  1. If you never stated the reasons listed, it would seem that they are the opinion of the examiner.
  2. Sorry to hear things are not going well for you. Speak with your health care provider about admission into the hospital. If you are in crisis you can go to the emergency room.
  3. If you ask for an audit of your award they will have to add the cola before they reply. All Authorization awards must be completed in order to complete an audit. Right now you are one of thousands that the computer will generate an OVERRIGHT award on. They sit in a pile until Central Office demand that they are addressed at the Regional Office.
  4. Send an IRIS request and ask that they reply in writing.
  5. The VA can only find you incompetant if you can not handle you money. It is best to have the doctor you are currently seeing write a state that it is his/her medical opinion that you have displayed the ability to handle your money and are capable of paying your own bills. It will hold more weight than you getting a statement from a doctor that has not trated you in the pass.
  6. Contact the Homeless Veteran Coordinator. There is one located at the hospital and at the Regional Office. When you send in any correspondence put ****HOMELESS**** on the top. Your claim will move faster this way than filing a hardship. Homeless veterans are tracked by the Central Office in Washington.
  7. If you got your retro payment on the first your regular payment should have been included. They pay through the first of the month if the deadline for submission has not passed.
  8. You must file a claim for "depresson secondary to foot condition". You claim must state that it is a secondary condition. You can file the claim ASAP.
  9. When she files for benenfits she need to state that he died of a service connected conditon "Lung Cancer". They will have to do a rating for her DIC claim.

  11. You still have to show that you have the condition. The VA can deny based on you not showing up for an exam.
  12. If the form is over a year old they will need a new one. However, if your have already sent in the information you are delaying your claim by having them send for the same information. If there is updated information pick it up and send it in yourself. Tell them to ignore the 21-4142 that your previously sent in.
  13. What was the effective date of his TDIU. If it goes bact to 2009 there is no back pay. If the increase is effective prior to his TDIU he will receive backpay.
  14. Filing a claim to add your dependents do not reopen your claim for compensation as far as the rating goes. You can add you child even if you are not married. If you file within a year of the birth they will pay you back to the date of birth as you date of claim.
  15. At 50% you are covered for all conditon at the VA hospital with the exception of Dental. They will charge any care you receive to you insurance.
  16. If the check is not there today call the 800# and make sure that one was sent out. They can put a tracer on the check and issue another on if need be.
  17. I would add the evidence to my appeal, otherwise, you still have to prove service connection in order to get an increase. In order to reopen a denied claim you must have new and material evidence. Should the DRO approve your claim the evidence for a Temporary 100% will already be of file.
  18. You can ask you Dr to write you a letter addressing you condition and its severity. He/She can address issues contained in the C&P exam, however, only a C&P doctor can do the exam.
  19. A claim can be deferred for many reasons. Usually it is for further development or a C&P exam. Sometimes they need clafification from the doctor. It alos can be because your Duty to Assist has not expired. Make sure you have all of your evidence in prior to the decision.

    Denied Dic

    The information that was sent to the pension management center should have been sent to the Regional Office (RO) in Little Rock. While it is confusing, DIC is handled at the RO and pension is done at the Management Center. You can reopen you claim by sending the information to the Little Rock Office. At the time of the decision the information available to the RO may not have contained the amended death certificate. Also you mentioned POA. Make sure you have signed a VA Form 21-22 appointing power of attorney to whom ever is assisting you with your claim. The VA can not accept information form a third party that is not your POA of record.
  21. An application to add a dependent to your awared is technically called a claim. While it is an administraive procedure, it has to be assigned a claim (130 EP) in order to maintian control of it.
  22. If at all possible, you need to post the Reason for Decision in order for us to look at the whole picture.
