  1. To be sure. When sending your timely NOD or SOC,SOCS OR with any timed Appeal. When you get there letter saying you have 30 days 60 days or one year which ever the case maybe Be sure and to attach copy of that particular VA's letter with your Appeal. (I have attach VA letter**** showing my appeal is in the correct timely return of appeal.) just so there is no discretions in the Dates. jmo ...............Buck

    Champva

    My spouse uses ChampVA for her primary and has a Selman supplement that covers the 25% that Champva don't cover,and its sure helps beings my spouse has a lot of disability Issues & not qualified for Medicare only (61) still waiting on SSD to be approved. She had been going to the VAMC here in Dallas for years for healthcare, she had triple heart by pass and Back Surgery,& seizures & was in current treatment for osteoporosis getting the IV drip treatments for her Vitamin D and she had one IV-drip (they do the IV-drips once a year) for three years suppose to help strengthen her bones and was currently seeing the Ecohdime <ms clinics & being treated for Sleep Apnea (has c-pap from VAMC) & for Neuropathy & around last fall Oct /Nov All the VAMC clinics were closed to her all but her PCP Doc, She can get some medications like heart meds and pain meds but that's it with the VAMC. It sure put us in a bind getting cut off of mid treatment like that...we had no choice and had to get the supplement insurance and we also got the Delta Dental program through ChampVA. for my spouse. I use VAMC for all my health care(currently) but sure thinking bout getting me some private insurance it may save my life or at least pro-long it the way VA is doing things.   3. Oh Okay Thanks Ms berta, Interesting! Thanks for those links, I'll read up on them. Rick , the only thing I can say is look up all regulations concerning Herbicide's/Chemical's that caused your condition,(Specialty Dr's ) stating that is the cause of your conditions today from your past military service. I don't know about any other presumptive to claim other than the AO, if you can use paragraph 41, and you have medical rationales & brown-water navy(working inside the ''Hulls'' that were contaminated) my opinion you have a excellent chance getting SC & Rated. Check out John Rossie Blue Water Alert, may have some information you need. Don't give up they got to be a way to prove this to the VA. I wish I could be more help for ya! Its been awhile since I went to my RO to review my c-file with appointment, drove a little over 100 miles and when I got there they could not locate my c-file, so I ask for a form that states I was not able to review my c-file on such and such date....I never did get to review it. that's been about 17 or so years ago. sure need to review it no telling whats in it. eh! .....................Buck
  5. disease, or disease associated with exposure to certain herbicide agents; wartime and service on or after January 1, 1947. (a) General. A chronic, tropical, prisoner of war related disease, or a disease associated with exposure to certain herbicide agents listed in §3.309 will be considered to have been incurred in or aggravated by service under the circumstances outlined in this section even though there is no evidence of such disease during the period of service. No condition other than one listed in §3.309(a) will be considered chronic. (1) Service. The veteran must have served 90 days or more during a war period or after December 31, 1946. The requirement of 90 days’ service means active, continuous service within or extending into or beyond a war period or which began before and extended beyond December 31, 1946, or began after that date. Any period of service is sufficient for the purpose of establishing the presumptive service connection of a specified disease under the conditions listed in §3.309© and (e). (2) Separation from service. For the purpose of paragraph (a)(3) and (4) of this section the date of separation from wartime service will be the date of discharge or release during a war period, or if service continued after the war, the end of the war period. In claims based on service on or after January 1, 1947, the date of separation will be the date of discharge or release from the period of service on which the claim is based. (3) Chronic disease. The disease must have become manifest to a degree of 10 percent or more within 1 year (for Hansen’s disease (leprosy) and tuberculosis, within 3 years; multiple sclerosis, within 7 years) from the date of separation from service as specified in paragraph (a)(2) of this section. Rick if AO Is not the question or being SC From exposure then I don't understand what your question is? I know the there trying desperately to get the House committee to vote for the Blue Water Nave Vets that were exposed to AO & get there benefits they all so deserve. Theres some specifics on Johnson Island, where they stored about Million Gallons of AO in 55gal barrels stack 3 high not sure the length but it takes about 3 1/2 Acres to store it. ................Buck

