Hello,

I'll go through this in chronological order:

On my initial determination letter for 100% rating (May 10, 2011) it says "An examination will be scheduled at a future date to evaluate the severity of your service connected "PTSD".

Further in the letter it states, "The examiner indicated that you would benefit from counseling and other mental health service, therefore, there is evidence indicating a possibility for improvement" The assigned evaluation is not considered permanent and is subject to a future review examination".

So, I submitted another application for increased determination, for P&T (August 31, 2013), and received a determination letter (October 29, 2013), stating:

1. "Evaluation of PTSD which is currently 100 percent disabling, is continued".

2. "Eligibility to Dependents' Educational Assistance is not established". (Indicating that it's not P&T I'm thinking).

So, I called the VA phone number and asked for a letter so I could receive base access and MWR privileges. I received the following letter:

"We are giving you this certificate so you may receive commissary store and exchange privileges from the Armed Forces". "This is to certify that xxxxxx is an honorably discharged Veteran of the Army and receives benefits at the 100% rate".

I was able to obtain a Base ID Card (DD Form 2765) using this certificate, which I thought required P&T Status to obtain.

Sp now, I've gone onto the MilConnect (www.dmdc.osd.mil) website and when clicking the 'my profile' tab I see the following information:

Persona Type: Disabled Veteran

Disability Extent: Permanent and Total Disability

Begin Date: 08-21-2013

I am trying to figure out where exactly I stand. Am I P&T? Am I not? Is my spouse eligible for CHAMPVA?

Any assistance is deciphering all this will be appreciated.

Hello and thank you for your service from what i know you are eligible for the ID card when you get a 100% rating with the statement about dependents not getting ch35 benefits you are not rated P&T through the VA. when you had your ID done they should have put down the date of your future exams as your expiration date but the person who did your id card didnt catch that and made it an indefinite expiration so you got a bonus. hope this helps

Go with the most recent determination, it takes precedence over any priors. You are P&T. Laminate that letter, too. CYA and all that.

(I AM NOT A RATER- I work the claims BEFORE they are rated, annotating medical evidence in your records, VA and Legal documents,  and DA/DD forms- basically a paralegal/vso/etc except that I also evaluate your records based on Caluza and try to justify and schedule the exams that you go to based on whether or not your records have enough in them to warrant those)

The MilConnect (www.dmdc.osd.mil) website only shows the information that was entered when you got your ID card if you are still confused call the va 1-800 827-1000 they can give you the info the VA has the letter stating your kids are not eligible for the ch 35 educational benefits shows you are not P&T this web site help http://militarybenefits.info/military-id-cards/

This id-firefighter30 is exactly correct in his observation.. I had a Vet friend, in your exact situation 100% not PT and got the ID card life expiration etc. Now this Vet actually believed he was P&T.. 4 years later He deceides to apply for Dep Edu. benetfits for his wife... and VA Drops the bomb on his world.. They gave him the news you know and scheduled him for a re-eval C&P exam... The guy calls me in panic mode.... I mean my man was in tears and shuttered at another C&P exam that may find him partially recovered and rate his PTSD at 50 or 70%. Fortunately, my Vet friend had applied and won his Social Security disability claim and was drawing social Security based on his evidence of the 100% VA rating. Secondly He have continued his Mental Health treatment with Veteran Admin (VA) and was on Med"s for the last 4 years.. I advised him to petition VA for P&T status with the aforementioned as evidence.

VA approved it, considering the Social Security award and the continuence of Mental Health treatment records (with Medication regiment)..... And that's just the way it Is ! RLWT

So this is happening to me. However, I am 90% with unemployability which means I get the 100% benefits. I have the ID card and everything just like 100%. On milconnect, it show I am P and T just like your friend. Also, my VA letter used to say future appointment when I print out benefit summery letter. It used to have a date for future exam. Now it don't! Do you have any knowledge about this Seaman?

 

Also, I was medically discharged in 03. I had a break in service after the gulf war. Anyways, I called today because they didn't have my first tour of duty on my education benefits. So I called to correct that. They couldn't read the bottom of my dd214 so the codes they needed were unreadable. Then the lady was talking about how my benefits would change for education. I asked how would they change. She said, the only way it would change if you were medically discharged. I told her I was. She argued with me that it doesn't say anything on my dd214 that I was. She had me call the archives place to request a new dd214.

So I went to the local Va representative to ask for help. While I was there, I noticed in block 18 it did clearly say I was receiving disability severance pay. Well, I called them back and argued some more lol. But I finally got the guy to read block 18. He then seen it and submitted the change request to his supervisor.

So my question is,being medically discharged, I read somewhere that if you were medically discharge and it was serviced connected, I would receive what is called an enhanced benefits.

My question is, does anybody know what enhanced benefit are as far as what extra benefits I would receive? I do know as far as education goes it changes from 60% to 100%. But that is all I know. So if anybody can answer my questions about the P&T and enhanced benefits, I would greatly appreciate it.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
