  1. Since the letter came from your NSO, you would be corrected in assuming that she filed the claim. Actually she was doing her job. You gave her power of attorney to act on your behalf. Seems as if she is on your side.

  4. The PTSD/depression/memory loss and IBS will be rated separately. The other symptoms of fibromyalgia will be rated together as they are a part of the disorder. They would be rated separately if there was no diagnosis of fibromyalgia.

  6. You can not NOD the reduction until it takes place. You can NOD the headaches You don't have appeal rights on a proposed reduction. You should ask for a hearing. Once the decision is made you will then have appeal rights.

  8. A C&P exam is not done in advance for a Prestabablization rating. There are all kinds of factors that effect whether or not an exam is done. Need more information.

  10. If you have a Service Officer they shold have received a copy of the letter. Find out what information they needed and send it in. A claim is not final until one year after the date of the decision letter. The information will reopen the claim.
  11. The only way to get another exam is to go through the Regional Office. They have to pay the hospital for the exam, thus the C&P office has to get a request from the RO.
  12. Humor me, what does the VA prescribing meds have to do with the condition being service connected. Did you have the condition while on active duty or within a year of discharge. The VA hospital has no connection to the VA Regional Office. They are two different organizations.
  13. You can reopen your claim by asking the Regional Office to reschedule your appointment. Do so in writing.

  15. Take the letter to your doctor and have him state that the treatment record is in error. Case closed.
  16. I had the winning number to the lottery and powerball but I put them down and can't find them. Damn PTSD!!!!!! I will probably find them the day after the drawing. Go get them, YOU ROCK!
  17. It looks as if the VA is calling Clear and Unmistakable Error (CUE) on themselve. As a part of his rating they understood that he had loss of use of his arm. After review they are saying that this was a mistake. The is no time limit (5 year exam) for them to call a CUE. The only way you can appeal is that he indead has loss of use of the arm. If he does, send in the medical evidence.
  18. You can do Voc Rehab while on TDIU. They encourage you to do so. Their hope is that you complete VochRehab and get a job. You can keep your TDIU for the first year after you go back to work.
  19. Anytime you add to your existing claim the new issue has to go to development for a VCAA letter. It is not optional, it is mandatory. Once your have your notice it may well go directly back to the rating board. Chances are you will get a C&P exam.
  20. All mental conditons are rated under the same criteria except eating disorders. You will get no higher rating for PTSD than you get for Major Depressive Disorder. Hate to hear about the trauma that you endured. They will only rate you for one mental condition. Your local Vet Center should have a Women's group for PTSD. Check it out.

  23. It might be a brokered case. Sometimes one RO will send cases to another RO for rating. It is just a numbers game. If it is a brokered case they usually complete them in 30 to 60 days.
