Got 2 Packets From Ss For My Ssdi And Ssi Claim

Question

I got 2 packets one from atlanta one form kentucky (or at least that is where they are to be returned to) Do anyone know where in the process I am. No appointmetns as of yet. They asked what i did day to day and my work history again. my work history is sketchy there could be some jobs i forgot to be honest i have had a few of them.

Can you tell me anything about what is going on any of you who know.

I applied for ptsd only. I submitted my nexus as proof as well as my medical records and my long list of medications i take. I take 2 heart meds, 1 for diabetes, 1 for sleeping, 2 for pain both narcotics, a muscle relaxer and a tablet for my ptsd.

my gaf score was 48

I am wondering if its going to take years and if it possible i will be approved from you guys opinions. any info as stated would be appreciated.

according to http://www.allsup.com/about-ssdi/ssdi-guidelines-by-disability/post-traumatic-stress-disorder.aspx I do meet all of these qualification as far as symtpoms ect.

First, you need to remember that SSA SSDI is 100% or nothing!

Next, you will need to know what the SSA records show for your contributions.

Finally, as to work history. The SSA records should show what years you were employed, and the per year contributions.

With this information, it's possible to use the SSA web site to calculate a rough estimate of what SSDI/SSA will pay.

Having said that, I'd also say that (assuming you have adequate medical treatment records) that it's better in your case to apply listing all the conditions that have a significant effect on your ability to gain and hold a job.

Another interesting tidbit has to do with your age when you apply. The younger you are, the harder it is to get SSA to grant SSDI. The optimum age is actually just before you turn 62. Since you can apply at 62 for early retirement (assuming enough credits), SSA considers the dual application as showing that you are really not able to work. The early pension will be paid, and assuming you are successful with the disability claim, eventually the retroactive difference will be paid, along with a change to SSDI. The SSDI rate is the same as if you had taken normal SSA retirement at full retirement age. When you actually reach full retirement age, the SSDI payment reverts to normal retirement. If you can show disability prior to the date of application, the law allows (if everything is done correctly) a retroactive date for the start of eligibility and payment. This may add say six months payment(on average) to your SSDI.

As to how long it will take SSA, that's anybody's guess. I suspect that they may send you to an exam at some point to determine your disability level. The exam results and your medical records are normally reviewed by a state agency (Kentucky?) at SSA's request. You may eventually see a document that says "fully creditable", if your claim evaluation is favorable.

If you want the process to take months instead of years, I highly recommend finding an attorney who will help you at this stage.

Most SSDI attorneys say "Come to me after you've been denied" or "been denied twice" because the majority of applicants are denied at the 1st and 2nd levels.

Just my 2 cents.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
