remand is back. DENIED still. i have 30 to provide
this is what the judge put in remand back to AOJ: REMAND The severity of the Veteran's bilateral lower extremity radiculopathy has not been recently evaluated, and as that is the prime concern for claims in an increase in rating, a new examination is necessary. Ok, we called our Vso in dc. I knew we had sent the va firm 9 in idea 14, but we did not question it really. The Vso caught it today . So hubbys docket number should be in 14 instead of 15. Now instead of 55,587 we moved up to only 41 thousand something. So some one in st Pete let it set on some desk o4 box before they realized it should have already been in dc at bva.

Retro Question about time frames
I just found out on eBenefits today that my increase for Pansinuitis under Appeal at RO was upped from 10% to 30% maximum. TWO QUESTIONS.........(1) should I see the the new monthly increase come May 1.......and (2) how long does it normally take to receive Retro amount deposited once they've posted new disability on eBenefits. I have not receiving anything officially via mail just the disability change on eBenefits under Disabilities today, but I did check with my local VA and they reconfirmed.

Average wait time for an expedited BVA Appeal decision
I'm hoping that someone can help me with at least an estimate on how long it takes a VLJ at the BVA to complete a decision on an appeal that has been expedited. This is not a remand. I was told by my attorney that my appeal was assigned to a VLJ back on 12/15/17 and that the Board approved our motion to expedite. I also have received a letter from the BVA stating that they did grant our motion to expedite but the letter just now came in the mail but my attorney knew back in December that the request to expedite was approved because he called the Board. My question is...how long is the average wait time for an expedited appeal decision from a VLJ once they start w…

1983 Insufficient Exam
Hi there, Does anyone know of a case where a DRO revised an effective date during the appeal period because the original claimed condition was never examined (this was in 1983)? I have submitted a NOD for an earlier effective date because after 5 times of claiming foot injury/plantar fascitiias, my dad was finally awarded max rating. He originally claimed in 1983 and the examination is completely void of info concerning feet. That was one of the conditions claimed. Maybe Berta-can you see the VA calling CUE on itself? (CFR 4.7?) Any info is appreciated. Beth

Timeline after DRO hearing
Hi everyone, I saw an old thread and thought I would ask for current timelines and from which RO I filed 2 NOD 2/28/2016 1.S/C Secondary MDD(was 70% now severed)(DRO stated he was overturning severance) 2. My appeal was closed early
I called the VA to dispute this, but the person on the phone told me I only had 60 days to submit form 9 because they mailed me the SOC. The appeal was completed on Nov 28, 2017. Did I misunderstood the instructions on Form 9? 4. HOW LONG DO I HAVE TO COMPLETE THIS FORM AND FILE IT? Under current law, there are three different ways to calculate how much time you have to complete and file this form. The one that applies to you is the one that gives you the most time: (a) You have one year from the day your local VA office mailed you the notice of the decision you are appealing. DRO Hearing
Hi guys, new here. So sorry if this is kind of long. I was granted a secondary mh rating, it brought my rating to 80% which prompted the VA to apply for TDIU. This new claim went to another RO, not my local who just gave me the mh rating. So this other office looking at TDIU said there was a CUE, and my mh was severed even though I disagreed, asked for a hearing and did everything I was supposed to, I was never given an exam before severance either. So fast forward 2 years of waiting on the appeal, I became homeless, lost my car and credit everything. Vets.gov question
Ok went to vets.gov and it says hubbys appeal will soon receive a board decision. Would it be advantages for him to stay there or do the Ramp. Another question when you click on issues it shows he is asking for an increase in diabete. And on the other issue it says service connection for arthersclotic renal. He filed diabetic nephrology secondary to diabetes. The reason I’m concerned here is he was diagnosed with diabetic nephrology before he was diagnosed with cad. I’m afraid they are setting up to deny this already. Should we contact Vso?
