Question

It went well and I was able to stay on point as the cards feel as you guys intended. We got started on the PTSD and the stressor, and the Borderline Personality Disorder they tried to stick me with GONE! Soon as I started I had 4 IMO's for PTSD and the C&P "Examiner" stated my condition look more like PTSD but I had a "Borderline Personality Disorder" on a Mental Health eval and was talking about PTSD when he did have that exam sheet to work from only Mental Health had he had the right sheet he might have been in line with the rest of the Doc's, so he agreed it was screwed up he should have never mentioned PTSD,(he,he right he screwed up alright he was suppose to screw me permanently)and as for my stressor it was all a big misunderstanding the had 2 people working my claim and there was a mix up and my stressor or my commanders letter got missed they really didn't need the JSRRC letter so they granted the stressor, honest mistake that set me back a year plus and I came within a nat's ass of getting a "Borderline Personality Disorder" stuck on me for the rest of my life. He ask if I would take another exam but for PTSD, I answered that they don't need one you have Mental health records of constant treatment and I continue to receive treatment but if you want sure. He was very pleasant nice guy really wanted to help so what happen to me he had nothing to do with. and went over the back and the incapacitating episode and wants me to take another exam for that as well and he wants the SSD paper work before he makes his final decision, I have to say I think the hadit members put together one HEll of a tight case and saved me from a BVA, time is on my side now and it looks to be a lock once all is done..Thank you you long timers for getting your hands dirty and all for the help you all have provided over months and months worth.......Yog

Sorry, not to be a cry baby but,

Damn Shane now I feel like I won the battle but the war rages on. I get going to a PTSD exam but a Physical exam to? like I said it feels like going through it all over again but with a clearer view from both sides(because the other side screwed up on trying to screw me) but still yet the process starts all over again. Now I am not a loud to submit current records as evidence and they will be reading from their C&P's. Its funny like that, you walk away feeling like you killed but once you have a chance to let it sink in they got a second chance too but a new angle Jesus Christ this shit make me insane. Rich

Calm down. We both know you will do just fine. We talked about this, remember, they pulled the same crap on me

and it back fired in their face.

At my age, the Social Worker at the R.O thought I would be a No Show.

When I received the date of my C&P, I was ready to fire right back. I was more ready for this

C&P than any of the three they had already sent me too.

Hang in there and call me when you receive you notice.

Take a breath, Rich. This is just a C&P exam and it should be expected. This is what they do, because they aren't smart enough to put two and two together and rate off the evidence in front of them. That would mean that they have to dig some and read it all in order to get all the information that they need. So, they instead use the "inadequate for rating purposes" crap on us. You really did have a big WIN this morning. Now all you have to do is study the exam sheets and rating criteria one last time and then go in there and knock them dead. :rolleyes:

They may not do crap either, I asked him why? why do I need another with current MH records and he never did say just said will you attend another? I did say sure I'll do another,lol

When the DRO mentioned requesting another exam, maybe you should of answered: "What question will another exam answer for you that is not already discussed or answered in the current medical records present??" (Possibly--just the most current level of the disability as prior mentioned.) However, may be not. Could the DRO just have been walking the fine line of "decisiveness"? Sometimes it could be best to answer a question with a question? Also, I wonder if the "inadequate exam for rating purposes" problem could be resolved by the VARO not paying or reprimand the physician for failure to follow the physician's guide/or exam protocol.----They(VA) comprised the exam, just (VA physician) answer the dang questions so they can RATE the veteran. The VA doc just don't seem to want to answer all the questions on their own exam sheet. Why does the VA then use a "disability exam worksheet" which many VA doc's appear to ignore??

Me I would take the exam it will probably be scheduled quickly as I think that these guys have some new incentives to clear out old claims.

You can sign a waiver and tell them to rate the claim with the evidence that they have. I think taking the C&P is less riskier but its your claim and I will remind you that when I first talked to you I told you that you had a good claim.

Glad that you got personality order fixed.

You are in the home stretch and DRO will move in a few months.

As always good luck and don't worry so much.

      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
