Question

Hello, during my VAMC psyche appointment today the doctor said that she has connected my PTSD to my service connected injuries. I had already mailed in my final evidence 2 weeks ago for TDIU. Can I add my mental health records to be considered for secondary, or is it too late?

Ebenefits has my claim under still gathering evidence. The deadline for submitting new evidence for SC was 4/25/12.

Thank you.

You can file a claim at any time but remember this. It can cost you time. On the other hand it can also be helpful in an IU claim.

It is really a catch 22 but some bottom line means it is your claim and your the one who has to decide.

Personally I would do it as it seems favorable and will help the claim I already have in.

A Veteran is a person who served this country. Treat them with respect.

A Disabled Veteran is a person who served this country and bears the scars of that service regardless of when or where they served.

Treat them with the upmost respect. I do. Rejection is not a sign of failure. Failure is not an option, Medical opinions and evidence wins claims. Trust in others is a virtue but you take the T out of Trust and you are left with Rust so be wise about who you are dealing with.

I would do it, not going to hurt your timeframe all that much since it only has been two weeks. Months yes but couple of weeks is nothing..

I picked up and faxed in my psyche records to the RO and SSDI. I have a consistent GAF score of 45. During my IU paperwork, I mentioned psyche problems but have not formally filed for secondary PTSD.

Should I file a claim before my IU claim is decided or will the VA make the connection on their own after reading my records? Even if this delays my claim, I'd rather do as much right the first time instead of wait on appeals.

My original claim for L/R ankle injuries was filed in 5/11. The VA sent me paperwork for the IU without me requesting it. I am already 20% SC for knee and back.

Yes, send it in. My understanding is, you can send in anything for your claim up till the rater makes his decision. The deadline for sending in evidence is just an estimated date before it's subject to go to the next stage. Everyone knows that's a big joke, cause normally it sit's there 6 months to a year after that deadline. I agree with everyone else, if it'll help, send it in.

Well good thing I did add mental health to this claim. I was recently rated 70% SC for it, boosting me up to 80% total. Still have a DRO appeal in for other problems.
