Now what?
03-19-16 Granted 30% asthma according to AB8 letter. (From 06-03-2011) 03-20-16. Received SOC regarding headaches. 03-21-16 Submittef rebuttal to SOC and fired VSO. (Did not follow remand instructions/failed to consider nexus for migranies related to service connected asthma, rhinitis, nasal blockage, deviated septum never addressed). Have not received official rating yet. Also did not receive retro payment or new monthly adjustment for April. Damn VA. Real good at sending BS denials. Not so good at getting Veterans their entitlements when proven wrong.

What about the Presumption of Soundness?
I am still trying to figure out the VA and claims process but I've been "in the system" since 2012. I am currently 90% s/c but the VA has denied a lot of my claims without much information. My initial claim was for many items that I was not diagnosed with at that time. So my claim was decided and some items were denied. However, I was in in treatment and did later get diagnosed with what I had claimed. As time goes on, I get smarter. But, the VA seems to go the other direction in my opinion. If there is any kind of proximate cause and presumption of soundness then I am confused as to how these can not be s/c at this point? I ask as I just have gone through an…

SOC never received
When I filed my NOD in 2014, I specifically asked for a DRO review hearing on the NOD VA21-0958 form. I never received anything in the mail. After searching this site in January and the internet I found the following: "After the VA receives a NOD from a veteran, it will prepare the Statement of the Case (SOC) for all issues that were not granted service connection or the maximum rating. The SOC is an explanation of the decision, including a cover letter that gives instructions about the appeal process. Also included in the SOC is a list of the issues being decided in the claim, a summary of evidence, the pertinent laws and VA regulations that relate to the claim, a…

Should I contact the Secretary?
Hello All, Some of you may know, and I'm hoping for some advice... 5 months ago, I was granted SC for several issues with a minor remand for issues that reach back to my original filing date of 2008. I'm looking at tens of thousands in back pay. I've heard neither hide nor hair from the VA regarding my SC grants, back-pay, or anything for that matter since the original SOC from the BVA. I work with lady here who used to be pretty high up in the VBA and came to my place of employment after a stressful time at the VA. She told me that BVA cases should be implemented within three months and that my five month wait time is the apparent exception and NOT the ru…

Bva With Remand To Amc
I am new and posted much of what I am copy/pasting in another forum. However, I did not get much of a reply on that forum and thought I would try here. I will try to be as clear as I can, feel free to ask questions. I will try to make this short and simple. I was discharged in 2003 for Supraventricular tachycardia. I found out after leaving the Army that they damaged my AV node and they took someone else's heart monitor and put my name on it (documented by VA cardiologist). The problem is that by putting my name on the other monitor and not my monitor, I received a 10% and not 30% rating in 2003. I have been fighting this for many years once a VA cardiologist po…

Does an Increase claim move faster than a FDC new claim?
Just curious if anyone has asked for and got a rating increase and how long that actually took A to Z time-wise? I would think a well documented Increase meeting criteria guidelines fully would move faster than even a FDC claim? But never had an increase claim come up until now. Is an increase treated separately if you also submitted a new claim along with it at the same filing time? Does filing together hold either back until both are decided, or does an increase move at a faster clip than a new claim done at its own pace? Thanks in advance for any answers.

File With Bva Veterans Law Judge
Being so close to a finish line is like your last 3 weeks on deployment and you start the count down of hours then minutes and there is never a good feeling its ever going to end. I just received this response "Dear Mr. Frei, Your appeal is here at the Board of Veterans' Appeals and is currently being reviewed. If you're referring to the date change on eBenefits, that is when it is assigned to different attorneys on the VLJ's staff. Review is proceeding on your appeal in an expeditious fashion since this has been Advanced on the Docket. It has been with the VLJ since the 5th on this month and has moved on the 7th and 14th, now everyday waiting for the date …

Not sure this is the right topic to post under, but....
I have a NOD filed for Migraines. I have been seeing a VA Neurologist for these headaches. Last Wednesday, April 6th was my last visit, and she did not do a DBQ for me, however she stated that her notes would contain everything I needed to use for my NOD. The only problems is, the notes are not posted on MyHealtheVet. Are these notes normally posted there? I understand there is a 3 day hold, but it's a week and a half now. How else do I get these notes? The only reason I am in a hurry is that the Regional Office said to submit evidence within 30 days. Any advice?

ptsd BVA APPROVAL
In 2009, claims for PTSD increase and A&A /Housebound were denied. Today, I recieved notice of approval for both claims. Claims were approved for the "entire appellate period". It was not my endurance alone that made the struggle worthwhile; the Hadit community offered support and superior guidance during a very difficult period. thank you gba

Tinnitus Denial. Need To Appeal
First time poster but have reading Hadit for over a year. Here's my situation. I filed for Tinnitus June 2015 and just received my denial letter. I see many errors in the decision. Did not follow VA training Letter 10-02. Did not consider my IMO. And I don't think they actually read the whole C&P exam notes. Also, doesn't look like the examiner had my SMR. Only my VA records. I am in the VA medical system. No service connection. I am not claiming HL. Only tinnitus. I will omit the hearing part of the exam but include her opinion on it. The examiner didn't even want to look at my smr that I brought with me. Bold parts is what I feel is relevant to an appeal. I entered…
