  2. There are a lot of systems/conditions the VA don't let the Vet know about. I had Dupytrens Contracture and I see it has a rating for it but to get it SC is something else/you would think the Dr's would let the veteran know it is ratable eh!......it just happen to come up on me had it for like 6 years....that's a condition that the disease starts to tighten up your fingers and it draws your fingers in some times just one finger or all four (mine was my right pinkie) it curls inward and can't use your hand for anything or it makes it hard to. VA did inject some type of enzyme in the cord and the next day they broke the cord into (very painful) but you get antistatic and that is whats painful...big old long ass needle. Anyway I never knew it could be rated? don't know how to file a clam on that? anyone know? ................Buck

  5. mtkabbott, could you possibly make your text just a little bit bigger. If the VA has your retro in review be sure and check the dates because the longer they wait the bigger your retro should be. Be sure to check your Bank Account every few days. jmo ...............Buck

  7. I had my computer (laptop) go crazy yesterday as it updated / & after I rebooted it to get the updates completed , Well it wipe out my home page and had installed Microsoft 10 as my primary. I was using Microsoft 8.1....so I had to go to internet options and recover my old page. that means put the stuff back before the Microsoft 10 came up. That solved my problem. This is the time of year Microsoft changes up things and does it unexpected. ......................Buck

Well according to his spouse he has had these conditions for a long time he just would not tell anyone, has they worsen over the years, he has a stressor that could cause this MDD or PTSD, However I don't think its documented ? That's why I ask if he could go on the presumption that it indeed happen while in a combat area (reasonable doubt goes to the veteran) And ''Texas Marine'' maybe your correct it could possible be secondary to his primary disability on file. He would need his PCP doc to state this...or His MH Doc Thanks Guys. .................Buck
  9. If your not eligible for VA HealthCare but if your ever service connected you will be eligible. That don't make a lick of sense, I suppose if you have a military injury you could always get an IMO and give the doc some of your military history and show him your MTR's have the Doc to go by the VA guidelines and ask him to state your injury was least as likely as not caused by prior military service & MTR's and anymore medical evidence you can get and file a claim with your RO. this should get you a 0%rating. jmo .........................Buck

I think this veteran has a legal argument, the VA did not change the regs to have serve 24 months until 1980 so he should be grand-fathered in , in this case. he served in 1970, even with a medical discharge from basic training he should have a DD-214. even though he had this injury prior service & he may not be SC for it but he should be able to get VA Health Care. jmo ......................Buck

  12. could there be a presumptuous of a stressor? especially if that stressor happen in a combat hostile area. say the Vietnam conflict...because some times nothing is ever reported by the veteran and years later starts to relive his combat duty & his life is destroyed because of it. .............Buck

If a veteran is already rated SC 90% Combined rating and VA rater jump him up to the extra scheduler to get TDIU P&T For only one SC disability because this disability keeps him from working and his age is over 55 & He Had this rating over ten years concurrent AS to be of nature with no future exams schedule. Now Another disability as come up And the VAMC PCP Doc sends Him to MH and MH Doc & a NP diagnose him with MDD/PTSD. Does this veteran need to file a new claim for the metal disorders? or will the VA send his medical records to his Regional Office for A Expedite /Forward claim? and the veteran don't have to do anything? or should he try to gather evidence/stressors ect,,ect,, and Get this Mental Disorder SC?& Rate %and expect a C&P for this new condition? of course be his choice. Trying to help a veteran and I'm not very familiar with the MDD/PTSD Regs just from what I Read I can't find anything on this type question? ......Thanks ......................Buck

  15. Thought Id post this for the veterans that can't find the new PTSD Regs these changes were posted by elder hadit member carlie back in Nov 13th 2011. If anyone knows of any ''New PTSD Regulations'' please post them. Thanks, .................Buck
  16. Did you have this Dysautonomia when you was SC AT 20%?? and Homeless? or if not what is your 20% rated for? Being your in appeals for all these contentions? You may want to check with a Dr with VA experience. One comes to mind is Dr Bash he is a member here at hadit if your on the street you need to go see your VAMC SOCIAL OFFICE.   17. Question, How would a veteran know if A qualified PTSD Doc signed off on his PTSD Diagnose by a N.P.?? I take it N.P.s don't have much clout in claims? ......................Buck