  8. It's a good Ideal if veterans take note what the examiners Credentials were before or after the exam, was the examiner qualified in the field of medicine that the veteran is in question? to preform the C&P Exam? .....................Buck

Check out Nehmer Litigation, In 2003 a new Regulation was added to provide guidance in the adjudication of claims Under Nehmer Stpulation 38 CFR 3.316 Also I read in the M21-MR...I Can't remember the prevision/stuplation but if I remember right it says that the last day in Vietnam will be consider the 1st day of being exposed to A.O. I never knew a veteran had to prove he was in-country (boots on ground) & he was exposed to AO when he was in RVN, Service records should prove that & travel orders to the RVN . JMO .................BUCK

Congratulations Jumpmaster, Be sure and fill out the forms for ChampVA for your spouse and if she wants to go back to school she can do that too, & don't forget to fill out form for your free 10.000 life Insurance & ID for Commissary privileges and by all mean if your a home owner don't forget to go to your county tax office and get your tax deductions. (take anything that says your 100% disable veteran.) Also if your 100% and did not receive Chapter 35? fight for it you will get it! Good Post N Kelly, I hope that some veterans organizations will come to his aid and help him, defending this veteran would help legalize it, some states has approval and I hope this veteran is acquitted.(this is ridiculous) I am from Oklahoma and this is mindboggling....makes me ashamed to be from Okla. eh! The VA is over medicating all of us veterans that have ptsd and its going to take it's toll on most of us & if cannabis is helping why not make it where we can use it. And yet there cutting back on pain meds & opiates ect,,ect,, don't make a lick of sense. jmo .......................Buck

Thank you Mishelly, I Truly enjoyed visiting with your Dad I loved the way he thought about things and he said what was on his mind I never got to meet your Dad in person but just getting to know him here on hadit I could tell we would have become great friends, Stretch was my kind of people. Everyone That knew him is at a lost & empty feeling here at hadit and Sadden by his death , its never eazy for anyone when they lose a loved one and best friend, just remember all the wonderful times with him and the things he taught you your life will go on and your memories will be forever until you guys meet on the other side. Ms berta I think the USA stayed in Long Binh until around 1973 0r 1974 or so,IMO after most all the troops were pulled out of Nam from the North on down to the South after President Nixon Orders a phasedown Release program of the troops in the RVN Conflict,(not exactly sure what it was called) Then North Vietnamese Army came south after Most all the US Troops were out and the North, Finally took control of Long Binh and on to Saigon, I think this happen around 74 or 75 but I'm not sure on these dates. During the time around 1965/66 to 1973 or 74 (maybe before that?) some of the bases did employee Civilians Vietnamese for labor,the women washed clothes/fatigues ect,,ect,,/cleaned the hooches where the soldiers stayed and then V men did odd jobs,most were very poor and unhealthy and of older age but they were a lot of young too, at the end of the day they were all loaded up on a bus and taken out of the compound, for long binh They were taken to a bus stop mostly for the Vietnamese that lived in Saigon & some US Buses would take some of them back to Saigon. The South Vietnamese were good people. Most troops called the women ''Mama-san''& for the humorous side words like ''dinky-dau, boo-coo were used a lot ''you dinky dau'' ''you boo-coo crazy'' jmo ..........................Buck

