Remanded Appeal back at BVA!?
Hi all, After contacting the VA Secretary, my appeal has left AMC and is back at the board. During that week process, my DAV Representative wrote an arguement for me regarding my remand. Looked excellent. I received an update on Friday through ebennies that my case is "Pending Hearing Request/Scheduling". Does anyone have a clue when the next step could be and if that next step is "With Veterans Law Judge?". My appeal has a docket date of 2012. Thanks All! SF03

Bva appeal complete
checked e-benefits. Say's my appeal @ Bva is complete. No open Appeals. Actually had to go under historical Appeals to find it. Called bva and was told decision is being mailed today

An appeal stuck in limbo
I've had an appeal filed since may of 2013. Back then, the 21-0958 had a checkbox to select that you "would not like the appeal to the BVA", which, at least back then, was supposed to mean that the appeal was seen by the VRO, and if the VRO knee-jerk-denied it, then you could still go to the BVA afterwards. Now, I see that the 21-0958 has been changed so the checkboxes read precisely which review process you are appealing to. At any rate, every time I call the V.A. to find out where the FUDGE my appeal is, they simply state that it has a docket number assigned to it, and that the BVA is backed up so "shut up and wait". diabetes Conflicting Examiner Decision
Hello fellow vets: Wording from the examiner was "Can do moderate physical labor with his diabetes, but "Would have difficulty using his fine motor skills, requiring light touch sensations. Also has bi-lateral hand weakness. (regarding my bilateral upper/lower neuropathy). Was a letter carrier for many years. I was denied TDIU. My NOD was carefully written out by a wonderful VSO; still waiting on final decision. Could there be a conflict on the decision? Thank you very much Make sure to call your mom if you can!

tdiu I Am Not Sure Where To Put This, Thew Ongoing Struggle With The Va Has Left Me So Messed Up
I started my last group of claims in 2009. I wanted to in 2008, but after almost dying and hospitalized for many months... the VSO at the service agency said they could not get me an appointment for many months. I started with many claims again, I was sick on active duty from chemicals. I worked with fuels, and other. I filed for more disability claims, I had already won a claim for 50% for headaches on active duty for chemicals. I got sick from jet fuel, leaded gasoline, diesel fuel, and then trichloroethylene. 3 Quick Q's on NOD's
Q1 - Is it better to just file a NOD when VA tries to low ball iron-clad evidence that meets the full criteria/regs. for a higher disability increase? Q2 - When filing NOD is it true nothing begins until you receive a Statement from VA first as to their reasons for denial in order to respond back? Q3 - How long is the average time to be granted a DRO Hearing once NOD's is filed? Thanks for any advice.

Is My Back Rated Correctly?
I was rated 10% for a lumbar strain 9-10 years ago. About three years ago the rating was increased to 20% with a secondary rating of 10% for radiculopothy. I've was relatively successful in reducing serious flare ups by being careful not to do anything too strenuous. In the last couple of years it has become more debilitating and the flare ups are longer in duration and happen without anything necessarily causing it. I finally went in to seek help from a specialist. My MRI shows advanced Degenerative Disc Disease, protusions (blown discs) and stenosis. I'm in physical therapy, which helps for a couple of days. service connection granted
Lawyer just called granted service connection for tbi and All residuals. Now i have remanded a small issue which was my skull fracture which I have plenty off xrays from my accident. Thank you all for all your advice my appeal off I officially in less then 5 months. I annoyed allot of people in my way to this grant and I apologize I still dont know what this means yet but maybe someone can chime in please?

hypertension Denied Sleep Apnea Claim
I am new to this site and I will apologize ahead of time incase my question seems pretty basic. I was recently denied sleep apnea and hypertension as not being service connected. I will only ask about my sleep apnea at this time. I was recently diagnosed with sleep apnea (I retired from the military in 1995). I use to snore very loud while in the military according to my ex-wife. My question is will a statement from my ex-wife be enough to justify my sleep apnea? I was also given a service connected rating for my scoliosis of 20%, I have read online that spine problems can cause sleep apnea. diabetes Sleep apnea secondary to diabetes
I am brand new to this group and was surprised not to find any posts about claiming sleep apnea as secondary to diabetes type 2. Perhaps I'm just not looking hard enough. My claim for diabetes was approved as presumptive due to agent orange exposure My sleep apnea was disapproved as not being service connected. I submitted an NOD claiming my sleep apnea as secondary to my service connected disability.
