OK heres what goes down.. you show up 1 hour before your scheduled hearing. do not park in the spots that are numbered, there are visitor parking spots. if you get there early in the am, the employees will be going thru the triple layer of security.. you put your stuff thru a scanner, get question by a few _rent a cops, and are told where to go.. you are basically " handled " from the moment you arrive, until you leave.. There shant be any b/ TOUR DE RO".. You can go to the cafeteria, or the crapper, and nowhere else unless directed.. You are permitted to bring notebooks and laptops, and they record serial numbers in and out, so you dont walk out with the wrong laptop.. mainly one of theirs.. The demeanor of the employees seem very casual, and lackidaisical, towards each other, lots of smoking and joking in the parkinglot, and hobnobbing in the cubicles.. No big sense of urgency was sensed. As I sat waiting, bored and very sleepy, I spotted the honorable sec Mc Donald pic on a wall in the lobby and thought to myself,, wouldnt it be fun to start a rumor that the SEC was making a visit today.. I was just curious to see if the subject matters being discussed would change from last nights basketball game and LeBrons frustrating night, to the passionate quest to end the backlog and gets some claims done.. My better judgment took over, and sat silent and kept observing the goings on.. Employees seem to trickle in at different times. and everyone was quite friendly to one another.. So finally Im summoned to the hearing room. Just a small room,. very well lit., with microphones and recording devices/ I am administed an oath to tell the truth and then told why I am there. The hearing goes quite smooth and non adversarial, and the RSVR takes short hand notes on a legal pad. I feel like I had ample opportunity to present my facts and reasoning and everything went smooth. I said what I wished to say, and presented evidence that I felt could be beneficial and was asked several questions then the hearing concluded. I chose to share this experience so that any veterans who may be scheduled for a hearing in the future can get an idea of how things work.. It was not a grilling or cross examination, or a pissing contest. If you feel you would benefit from a personal hearing,. you can request one at any time.
  15. ALSO research the difference between SPONDYLOLYSIS AND SPONDYLOLYSIS -THESIS.. BIG DIFFERENCE.. I would bet you have the Thesis.. which means the nerves are likely getting pinched..
  16. I dont like to see words like " back pain" knee strain'' neck pain ect.... thats all horseshit .. those are symptoms.. I would get an MRI, of back, and neck, and go let a specialist BLIND read it.. in other words, dont tell them what the VA report says.. you will likely find out your " back Pain" is a slipped disc, pars defect, broken vertebre, arthritis ect.. From the long list of symptoms, you have did they check you for Fibromyalgia? rhumetoid arthritis?

  18. Berta i believe the term attorneys use is that the evidence is ' raised of record"... meaning that the info was available to the VA and claiming ignorance is not a valid reason to omit. IE a surgery was performed at a VA hospital, that was because of a secondary disability.. For instance, a person gets kidney cancer as a result of service connected hepatitis.. The patient gets surgery, then files for disability for the kidney cancer.. The evidence was raised of record when the claimant filed.. That is how I understand it anyway.. anyone knowing more plz correct me if im wrong.
  19. there is a reason the VA highly recommends VSO s and it takes divine intervention to fire them once you lnstall them as your power of attorney.. Bringing most VSO s (not all ) into the baTtle is like bringing a blind man to a knife fight, they might get in the way, offer support, but likely wont get much done.. JMHO I own these words and speak from personal experience.
  20. ok you recieved an extra 20 percent because of the reopen and his help.. so lets do some figuring here... lets see how long it took to recoup your 2 grand,,, maybe 6 months>>>> and now your banking that extra 20 percent like clockwork??? what im I missing here.. I wish there were private investments in the business sector that paid that kind of retuirn.,. JMHO..
  21. Take iraq for example we went 3 times, declared victory twice, spent BILLIONS of dollars, then left the country worse than ever.. BUT THEY DONT HAVE FUNDS TO TAKE CARE OF VETERANS!!!!! BULLSHIT!!!!!!!
  22. Yes sir it is pathetic that a veteran most endure so much suffering because of the VA. What is going on now, in my opinion is that the VA is paying for its past sins.. For decades veterans have been getting the short carrot because there was no mass communication among veterans. All we had were service orgs who live in the VA and are submissive to the wants of the VA, not so much the veteran. How many 10s of thousands of vets never got a penny from the VA or a bandaids worth of treatment.. With the information digital age, we are no longer in the dark, and ignorant to the laws and regulations, and whats going on inside the VA.. many many, veterans are finding out, that they have been wrongfully denied, 5, 10, 20, 30, 50 years ago.. that wrongful denial which is not the veterans fault, can sometimes lead to BIG retro,,, Just imagine if you were the claims examiner who denied a claim 20 years ago, and it pops up again and have to deal with the veteran.. Do you think they will say they screwed you and just service connect and retro? I bet not,, I just cannot for the life of me imagine a claims rater going to a supervisor and saying, I am going to need to submit for payment to this veteran, seem 20 years ago we dropped the ball, and he has caught on.. looks like we owe him 655.000 and 42 cents, can you cut him a check? Im sure it is a huge setback in the beancount when this happens.. \ In this present day and age, the govt seems to like playing the " were broke" card.. I dont buy it.. Broke countrys dont give hundreds of millions of dollars a year to other countries and keep thier armies at war for 15 years with no tangible fruits of war to show for. Fight tooth and nail for what you have earned and always remember.. the VA screwed up .. not you This is just the tip of the iceberg,.. they have pissed many veterans off, and word is getting around, and veterans are going out of thier way to help other vets not get shafted... The sins of the VA s past is here and its going to be very expensive.......

ALSO if she told them in the initial claim she hurt her back, and they knew it was during combat operations in a wartime theather, she may have a CUE cliam... that means she gets paid back to her original filing date// DO YOURSELF A FAVOR GET A BENEFITS AGENT..
