  2. Make sure you get a copy of the exam just to see what she actually put in there. Sometimes they make mistakes and the sooner you notice them the better. My first exam had some obvious mistakes and I made the mistake requesting it too late. Frank

  4. Here is something else that's side tracking a little. Since you went in for the shoulder and they said nothing was wrong and soon found out you have two torn rotator cuffs then there is another type of claim you can file when VA health care negligence is involved. If I understand your post correctly you would have an adequate case. I would file for secondary first though. That is if i'm reading your post correctly. If you can elaborate more about your condition(s) then we can help more. Since your rated 70% for this it might weigh heavily on the TDIU exam. Really this is all I can contribute since I just know what's in your post. How is your depression doing? Frank
  5. If you fell and injured your shoulder because your S/C knee gave out and have this in your records file for secondary. As long as your depression hasn't gotten better shouldn't be worried. Sounds like you're definetely not able to do any work from reading your post. Are you getting SSD for your S/C conditions? Frank
  6. Looks like your attorney is getting the VA's ball rolling. I don't have an attorney but was thinking about getting one myself. From your experience it looks as though having one really helps. I might consider getting one if they deny my claim for IU. There good at catching stuff we tend to overlook. And their more pro-active than VSO since they only get paid if you win. Correct me if i'm wrong on that though. Frank
  7. yep yep, I have been diagnosed with MDD, bipolar 2, and anxiety. Since I have so many dx they rated me for Mood Disorder NOS (Not otherwise specified). I guess that rating covers them all which is good. Frank
  8. They might go ahead and give you P&T if you make the BVA hearing. Heck, what do you have to lose by going? That's my opinion on it. Frank

  10. No no no no no no no, don't check that box. SSDI and Unemployment are two totally different things. One is state and other federal. It doesn't do you any good to check that box except that you will lose your unemployment. SSDI considers you disabled due to the fact you cannot sustain work, not trying to find work. I know, I get both right now. Been getting both for about 12 months now and with extensions I get Unemployment until Dec 09. Frank

  12. I'm not sure if the rules for Unemployment and SSD are different in other states but in California anyone can get BOTH Unemployment and SSD at same time. Their rationale for this is, just because you are getting SSD doesn't mean you aren't trying to get off it and work. Also, one is State and one is federal so they don't conflict with each other. I have been getting Unemployment AND SSD for over a year now because of all the extensions since CA unemployment is so high. Normally Unemployment is only 26 weeks. If in another state though I would confer with an SSD counsiler as far as any rule differrentiation. Hope this helps, Frank
  13. Kelly, i'm not trying to step on your toes but telling the VA their evaluations aren't long enough is like telling them they take too long on deciding claims. Ain't gonna help your situation. Just do like was suggested from the elders and get an IMO. I see the examiner also used that dreaded personality relation. That's a killer and concedes the likelyhood you will need an IMO. Frank
  14. Hi Elliott, It really depends on your evidence and your individual claim. I have heard of appeals here on hadit taking about 6 months all the way up to many years. Hope for you it's sooner rather than later. Sincerely, Frank

  18. Rockhound, I feel for ya, I went through the same thing. I didn't have an IMO either but I finally got one, actually two, and they got my claim granted. If you can see if your treating physician will write you an IMO regarded the connection. I handed my C&P exam to my VA doctor and he said, "Hell no" that is wrong what the examiner put in. He was more than willing to contradict the examiners opinion. Hope it works as well for you as it did for me. Good luck, we're all with you. jay

  20. The DAV is representing me and they are normally located where your regional office is. There is no certain time limit to your claim being rated but you should feel good because you're at the home stretch. Mine took about 4 weeks from the time it was being rated. Jay
  21. I already sent this post once and somehow and it didn't post for some reason. I found out today there is a time limit for adjudication of my claim. Sometime in July it's supposed to be rated and finalized. Jay
  22. They should have had your personnel records before sending to BVA. I would be really angry too. Good for ya to blow some anger off your chest though. Hadit is a good place to do it instead of going out and getting in trouble. Lot's of support for you here comrad. Jay
  23. Carla, i talked to my DAV rep today and he said they have a mid July completion on my claim. Just thought you might want to hear this since you stated they have no time limit. Jay

  25. I get SSD and VA Comp. I got my second 250 today. Is this a mistake because I thought I was only supposed to get one? I'm going grocery shopping or maybe I should put in my savings in case they want it back. Jay
