My spouse has filed for SSD but not yet been approved. She use to get her medical care at the VA and the specialty clinics but they closed the clinics to her. so we ask ChampVA if they could suggest a good and reasonable supplement Insurance. They recommended (Sellman Insurance) 50.00 deductible. I had to join American Military Retires Assc (AMRA ) (25.00 membership a year) to get the insurance with Sellman Insurance, it covers the other 25% what ChampVA Don't cover. its about 74.00 monthly. but they have a 6 month waiting period for pre existing conditions but covers any new ones. To join the American Military Retired Association you need to be 100%SC P&T.. & They have other benefits as well. .........................Buck -

AndyMan. you should file a NOD on all your SC disability's and what the Doc said about them getting worse a lot worse, you could possibly get 100% P&T. Get new medical evidence to support your claim and what that Dr mention. If you can't work they can award you TDIU P&T With no future exams and your disability's are of Nature Or static. ...................Buck -
Well when they release you they give a report as to why they released you from voc-rehab and my counselor stated it was not feasible to retrain this veteran because of his service connected disability's, I actually did not ask them to write a letter they just did and sent me a copy, I used it at my DRO Hearing as supporting evidence. IF you use voc-rehab to go back to school or find you some type work you can do then yes its hard to win your claim if you go back to work or currently working especially TDIU They didn't have Ebenefits when I did my claim ...................Buck

your probably going to get the cue denied if you file for wrong diagnosis They can correct that, and your disability kinda falls under the next rating code for the appropriate rating..if your current disability don't have a code number or wrong code? you should file for your other disability's with new claim if you have new medical evidence, or you can file NOD on the current issues your having...not so much a wrong diagnosis but for your Back & the Radiculopathy if you already have a claim with these disability's? then file for an increase if they have worsen. but you need medical evidence to support your claim. ............................Buck -

I never cared for the W.W.P, when people make a big profit USEING wounded veterans to benefit them self , I have no use for a charity like that. I think I read some where? from the'' wwp'' donations that they spend 80% on them self(executive salaries) and 20% on the veterans ......................Buck

I'd take it with me to the DRO Hearing! that way you make sure he gets it! DRO usually look over your records and an evidence they have, he should ask you if you want or have any new medical evidence to present to help support your claim. I find DRO's are nice guys and want to help us . .............Buck -
If a veteran can't make it through Voc ReHab and can't do the work he use to do. unable to work because of his/her SC Disability's or find substantial gainful employment. Usually the Voc- Rehab counselor will write a favorable letter for the veteran to help get TDIU, However medical evidence is the key that unlocks the door to 100% TDIU. You can always call the Voc- Rehab and ask them to do you a big favor and write a letter for you. Voc-Rehabs must be different across the country but mostly I think its just the people. jmo .................Buck

Unless things have changed since I was in VOC=REHAB...that is BS. My counselor was glad to write me a letter stating it is not feasible to retrain this veteran because of his SC Disability's I was in Voc Rehab & ILP. BUT THAT WAS WAY BACK IN 2000 ................Buck

I had a veteran serve bout 2 months he got hurt bad in Basic training and was medically discharged. He was accepted in the VAMC As A VETERAN..IF you have A DD214 with a discharge other than dis honorable then you can receive VA Health Care. ........Buck -

Yes you could reopen the claim but an NOD would be better imo to get a better EED. Reopenning the claim I believe they will just go back to your C&P Exam in 3 -15 if it was rated as mild to severe in 3 15 C&P Exam check your ROM it could be grater than 20% now it possible be 30% maybe 40% bringing your rating up to possible 70% or higher & the EED May go back to the original claim 11-98 You may think about getting a IME/IMO and Ask the Dr to use the VA guidelines pertaining to this particular disability or the causes from it. Remember in a cue claim you can't use new and material evidence, they use only the evidence back when the claim was first filed only. Although you probably would get a better EED. Asknod or Ms Berta broncovet or JBasser would be better to ask about this type claim they all know a hell of a lot more in this VA system than I do. they be would be the ones to ASK about filing a reopen claim or just File NOD and Disagree. I would file NOD and disagree with their decision & attach your new and material evidence. I believe an increase is warranted for this disability....to %? look to see what you should be rated at. Also I've notice that my diagnostic code for this rating is not correct (state what form # its on) (give the code #) could you please correct this as I need the correct diagnosis code for my records. or if this diagnostic code has no Number and the rater added it to the next appropriate rating disability? either way you would like this to be corrected. I would not file a cue this is just my opinion....other elder members can help, but this is basic what I'd do. ....................Buck -

I mean can a veteran file a cue...if he finds evidence in his award letter years later? like they paid this veteran from the time he filed for an increase &he was50% rated....he file for increase in 2001 and bases state the reason for the award medical evidence shown the disability has worsen....but it also stated although records show u stopped working in 1999 we grant your award from the date you files for increase....2001...filed increase from 50% in 2001 awarded claim in 2002 1 year rerto And the Veterans SSA employment records show he stopped working in 1996. would this be a cue on the va? So I'm thinking he is missing out on 5 years retro? .............Buck

If you had a DRO Hearing, and they expedited your claim and was awarded TDIU P&T. Filed increase 2002 awarded 2003. but the DRO who wrote in his report he mention that ''they paid you from when you first filed for an increase on your 50% disability in 2002 altho records show you stopped working in 1999...but SSA records show you stopped working in 1996. Is he referring to the SSA Records? They are the only Administration that keeps employment records correct? Maybe the statue of limitations preclude from reopening the claim ? if VA has such? .......Buck

I tell veterans to go and file for their disability's even if they already have a S.C.disability and getting compensation & no matter what % 10% up to 100 % if a veteran has more SC Disability's that arose later then File Claims for them if a veteran is deserving of the SMC's so be it...he/she is entitled. I believe a Veteran should get what he /she is entitled to. My opinion they need to increase the compensation rates to at least 50% ....................Buck
