I Have A C&p In A Couple Weeks What To Expect

March last year I was awarded 90%SC. Right after that I received TDIU at 100% T&P. Life was great after years of the fight..

Then the same month (March) I was DX with small cell lung cancer (Limed). I filed for SC because of AO and was awarded 100% with aid and attedance.

After 6 treatments of chemo, along with 35 radiation the same time. After that 15 radiation brain treatments. Here we are in June of this year they want to have a C&P for my (respiratory problem). I so far am NED for the cancer. It's all the other problems that really hard on me. Some where and some how I had two TIC strokes, can't feel much in my feet, found out last week I have a vein that is completely blocked but have two other veins that has by-passed the main one. I also got 65% damage to my kidneys .

I,m still tired all the time sweat at night, hit the bath room 8-12 times a night, dizzy when I stand or walk, can't walk 100 ft with out almost passing out.

I figure they'll knock me back to TDIU which would cost me money. Do I need to file for all the other problems that has been caused frome the cancer treatment? I was well and no idea of what the treatment was going to do to me. Thaks

Were you in Vietnam? It seem that they have gave you P&T?

They are looking at the cancer to see if your cured.

You should be at SMC L or higher now since you have a 100 plus a 90 and a and a.

You should file for the kidneys and other things and maybe depression if you have it to offset any reductions by the VA.

A Veteran is a person who served this country. Treat them with respect.

A Disabled Veteran is a person who served this country and bears the scars of that service regardless of when or where they served.

Treat them with the upmost respect. I do. Rejection is not a sign of failure. Failure is not an option, Medical opinions and evidence wins claims. Trust in others is a virtue but you take the T out of Trust and you are left with Rust so be wise about who you are dealing with.

Did two tours in Nam. First tour with 1st Cav as a grunt, went to flight school 2nd tour with the 101airborne up north. I was rated with all my combined at 90%. They then gave me TDIU. The cancer at present is stable. My cancer Dr says I will always have the cancer it's under control right now. Could come back and I'm screwed. I'm taking PET scans every 3 months. As it is a very aggressive cancer. Less then 5% make it to 5 years. As far as SMC as L I'm not sure they gave me that. I was moved to 100% with aid and attendance.

As I'm already rated TDIU P&T. What should I expect filing for the lung damage, kidney, and the other problems the treatment has caused?

As far as I know,is that once you are P&T. You are max out on money, except for SMC's. I'm up to 380 %, but only P&T 100% with two SMC. Are you married? you can claim her, sometimes the DAV or VSO leave off your spouse.

Found out what was going on. I have had two C&Ps now. There checking how much more damage the cancer treatment caused me. They tested lungs and the kidneys.. Looks like Im just going to be one of the 100% plus guys. Thanks for all the info and help

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1.     • Are all military medical records on file at the VA?

      RichardZ posted a topic in How to's on filing a Claim,

      I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
