"NOTICE OF DISAGREEMENT" August 20, 2014 Board of Veterans'Appeals C-00 000 0000Department of VeteransAffairs Washington DC 20420 Dear BVA, Please accept this letter as my "Notice of Disagreement" (NOD), in response to your decision letter dated April 23, 2014. I request additional time so we may reach an equatable conclusion to this case. I still have not received, or had the opportunity to review copies of my "Claims Folder", requested on December 7, 2011 , per FOIA requirements, prior to my BVA Hearing held on May 22, 2013. I had to go before the Honorable... BVA Judge, at my BVA hearing without ever reviewing copies of my records, putting me at a disadvantage and causing harm to my claim. I have waited till the last moment to file this NOD, hoping the VA would comply with my request before the 120 day BVA, NOD time limit runs out. It has taken almost six years to get this far, and I do not want to start over because I missed a deadline. Enclosed please find a letter from the DVA office of the General Council in support of my efforts to resolve this in a timely manner. Yours Truly, Commander Bob

  4. For decades the VA has been gaming the system. Since it's inception, VA executive employees have been gaming Congress, the President and the Secretary of Veterans Affairs. Now, it's just a matter of time before those nefarious career VA employees will be found out. C.B.

Greetings, Since I have won my BVA case, I would like to use my individual SC disability percentages to reflect a clearer profile of 120%, thus indicating the many separate individual combat SC disabilities, in accordance with the actual state of my wounds. I have tried, but can't make any changes on my profile page. Your assistance in changing my profile % would be helpful. Thanks, Bob

  10. TITLE 18 > PART I > CHAPTER 101 > § 2071 § 2071. Concealment, removal, or mutilation generally (a) Whoever willfully and unlawfully conceals, removes, mutilates, obliterates, or destroys, or attempts to do so, or, with intent to do so takes and carries away any record, proceeding, map, book, paper, document, or other thing, filed or deposited with any clerk or officer of any court of the United States, or in any public office, or with any judicial or public officer of the United States, shall be fined under this title or imprisoned not more than three years, or both. (b) Whoever, having the custody of any such record, proceeding, map, book, document, paper, or other thing, willfully and unlawfully conceals, removes, mutilates, obliterates, falsifies, or destroys the same, shall be fined under this title or imprisoned not more than three years, or both; and shall forfeit his office and be disqualified from holding any office under the United States. As used in this subsection, the term “office” does not include the office held by any person as a retired officer of the Armed Forces of the United States. And, then there's this section of the Code that outlines Secretary Peake's obligations. TITLE 44 > CHAPTER 31 > § 3106 § 3106. Unlawful removal, destruction of records The head of each Federal agency shall notify the Archivist of any actual, impending, or threatened unlawful removal, defacing, alteration, or destruction of records in the custody of the agency of which he is the head that shall come to his attention, and with the assistance of the Archivist shall initiate action through the Attorney General for the recovery of records he knows or has reason to believe have been unlawfully removed from his agency, or from another Federal agency whose records have been transferred to his legal custody. In any case in which the head of the agency does not initiate an action for such recovery or other redress within a reasonable period of time after being notified of any such unlawful action, the Archivist shall request the Attorney General to initiate such an action, and shall notify the Congress when such a request has been made.
  11. Pathetic... 20 or 25 miles distance away from many VAMCs , would show real commitment in helping disabled vets. Disabled vets living outside of metropolitan areas would still have 40 miles of heavy traffic to go through just to spend 20 min. looking for a place to park. Then 40 miles of rush hour traffic back home, after spending hours at one of those training hospitals. This clause in the bill gives us insight into the mentality of those in Congress, who claim they want to rebuild the VA system. I want to see more from these changes they are trying to beguile us with. JMHO, C.B.
  12. I agree, Berta, however, this would require much sacrifice from our new generation, as well as the older vets.
