Voc Rehab Called Me Today

After four years the new Voc Rehab Officer who has been very nice to me called and said a new bed has been ordered and I should get it soon. Its not here but sounds like we got it.

Don't give up no matter how discouraged you are with any claim. Things change and so do people. I have had four voc rehab officers.

I am pretty sure they are going to turn down the a/c that was recommended but I will probably appeal that.

So don't forget to have an open mind and don't be afraid to ask for stuff cause they do have a budget ot 25,000 for each Veteran they qualify. They won't tell you.

The reason for Independent Living is to keep a Veteran in their home. Also a Veteran who rents can get stuff if the owner agrees.

Veterans deserve real choice for their health care.

I am writing my memoirs and would love it if you could help a shipmate out and look at it.

I've had a few challenges, perhaps the same as you. I relate them here to demonstrate that we can learn, overcome, and find purpose in life.

New beds are Nice!!! How will you train yourself to sleep on your back? Guess you can start in the "up" position and lower yourseslf down a few notches a week?

Dear Wings:

It is actually amazing what has happened. I have slept more in last two days than I usually sleep all week. When you lay down you slowly sink a little into mattress and it sort of locks you in. The man that brought the bed adjusted the bed where I am slighly raised at head and feet and saved the position. Now when I want to sleep I usde 1 pillow and set to sleep. I used to toss and turn but pretty much stay in sleeping position on back. No more 4 to 6 pillows and sleeping on side so far at least.

To be frank if I had to buy a bed like this it would have never happened. And yet a good nights rest is probably a thing I have had the least for over 20 years and maybe longer.

I am not saying that everyone needs a bed like this but it is something to consider if you can get ILP from Voc Rehab. Most people who do not sleep well underestimate the value of a good nights rest but many of the people we deal with do.

This morning I woke up at 6 when the massage feature started working. Freaked me out a little need to find out how to turn that feature off.

The shower I got from the grant has been great and the bed is fantastic. If that is all I am still happy and this spring will go ahead and get a new a/c system and make payments for 2 or 3 years.

The main reason I have posted about this is cause I think that not many Veterans are aware that a monthly check is not all that they are entitled to get from VA.

Mike Harris used to be our goto guy about Independent Living. He helped and still does a lot of Veterans. If I can help in any way I will try.

I guess if you have a CPAP sleeping on your back and being comfortable is important. What kind of bed did you get, Pete? I have an adjustable bed regular springs. My problem is my lower back. I have pillows to put under my knees. I can'g sleep on my side since I have problems with shoulder injuries and TMJ.

Pete, I bought one of these. I love it. The only thing I see wrong with it is the fact that it is hard to get out of. you kind of have to roll to the edge and fall off.

Another advantage is that you will never have to worry about bed bugs with that mattress. Aint going to happen.

A Veteran is a person who served this country. Treat them with respect.

A Disabled Veteran is a person who served this country and bears the scars of that service regardless of when or where they served.

Treat them with the upmost respect. I do. Rejection is not a sign of failure. Failure is not an option, Medical opinions and evidence wins claims. Trust in others is a virtue but you take the T out of Trust and you are left with Rust so be wise about who you are dealing with.

Hi all....Gives me hope.....Contract consulant was here the 22nd. She was going to recommend....1. New bed 2. new walk in shower. 3 Stool riser...4. computer ( Desk top)...Garage doors (old ones wood and I can't lift because of back ddd....6 A chair that lifts you up and throws you to the floor...Just kidding on last part..

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
