Hospital Summary
Hi, I read a rule that states a hospital summary can be considered an informal claim for re-open or increase, IF the condition contained in the report is the same condition SC has been granted or denied for in the past. 38 CFR 1.57 MY Question: In a 1978 VARO rating decision, the VARO DID consider the Hospital Summary as evidence in making their decision. What the VARO DID NOT CONSIDER in making their decision was the RX drugs prescribed to me during that specific hospitialization and what those drugs were prescribed for ( headaches and neck pain ). Without any consideration of these VA prescribed drugs, part of my claim was denied. The claim was for Seizure…

C&p
Hello all, I am currently rated at 20% for DDD cervical spine. I filed a request to reconsider and added more claims: Chronic pain, migraines, anxiety/panic disorder, gastriontestinal problems, radiculopahy (both arms), tendonitis (elbow & shoulder), post traumatic arthritis (wrist), lumbar/thoracic back pain, arthritis of cervical spine & neck scar. All have been documented and linked together. I received a letter stating I have 3 C&P's scheduled next month. I know one is for the anxiety/panic disorder, but I'm clueless for the other 2. I called and they refused to discuss it on the phone. Whats the big deal??? Does anyone have an idea what exams t…

Another Question On My Cue Claim?
In my appeal of my very first claim, I had made a reference to the inadequicy of the C&P Exam, the VA Examiner had givien me. I did not specify any particular error that was made, but I did make a request for another C&P exam so that these deficeicies could be remedied. Rather than conducting another C&P as I had requested, they ignored it completely and denied my claim on appeal. Not realizing I could take it any further, I let their decision stand, to my later regrets. Mind you, I was a Corpsman in the Navy and had been stationed at a Drug rehab Center, and was quite aware as to what constituted an adequet pysch evaluation, not to mention, that I had…
