Got Tdiu -Now Letter They Are Trying To Take Away

I got TDIU some time ago(as I should have)I was an attorney by former profession-I was sent questionairre @ whether I had worked in last 12 months-I do what I have to do to maintain my license -CLE education,etc-also/ I did a will and maybe one other matter-very low income-less than 9000$ or less in one year maybe I did not fill out form correctly-I dont know how to answer the question in that I am still an attorney- but they are trying to reduce my TDIU to 80%-my Drs will say I cant work-but how do I address this mess-thanks for my HADIT friends Is there some case that says that marginal employment is not enough to cancel TDIU-also should I go to local VA office and seek assistance-I know to and will answer by Reg Mail.They are trying to say that I worked for twelve months-but I really did not-other than being licensed-I cant work physically-as my Dr will say I am 66 years old/also on social security

I provided two new IMO letters from two of my Doctors as to my service connected injuries being permanent and rendering me unable to work-permanately disabled-also submitted a VA form 21-4140-the letter I received said if I furnished "all necessary information to certify that I remain unemployed,no action would be taken"-Well it must have worked,because benefits continue and no further action or procedings(I had requested a hearing,it they intended to proceed with reducing my benefits,take away TDIU- thanks for all the advise which was helpful

You need to edit the post you made this morning at 12:16am, so that we don't confuse any future readers of this thread. I see you also mixed up Pete53's quote, in your 12:17am post. Perhaps you, or with Pete53's help, could go in and correct your mistakes, by moving the quote marks to the correct places.

Again, I am pleased to see that your TDIU issue was straightened out.

What kills me is the vet has to depend on the VA processing the employment questionaire in a timely way. These screw-ups could lose their butts if they were not sitting on them. I send the darn thing in early before I get any prompt from the VA. I am TDIU ten years.

Is the form 21-4140 the one that TDIU vets need to send in? My TDIU was granted last December, and is P&T (got the commissary card, CHAMPVA for my spouse, etc).

Is TDIU ever really P&T? Will the form need to be submitted forever?

After 20 continuous years, you are not supposed to have to return the questionnaire. However, nothing is certain with the DVA! My UI was scheduled to be rescinded after 28 continuous years, twice because I failed to return the questionnaire which the DVA never sent and which I never received.

5.08 CONTROL OF EVALUATIONS BASED ON INDIVIDUAL UNEMPLOYABILITY

Prior to October 1, 2005, if a veteran was assigned a total disability evaluation based on individual unemployability, BDN would automatically issue an annual letter (VA Form 21-305) reminding the veteran of his/her responsibility to immediately notify VA if he or she returns to work. Effective October 1, 2005, an employment questionnaire will be issued to this same category of veteran for a period of 19 years or until the veteran reaches age 69, whichever comes first. BDN will automatically establish controls for the return of these questionnaires. The Income Verification Match will also monitor the veteran’s employment status. See M21-1MR, Part X, Chapters 9 and 10.

a. Exceptions. Controls under this section are not required in any of the following instances:

(1) The veteran is 69 years of age or older;

(2) The veteran has been rated totally disabled for a period of 20 continuous years, which protects the evaluation from future reduction under 38 C.F.R. 3.951(a); or,

(3) The veteran is assigned a 100 percent schedular evaluation.<br style="mso-special-character:line-break"> <br style="mso-special-character:line-break">

5. Continuing Requirements for IU Award

5.a. VA Form 21-4140

After the initial IU award has been made, the veteran must submit a VAF 21-4140, Employment Questionnaire, on a yearly basis to certify continuing unemployability. The VAF 21-4140 is required unless the veteran is 70 years of age or older, has been in receipt of IU for a period of 20 or more consecutive years (as provided at 38 CFR 3.951(b), or has been granted a 100 percent schedular evaluation. The form is sent out annually to the veteran from the Hines Information Technology Center and must be returned to the regional office. It requests that the veteran report any employment for the past 12 months or certify that no employment has occurred during this period. The VAF 21-4140 includes a statement that it must be returned within 60 days or the veteran’s benefits may be reduced. Completion of this form has a major impact on IU benefits in one of three ways, as described below.

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
