I Called Bob
Hey, Vets. This works great. I called Bob on Wednesday. Thursday morning the BVA gomer calls to find out whazzup. Then today the DRO calls up to say they are doing my DRO (which I didn't ask for) on my NOD of my CUE denial for a rating reduction. VA Seattle is 545 days out on DRO reviews. I submitted the NOD on 4/30/2014. The DRO asked me what I wanted. 100% from 1994 and SMC S. http://asknod.wordpress.com/2014/10/03/vasec-what-happens-when-you-call-bob/ onward thru the fog. Vote for Bob.

ptsd Appeal for PTSD/MST, MDD denial
February 26, 2016 at 11:49 am I am looking for a successful attorney who is very familiar and experienced with appeals for PTSD/MST and MDD. I have a diagnosis from my VA psychologist of PTSD/MDD, and a NEXUS letter from her. I have medical records from sick call in the Navy where I complained of stress and stomach pain which provider noted was believed to be due to work issues. I was prescribed Librax and Mylanta for my illness. I was denied in the basis of not enough evidence to prove stressor occurred. NO C&P EXAM WAS EVER ORDERED!!! Thank you all so much for any help and advice. -

expeditiously remands
This may help some? but its hard to ask VA about remands and why they go back and forth. BVA TO AMC BACK TO THE BVA, THERE LITERALLY Playing around with your claim as you get older filing a Extro- writ will shake the tree but it probably is the best thing to do if your claim keeps going back and forth and you sit there and wait &wonder...but a writ will make them get off the lazy butts and work your claim http://thomasandrewslaw.blogspot.com/2011/02/when-does-va-handle-remand.html ......................Buck

Next Phase -Filing the NOD--Any Advice?
Vets: I'm finally at the next phase of my original claim which is the Notice of Disagreement (NOD) and am happy about how my claim turned out so far. Frankly, no one really ever expects to get everything that they request the first time out the gate? I requested the C-File almost 7 months ago so I would have it for this phase but so far, the C-File is a "no show"? Over the last year or so, I've read about NODs and the options that one has for an appeal. My original claim was finally finished yesterday with a 10% SC bump up for TBI with headaches and cognitive issues. I was hoping to take my C-File and make an appointment to visit Dr. Ellis to get some IMOs/IMEs com…

hypertension sleep apnea appeal
I'm a newbie here, but at the advice of my VSO I claimed and then appealed that same denied claim for OSA. I spent almost 30 yrs in the USAF and didn't get tested until a year after I got out. I didn't read any websites like this because my VSO couldn't believe it got denied, but after reading all this I can see why it got denied and the appeal will get shot down as well! I don't have it tied to any other SC condition?! How can that VSO even have a job there? All I have are the records from a private pulmonologist saying I have OSA and RLS, plus his PA filled out the DBQ and stated it indeed started while I was active. Oh and I have a lay statement from my wife. I …

NOD & C&P Exam and New Evidence Question
Hi brothers and sisters, I'm new to this blog I have been reading a lot of information. But I have a specific question about my situation. When I was rated last time I had 10% for my back, 10% for my knees so I was at 30%. Fast forward till now, in December I filed for an increase of my back issues because I have a sciatica and its really hindering my way of life and that of my family. In January I was given a C&P Exam. The doctor that did it, did ask me question on how was I feeling and then he proceeded to do the tests. When he did the forward flexion he asked me is that the farthest you can bent and I said yes (he was asking like not believing me of cour…

Blood Disorder - Polycythemia Vera, Myelofibrosis
Hello forum, I am writing behalf of someone I love dearly. Service member is retired Army, served 23 years and upon retirement was diagnosed with a blood disorder, Polycythemia Vera, later Myelofibrosis, and based on my research it is likely that leukemia will be next. Service member has filed for VA disability based on what is believed to be a service connected disease. Service member MOS dealt with microwaves, thus greater exposure to RF. Service member served as NBC NCO. Because of the rarity of this disease it poses difficulty in presenting a case. I have been doing research in order to submit a stronger case to VA. One interesting piece I came acro…

NOD timeline
So I feel like I should know this answer (because I am dealing with the VA ha!) but I wanted to see what anyone else thought. I filed my claim in Feb 2015, denied one of my claims and received letter in May. Sent in NOD and all paperwork that went along with it in June, which it was received around the 9th. At one point, ebenefits had an estimated date of completion, but after the update, one of many, there is no longer a date. My status on the appeals page is "appeal pending-notice of disagreement" and that has been that way for as long as I can remember. The location is at "originating VA office". A couple weeks ago, I emailed the VA and got a scripted email back say…
