New October 2019 Update AO ship's list
https://www.va.gov/shiplist-agent-orange.pdf Also VA is doing an outreach----by mail---as soon as I can redact a letter a BWN veteran got- (it is specific to his denied claim) I will scan and attach it here. They are sending out about 70,000 letters to veterans who were previously denied and had an AO presumptive. The letter also states that : "VA is currently processing claims and will decide these claims based on the date of the new law. This means eligible Veterans will be awarded benefits as early as January 1, 2020" This is extraordinary news- not expected at all.......!!!!!!!!!!

VA General Counsel AO BWN advisory opinion:
I suggest anyone willing to help with the AO BWN claims, to read this over very carefully: https://www.veteranslawblog.org/wp-content/uploads/2019/05/VAOGC-Adv-Opinion-re-Procopio-3.29.2019.pdf I just got it from OGC but need to leave fora church meeting and I will decifer it later. I believe a vet here has basis for BWN AO CUE already , and this can be evidence for that.

Pressure on over BWV "stay" on AO claims
The Stay was imposed by Wilkie and makes no sense at all: I could write the regulations for them in a heart beat. Most of us could. https://www.military.com/daily-news/2019/09/25/terminally-ill-vet-caregiver-va-end-hold-agent-orange-benefits.html But this statement really got me: "Rick Weidman, a co-founder of Vietnam Veterans of America, said his organization had been assured in the spring that claims processing would be "ready to go" once the bill was signed into law. "We all know the claim dies when the veteran dies," Weidman said. "What happens to those who die before Jan. 1?" "Mr. President, ultimately it's your responsibility" to end th…

From your AO research, Tyndall AFB, AFESC, Lowry AFB, or RAF Alconbury?
I am not a boots on any presumptive ground vet. I don't know if I have ever been any closer to AO than just off the Seabee storage area in MS or spent the night and ate at a Seabee's house multiple times who would have been involved in 74 -76, although he didn't mention it. He had more hashes on his sleeves than I could count back then. But, I was at Tyndall AFB in Florida, hunting and harvesting from the hot spot where barges loaded and offloaded since the 40's.....off of that bayou, half way in the middle of the bay, probably as close as the public dare take a dioxin reading, its the highest numbers for dioxin in north florida, except at Eglin. That bayou is on th…

Blue Water Navy vets from NVLSP!!! Yippee!
https://www.nvlsp.org/news-and-events/news-articles/nvlsps-faqs-for-blue-water-vietnam-veterans In part: "9) If my claim is granted, how much will I be entitled to in retroactive benefits? The effective date assigned by the VA to awards of disability and DIC benefits is usually the date the claim was received by the VA. For example, if VA grants benefits based on the veteran’s first claim for an Agent Orange-related disease and that claim was filed in January 2019, the veteran will be assigned an effective date in (and will be paid retroactive compensation to) January 2019. However, if the VA grants benefits based on a veteran’s second or third claim …

Sec. Wilkie sued over BWN delay
https://www.disabledveterans.org/2019/07/24/advocates-sue-va-secretary-over-delaying-blue-water-claims/ The stay he put on this issue is until January 2020. Vet orgs are ready to file BWN AO claims. If you were denied in the past by VA for what is now an AO presumptive, and fit into the HR 299 criteria, file the claim. You will need a copy of their past denial, as it appears ( the general consensus among vet lawyers and advocates, is that Nehmer will kick in) Nehmer should kick as these vets are supposed to get equity and are supposed to be considered th same way Boots on Ground Vietnam Veterans are. The problem with the Stay ( moratorium) is that…

HBP awarded due to AO!!!!!!!!!
This is one of the issues I wrote to Secretary Wilkie about- I feel I made a strong argument for HBP to become an AO presumptive- then I was advised by my VARO to apply for accrued on the new form and with a different VARO. These are CUE claims, and they ( my RO held one back) and sent me a letter that said the letter to Wilkie had been sent to them, and they held back my 1151 HBP claim. Which had been awarded 3 weeks after they denied ,due to my CUE on the denial. They said I already got paid the proper retro ,but I didnt. I have a CUE pending on the 1151, at my RO but I think I will file a new claim just like this one, direct SC is far better than 1…
