  1. If you are rater 100% and not P&T VA will schedule you for C&P in three years, and i see it have been three years for you, when you are rated 100% and not pt VA are saying that its a possibility that you can get better. If your symptoms have worsten VA could rate you P&T.If I was you this is what i would do as soon as possible i would get me a appointment with a private psychiartist of psychologist and get he/she to write me a letter stating that i am unable to be gainful employed now and in the future because of my ptsd symptoms. From what i read in your post VA should rate you P&T and i am hoping that they do.Good Luck mobie
  2. Pete i am only trying to help this veteran and to get service connected you got to play by va rules. mobie
  3. The VA gives Ratings in increments of 0,10,30,50,70, and 100 but you never no about the va.In my opinion, if you are rated for ptsd i would guess 50 or more and if you are unemployable you need to get a letter from your psychiatrist of psychologist stating that you are unemployable now, and in the future mobie16r
  4. First of all you can have ptsd, but to get service connected for it three things have to happen.(1) Be diagnose with PTSD by a medical professional (psychiatist of clincal psychologist)(2)Have vertifable inservice stressor (unless you have a purple heart,Combat Infantryman badge, combat action ribbon of any medal that was rewarded to you for being in combat with the enemy)and (3)your ptsd corroborate with your inservice stressor and it is ongoing. mobie16r
  5. Bufloquv,I am going try and tell you what you need to do to get ptsd rating and the reason VA denied you.First the reason you was denied. You was diagnose with ptsd in 2008,you witness a car accident in 2005 where yor son was almost hit with a rock that flew through your windshield and car accident in 2005 where people was hurt and this trigger your ptsd symptoms,VA is saying that the 2005 and 2008 accident is the primary reason for your ptsd and you was denied because this is not military related. If i was you i would file a appeal and submit new evidence. In other words anything that didn't happen in the military would become a moot point, (accidents 2005 and 2006)i would concentrate only on the accident you was in when in the military 1989. Every time you visit your psychiartist of psychologist only talk about 1989 accident and how it affected you now and over the years. If you having nightmares, panic attacks, night sweats, of anything else, just make sure it all pertain to the car accident you was in, in 1989.I hope this helps mobie16r
  6. Deserteagle, welcome to hadit, more than likly if va reopen your claim it will be retroactive to the original date of claim. You should have a chcck in the mail of in the bank mobie
  7. If your C&P examiner stated that you was unable to to be gainful employed. it is possible for you to get a rating of 100% and Unemployability become a moot point. Could you explain the two gaf's of 50 mobie
  8. Celli like Larry said, you could be rated 70% and TDIU.Most of the time when there is total occupational and social impairments due to mental disorder and etc: VA will give you a 100% rating for generalized anxiety disorder and make TDIU a moot subject. mobie
  9. If you want your C&P results, download va form 10-5345 from the www.va.gov/ and fill out and sent in to the release of information veteran medical center where you had C&P Exam and and you will get a copy in ten to fifteen days or when they finish it, or you can go there and go by release of information fill out the require forms and they will mail them to you. mobie
  10. You dont necessary have to have a C&P to get a increase for PTSD.If you got a IMO and a VA pyschiartist write a letter that your ptsd syptoms have worsen and you are being treated you can get a increase.ITs all about evidence that you get from a medical professional. mobie
  11. Remember,Carlie any injury or illness that is recorded in your SMR's that was cause by, or aggravated by your military service, but not listed as chronic, will not be service connected unless you are getting ongoing treatment after being discharged from the military, and a good IMO stating, that the illness or injury is as least as likley as not due to your military service.Don't know what the reg is,but i am sure that the VA have one.I hope this information be helpful. mobie
  12. Trailblazer, like carlie said, try calling and getting it vertify. If it is a C&P Examination, make sure you go to these appointments. mobie
  13. Bob,i agree with pete53,very good advice from Matt mobie16r
  14. congrats on your award mobie16r
  15. Mako25,since i became 100% service connected for PTSD in 2004,i have helped a lot of veterans with there ptsd claims on the local level, and at the BVA.I know if your claim get granted at the BVA,it can't be denied at your regional office.Your claim will be send back to the Regional ofice to get a rating, thats the reason it take about four months. mobie16r
  16. clw if you were affected by that air show disaster, and you are still having nitemares and not being able to sleep, because of it.go to a psychiatrist of a clinic psychologist, private of va and get a diagnosis and use that as your inservice stressor. mobie16r
  17. Once, claim get to authorization it have been rated of denied.Authorization check for errors, making sure all T's been crossed and I's been dotted, you probably will get a letter within two to three weeks.Sometimes the 1-800 people will tell you whether you got a increase of denied, once it get posted, and they can pulled it up on there computer screem.Try giving the !-800 people another call. GOOD LUCK! mobie
  18. Post like carlie, said and let us try to help you.On your letter of denier,"Under reason for claim bein denied" VA will tell you the reason for claim bein denied. Most of the time,it because of not having a "VERIFIABLE INSERVICE STRESSOR" mobie
  19. First of all,you have to be diagnose with PTSD,Second, you have to have a inservice stressor.Combat Infantryman Badge (CIB) Purple heart. Combat Action Ribbon (CAR) Or any medal that you received for being ingaged in combat with the enemy. If you don"t have any of those medals, you need a vertifabbe stressor that can be vertify that cause you to have ptsd AND YOUR ptsd HAVE TO BE ONGOING. MOBIE16R
  20. If you have a purple heart, cib,or any medal that you received for being in combat,VA will schedule you for a C&P, if not,you wil have to have a inservice stressor that been vertify, before a C&P is schedule. when va give out two GAF,most of time,it is one for PTSD and one for alcohol.VA might be trying to say you had a Alcohol dependence ,before your military service instead of saying that you use alcohol to medicate your PTSD and if that the case,it will knock down your rating. I am helping this Vietnam veteran that was given Two GAFs at C&P,50 for Alcohol dependence and 65 for PTSD and he got a rating of 10%.VA said he was dependent on alcohol before his military service. mobie16r
  21. Don't worry about your decision being reverse, because the the decision to grant already been decided. The Regional Office is going over your medical records to see what percentage they are going to give you.For PTSD its either 0, 10, 30, 50, 70 or 100. Good luck
  22. Mako25,The BVA grant or deny your claim if its granted, it will be sent back to your Regional office for a rating, and it take VA, about four months get your award to you,i know how you feel, just hang in there and congrats on your success. mobie16r
  23. What are your inservice stressor that cause you to have PTSD? mobie
  24. Competent lay evidence meaning you don't have to have any specialized education, training or experience,in other words anyone can give lay evidence. Lay evidence is competent when it is provided by a person that has knowledge of the facts. For Instsnt,if you was on a search and destroy mission and you got in a fire fight with the enemy and this was not documented, any of your buddys that was in that fire fight with you could write a competent lay evidence statement, because they was there with you and they would have knowledge of the fact. mobie16r
  25. Thanks Berta for your response and that is some good advice and yes he receive social security disability mobie
