NOD Question concerning new evidence submit timing
I was wondering if a NOD claim goes back to the same rater who denied the initial claim or does it go to a completely different Rater unknown to the initial Rater? How does this actually work within the system when you file a NOD? Do you file it with all the new evidence right then attached or is it best to wait on sending New Evidence until after Statement of Claim (SOC) is received to counter it better? What is the SOC all about and any different than the decision denial reasons????? Working on it this weekend to file with Rep on Monday so would appreciate a quick reply. Thanks for any help out there.

VA Claim DRO & Chronic Illness
I was discharged in 09 and was awarded 20% on 6/10. I have 10% for lumbar back strain and cervical back strain. I actually had medical coverage with the VA before being awarded any compensation. I had filed an increase with my local VA rep in Fairfax VA as well as some new conditions on 5/11. I unfortunately missed my QTC appointment and immediately sent a letter to them asking for a reschedule. Unfortunately that never came and on 5/13 i received the VA packet stating they would increase the lumbar to 20% with no other changes. The other claims were denied. Injured on 2week reserve / Character of discharge
Fellow Warriors, I was a reservist where i attended bootcamp and school (then transferred to reserves with an Honorable DD214) '89-'90, called to active duty for Desert Shield and deactivated with another honorable DD214 ('90/91) and entered active drilling status. During my 2 week active duty in 1993 i was in a HWMMV that rolled over and had subsequent back surgery/injuries. During monthly drills in 92/93 i was at sick call, with documentation, etc. in 94 i started missing drills and was discharged in 1995 with an admin separation OTH (for missing drills). Appeal update
Well most know my DRO hearing was in February and now I am in the decision phase with a due date of 9/28/16. I sure hope they decide it before then!!! But at least I am making progress! I sure hope I get the decision soon!!!

Interesting regarding my FDC claim/NOD
So most know on here my situation. I filed an FDC back in January for several issues to include 100% temporary convalescence for right foot due to left ankle. Right foot is NOT S/C so since my left ankle caused the fracture I put in the FDC. After filing the FDC, my NOD finally processed and I had my DRO review hearing last month. I noticed after receiving my C-file my FDC was "RTR" ready to rate but I assumed that it was going to wait until AFTER my DRO hearing and all those issues were resolved. Hi all, I got this letter from the VA today and I don't understand what it means. I am going to type it in and see if someone can help me out. We have implemented the decision form the board of veteran appeals of march 12 2016 This letter tells you about your entitlement amount and payment start date and what we decided. Not to sure exactly why skipped steps
I first had a NOD filed Dec 14, which was certified to the board Dec. 29 then it was rocketed and was then administrative Case Processing BVA in Jan. I then had a motion to advance granted in Feb. It didn't move until April where it then was with a VLJ at the board. I know some sort of end is coming and whether I still have to continue on and win at the Cavc or just maybe the BVA judge will have all the evidence he needs. I have taken ever piece of advice and used it from this site and all my fellow vets thank you. I was wondering I thought there was a step in between where it goes to a VSO? One day it was admin the next day with a VLJ.

Should I retake my hearing test
In 2012 I was awarded 10% SC for tinnitus when I filed for hearing loss. The ringing is really bad and I was grated SC for hearing loss at 0%, I had not test given to me when I exited the service, I was a 1911E tanker in my MOS for 3 years. I have a difficult time hearing in many situations , especially in places with any type of background noise. I filed an appeal and I am set up to do another hearing test on 4/1. My wuestion is this. If I take the hearing test again and the results are different can they take away my my 10% ? I don't want to lose that if I get a DR that is anti veteran as I hear some are. Has anyone ever heard of this happening before?

Im new to the forum but, I've been soaking up as much info as possible through this site in the past 4 months. I was told by the VA that I should resubmit my form 21-0781. My claim is awaiting Dro review. My question is how would this affect my claim?

One month and counting since DRO hearing - Question though...
Well yesterday marked one month since my DRO review hearing. I was told that it could be months. So I am prepared to sit this out. I do have a question though, is it true that they have to wait at least 60 days to ensure I do not submit any other evidence? If that is the case, can I let them know by submitting a VA21-4138 stating I have nothing further to submit? My DRO hearing went well and I provided everything at the hearing that I need to provide.

ptsd DRO and Appeal
Face to Face DRO meeting in Nov of 2015.regarding appeal for Sleep Apnea/PTSD connection. Had two sleep studies at VA resulting in C-PAP since 2011.This meeting was productive in that the DRO acknowledged the documentantion from the sleep clinic and the fact that I was on C-PAP. Also nexus letter from a provate doctor who stated that psych notes indicate a relation between Sleep Apnea and PTSD. Jan 2016 had hearing with VLJ. That claim is currently under review at BVA by a VLJ. At different stages can these claims impact one another? thanks for the support GBA