That's Ok Phillip I might have misunderstood you but you said you agreed , Oh well anyway thanks for saying your sorry if you offended me because truefully yes it did....PR Apology Accepted & Thank You. but mostly what Mr Quibley Stated And for the record Mr Quibley I too am not afraid to say anything to anyone face to face any time anywhere and you can keep your educated guess to yourself and I would appreciate it you would stay out of any of my post from now on.....Sir Phillip I get pissed off when someone/anyone calls me a liar, I understand this is very complex and I too thought at first he was in some type of special forces, this veteran has Major PTSD and I let him speak his mind, ...its my fault because I thought he was saying special forces when he was telling me he was in special operations. Sure I know he needs more hard evidence and hopefully that will be in his records everything I state is what he said to me or I researched it, I have no reason to lie to anyone and I believe this Veteran although some of the things he says is hard to believe I'm working on that now the best I can. I just don't understand why his unit is not on the internet? The Operations Branch (TMP) I Can not find that ? But he has a plaque that supports the Operations Branch (TMP) & the only part of his Battalion I found was the Saigon Support Command in Long Binh Headquarters Headquarters Company SSC. As for as Guard Duty he said certain units from all of LongBinh pulled Guard duty and obviously they were a lot of different units Divisions and Battalions at Long Binh Including the 9th infantry or a part of the 9th infantry. Also He never stated that he was in a Transportation Company...I may have stated that because of him a driver of a recover vehicle a Truck I suppose? He might tell me he was a pilot in an helicopter next....but that kind of BS don't bother me I still wont tell him he is a liar. I need his Records and then we can hopefully figure this all out. This Veteran did what was ask of him and I am proud to help him win his claim. Thanks ................Buck

Well I think this Special Operations Branch was taken wrong meaning everyone thought he was in special forces I did too at first , that's not the case here, after getting more information from him. eh! He don't have anything on his DD214 About that (Operations Branch) but he showed me a plaque from his unit gave him when he was going home(second tour) it says'' Presented to Sp 4 ------ .------- to show our appreciation for a job well done from the operations branch Saigon Support Command TMP has the American Flag on the top left the RVN Flag on the right and a map of all RVN in the middle.......His unit crest at the top that says ''FIRST and a USARVN patch or the left under the American Flag His 214 does have Vietnam as Indochina yes Korea no and he has 5 medals, and if your not infantry or special forces that don't mean you never seen combat or did your MOS he was not doing he MOS, his company commander had him doing this recovery of US Vehicles which is a completely different MOS. Now if you want to see this I'll Ask him to let me take a pic of it (Down load the pic put on here on hadit. and if you still don't believe that then you can kiss my Asperolo. And I don't care what you believe Quibley or Phillip.. you have the right to your own opinions I'm surprised in Phillip I always had respect for him. I never stated he was in transportation I might stated maybe. eh! I never question any Vietnam vet about what they tell me they seen or what they did in Vietnam, I treat all Vietnam Vets with a lot of respect, if he is lying then let the records show it. If a Vietnam vets wants to come home and say things about Nam that I know is not true I don't call him a liar, I just go on about my business. some of the vietnam veterans has Major PTSD AND I never question what they say if its there way of venting then so be it. My Brother was killed in action up at Quang tri Provices in July of 68 1st Marine 1st Battillion A company USMAC, He died of his wounds same day3 hours after the event happen. Research that if you think I'm lying about that Mr Quileby... His full name is William Loyd Foley Look him up he is on the virtual wall. I promised myself after that if I did my tour & got home in one piece I would help any veteran no matter what branch and I tend to believe what a veteran tells me, now theres a lot of veterans that had it rougher than others over there I don't doubt that at all, but I never will call a veteran a liar...and just because you guys think he is lying about being in Special Forces Because the Name ''Operations Branch was brought up....then think what you want. and I don't really give a damn what you think... Know it all Mr Quileby (I hope you wet the bed tonight Sir) I disagree about that a part of the 9th infantry was not in Long Binh it was research it! As for as me stating he was in the 9th Infantry I did not say that, I researched a lot of battalions /units from Long Binh 9th infantry was in Long binh or a division of the 9th and I said he may have been with them...or I believe he may have been in the 9th Infantry. Get your facts straight Mr Quibley. AS for as him witness a Vietnamese child get run over I believe he did see that and I hope the records will have something in them that pertains to that. Laugh about that Mr Quibley and get your facts straight Sir. As for as Guard Duty On the perimeter go ahead a laugh ALL of his unit members had to pull guard duty it also should be in his records when we get them. His Nam dates are from Dec 69 to June 71 As for as not believing him I have no reason not to, you guys can believe what ever you want if your so set on thinking he is lying about being in special forces because he said he was in a''special operations branch unit then that's your Opinion, he never claim to be in special forces &I never said he was, like I said I was like Ms berta at first & thought that until I got more information from him. He has a Diagnose for Major PTSD And at times its hard to understand him, so I just say well that's ok buddy we can go over this later when your feeling up to it. I believe this veteran has been straight up with me and I might have posted something I was not sure about until after the fact. I apologize for that. Its good that you guys can remember your platoon and all the members you served with that's good you have a good memory like that my hats off to you but believe it or not when your alone and do your duty alone and only see your fellow unit soldiers at night I can understand why he don't remember names...but like I said you can believe what ever you want. Ms berta as for as his travel orders it says on it what I can make out of it At the top of the letter heading it says Department of the Army Headquarters , US Army Support Command Saigon....Date Feb 10th 1970 IN-Country Travel Authorization The following individual is authorized to travel within the geographical limits of RVN During the period of so and so date. It has his name Rank -SSN- Organization HHC,USASUPCOM,SGN (TMP)....> (His unit I take it?) Valid only in connection with vehicle recover operations The purpose of this travel is vehicle recover operations. it has what his orders are listing from 1.2.3.4.5.6.7.8.9.10 basically saying the rules are and what he can't do and can do ect,,,ect,,where to travel, radio contact and what he is going out after. sign by his motor transportation officer Captain ******** * ***** It also stated that these travel orders can not exceed 60 days period. It has some more things on it I can't make out but the Subject is IN -Country Travel Authorization. Thank you & Thank you Ms beta for all your help and research with this and your valuable time...its well appreciated as well as some of the other hadit members on here stillhere ,USMC_VET, Jerrel Cook, Jbasser broncovet, Gastone and lots others I can't think of right now...I appreciate all you guys. ....................Buck