  19. It helps to be 55...but check out these regs.....I know its some times hard to understand a lot of post and some times I get mixed up but just try to put 2 &2 together. §3.327 Reexaminations. (a) General. Reexaminations, including periods of hospital observation, will be requested whenever VA determines there is a need to verify either the continued existence or the current severity of a disability. Generally, reexaminations will be required if it is likely that a disability has improved, or if evidence indicates there has been a material change in a disability or that the current rating may be incorrect. Individuals for whom reexaminations have been authorized and scheduled are required to report for such reexaminations. Paragraphs (b) and © of this section provide general guidelines for requesting reexaminations, but shall not be construed as limiting VA's authority to request reexaminations, or periods of hospital observation, at any time in order to ensure that a disability is accurately rated. (Authority: 38 U.S.C. 501) (b) Compensation cases—(1) Scheduling reexaminations. Assignment of a prestabilization rating requires reexamination within the second 6 months period following separation from service. Following initial Department of Veterans Affairs examination, or any scheduled future or other examination, reexamination, if in order, will be scheduled within not less than 2 years nor more than 5 years within the judgment of the rating board, unless another time period is elsewhere specified. (2) No periodic future examinations will be requested. In service-connected cases, no periodic reexamination will be scheduled: (i) When the disability is established as static; (ii) When the findings and symptoms are shown by examinations scheduled in paragraph (b)(2)(i) of this section or other examinations and hospital reports to have persisted without material improvement for a period of 5 years or more; (iii) Where the disability from disease is permanent in character and of such nature that there is no likelihood of improvement; (iv) In cases of veterans over 55 years of age, except under unusual circumstances; (v) When the rating is a prescribed scheduled minimum rating; or (vi) Where a combined disability evaluation would not be affected if the future examination should result in reduced evaluation for one or more conditions. © Pension cases. In nonservice-connected cases in which the permanent total disability has been confirmed by reexamination or by the history of the case, or with obviously static disabilities, further reexaminations will not generally be requested. In other cases further examination will not be requested routinely and will be accomplished only if considered necessary based upon the particular facts of the individual case. In the cases of veterans over 55 years of age, reexamination will be requested only under unusual circumstances. .....Buck

Gglider222, I don't think you need to worry about your SC Disability, you have had it untouched since 2001 they have a 10 year rule that when your disability has run concurrent for ten years or more then that exempts you from a exam, About the only way they can take your current disability away is they prove your disability has without a doubt improved to render you a lower rating or they can prove Freud. I'll go get the regs on that and post them. ........Buck

OIC Thank you Ms Tbird I was thinking if the veteran was 100% P&T& been that way for years and had a disability secondary to his P&T single disability for TDIU P&T that arose from it years later & Diagnosed from the VA PCP...would that be ''separate & distinct'' maybe that means ''secondary''as it would be independently ratable at a whatever % hopefully 60% in this scenario/case ect,,ect,, MDD comes to mine...or severe depression diagnosed by PCP Doc The PCP's Most anywayz won't tell ya nothing if it concerns a claim for comp. .................Buck
  23. Could a veteran get something rated secondary to his SC Disability if he is T&P TDIU? Say for instance Depression from his total single disability. at 90% SC looks like he could? but I am not sure if his depression has to be SC? If so how would he do that? to get SMC if he does get a 60% rating for depression? ..............Buck

I stop drinking years ago and turn to ''peach cobbler'' Buttter- milk biscuits' and white cream gravy just kidding, eh! but since I can't work I have put on a lot of weight just in my stomach no where else, I am looking forward to getting back to the gym and working out if my knees will let me & eating right...now if I can convince my spouse to stop cooking all the darn things that I love which is carb city I might lose. one good thing is in this family no one smokes my spouse and my two sons and me. but there married and live off , its just me and my spouse and some times our little beautiful healthy 5 year old grand monster daughter stays a week with each month which is the joy of our lives. ...........Buck