From the beginning a veteran files his claim, its a good practice to read and underline important information and hi-lite it and same with all dates hi-lite all of them too & keep in a safe place with all your VA documentation. Keep all correspondence Letters from the VA and Always get a certified return receipt on everything you send the VA. kept all your receipt's.& make double copies of everything pertaining to your claim. ReQuest C-File is a good date to copy and keep in a safe place. All medical documentation medical from VA and Private Sector. When it pertains to your claim never let any thing go by the way side chances are you will need it someday...make those copies. I have what I call my own home- made ''C-file everything is in Alphabetical order for fast search! ...................Buck

Thanks Jerrel & Ms Berta I think it would be a nice gesture for most of the Hadit Elder Members to post their condolences to Mikes Family the members that new him best before he got so down with his Illness. When requesting a veterans records should he ask for all of them from the time he join until the date he got out of the service? and do these these records include all of his Medical & in service records? Medical Records can be ordered from his VAMC, but do the records from St Louis Have some of his Medical records also? and from all the overseas country's he served in? Thanks .................Buck

Ms berta, Thanks for the above information and all your research , the veteran that was grated ptsd &mmd on the docket No.94-08 832 will sure help, I believe this seems close to this veterans case although he may not have Had has many Dr Reports as this particular veteran. I believe medal with two stars is from his volunteer service with the convoy getting the new buses and other volunteer service as recommended by his superior officer He does have 5 medals listed on his DD 214 and like this veteran it has the Vietnam medal with 2 stars and a medal that says with 60 devise and his commendation medals Now I need to research 38 CFR U.S.C.A 1110 U.S.C.A. 3.303 (d) and NOTICE OF APPELLATE RIGHTS under 38 U.S.C.A 7260 What reason did the BVA OR Maybe it was the RO checked with the ESG Enveriromental Group Cohen vs Brown 10 vet.App 128 Ms berta yes he his helping out all he can and he has sent off for his records from St Louis Mo....Not sure about him trying to contact the JSRRC for his stressors, what is that? Stillhere, I have look until I'm blue looking on the internet for hisunit I found is battalion its a big one in USARVN Called ''Saigon Support Command,HHC TMP He was placed in the operations Branch TMP in this Battalion After 4 months of in Cuntry(After he got to VietNam..and was doing a different MOS.
