  1. They would have to have a raw score of no more then 78 (rounded up to 80) to not get to 90. 78+10=80+10=82+10=84 (rounded again to 80). At a raw score of 79 plus the 3-10's would get you 85 (rounded up to 90). The vet needs to go on ebenefits and hit the disabilities tab and see what the VA is counting and at what rate. Cut and paste here if it is what you say the numbers are. At the top of that page it will show the overall percentage, etc., I cant see that page being jacked up. It might not show everything, but what is there is counted in the total. I don't think its a NOD, maybe a call to Peggy, but not a NOD. Probably just VA math. Hope this helps, Hamslice.
  2. Andy, My mistake was when I got out I looked at what ailed me and I saw that I had high blood pressure, so I claimed high blood pressure. What I know now (from Broncovet, I beleive) I should have claimed heart disease. Then I should have gotten LVH and hypertension from the start. In other words, let the VA do the work. My last claim, I claimed left anke/foot pain problem. The VA investigated both my ankle and foot and I got SC'd for one thing and I did get some info for further areas to proceed. I think if you have a injured hand and you claim your ring finger, they are only going to look at your ring finger. Whereas if you you claim your hand they have to look at everything, etc. Just saying, Hamslice

  4. Buck, I guess I should have been more specific. For the last month or so it wont let me see either claims status or payment history. Just the spinning wheels. Today the same. I can see and get everything else, letters, disabilties, etc.. Thanks, Hamslice
  5. All, Just was looking at my disabilities on eBenefits. In 2016 I did a new claim for heart disease as I was service connected for hypertension in 2008 and after a lot of reading and looking at my old med records it appeared to me that I probably had heart disease back in 08 and should have claimed it then but I was just a Soldier back then and not a doctor like I pretend to be know. LOL. Here is what is posted regards my heart in eBenefits currently; hypertension..................................................................................................................................0% Service Connedted 08/19/2008 >tricuspid regurgitation (also claimed as heart disease).................................................................Not Service Connected >hypertensive heart disease (also claimed as concentric left ventricular hypertrophy).................30% Service Connected 05/10/2016 Now in my med records I have/had evidence of LVH (enlarged left ventricle) and subsequenlty was granted the 30% secondary to HBP accordingly. Now also in my med records was tricuspid regurgitation on at least 3 ECG's from active service. Now my question is not that I think I should get more comp for the tricuspid regurgitation, as probably the heart disease trumps that, but why not Service Connected at 0%. I don't understand the "Not Service Connected". Seems the same evidence proves both? My hypertension is SC'd at 0% because it is controlled by meds which is correct. FWIW.   6. FWIW, I just tried to get an increase for my right foot plantar fasciitis. I was originally given 10% for just having pain from plantar fasciitis in 2009. About two years ago I started geting coritzone infections for pain, so I filled for an increase last year and was denied. From what I can tell is you get 10% for pain, and only 10%. With joints you can get more because of Range of Motion. I would get service connected for flatffoot pain at 10% and then secondary your ankle for ROM is possible. I do not think the injections call for anymore compensation than pain, i.e., 10%., however, in the archieves of past cases I do see where the shots have made a difference. My C&P for my increase for plantar fasciitis did involve an x-ray that showed arthitis of the right ankle and the examiner stated that it was caused by the plantar fasciitis, but it is not mentioned in my rating denial. I think I have something there for appeal, or at least a new secondary claim. That's my next step. Keep working all the angles, you know they are working all the angles against you.   7. bronco, All I can tell you is when my parents sighned up for it 20+ years ago, they went to walmart and sighned up with Humana. Then about 3 years ago, when we (kids) got involved, we found out that in our area, there was two plans, Humana and Security Health. After some research, we found out that all the Hospitals in our area where customers of Security Health and we switched thier plans and saved a bunch of money. So, I would do some research and see what works best at the Clinics and Hospitals you think you will be using, etc. I beleive this is a local thing and you need to do some local asking around and see what your neighbors are using and paying. A lot of the Hospitals are being bought up by insurance companies and it is cheaper if you use their advantage plan. And you have to consider all of the costs, deductibles fees and drugs, etc...   8. paul, This is just my opinion, but I think you would need something on paper for anything to change. Like a divorce, etc. The are married couples that live in the same house but seperate rooms, hell there are married couples that live on the same land but in two seperate houses. But, in both case they are still maried. So, if it were me, and the wife played ball, as long as there is not a divorce document with the courts, you should be fine. One exception would be if someone tried to claim one of your children as their dependent, i.e., if you still married wife were to move in with someone and that person wanted to jack with you.   9. Seems as of recent I am unable to see my "work in progress" and or my "payment history". All I get is the spinning wheel of doom?? Everything else works fine. I do have FOIA c-file request currently with a completion date sometime in 2019. Maybe thats whats got there undies in a wad. Thanks, Hamslice

  13. John, I agree with you totally on this one. I am really confused on the FBI part of the story. I mean, he went to them and told them he was f*cked up?? But, I can add that with our "everyones a winner", everyones normal" society, this will only get worse. With my job, I can commit people for 72 hours with just my signiture. But, they just get released and come back. My favorite is teenage girl "cutters". I can call a medical screener and tell them I have a 16 year old girl with blood running down her arms. They cut themselves repeatedly either for attention or because there nuts. And the docs, say no need to bring them in, just a cutter. Couple years latter they are usually cuffed in the back of my squad for something more nefarious. Anyway, This guy was telling everyone he had a screw loose and then the screw finally fell out. He was looking for attention, that is why the gig was up when he saw the cops and surrendered. Not a martyr for allah, just a nutjob. Hamslice
  14. Buck, I just thought of something. Pay records. Not the ones that you get, but, I wonder when you look at your Social Security statement, you can see how much money you made from when you started work. Mine go back to when I was 16 and working at the grocery store. When I started out in the National Guard, the years I went to basic training, OCS, Officer Basic Course and Officer Advance Course all stick out as big years because that was big money from what I was making at the Cranberry Marsh (minimum wage). Now I know that all the statement has is the amount you made every year, but I wonder where they get that data and if they would have what the gov submitted for your wages that year. It would be interesting if they have that data. It would show what you earned and you could use that for evidence. Not sure if in 69 Army money was big money or not, but extra pay might show up to show you were overseas, hazardous duty, iminent danger, flight, etc., The other issue is if they had it would they share it?   15. Buck, Just a thought, but my service is from 1981 til 2008. I attually have 5 seperate DD214's. This is because of reserve time where you get a NGB for 23 and active time where you do get a DD214. My time hopped back and forth. You only get one form 23, however, you get as many DD214's as you do active service. So, if you had any breaks in service, or simular experiences, maybe you have another DD214 out there, Just for the record, the VA will only put two of my DD214's on my service verification letter. I did have three and then there was only two, so I submitted all 5 and they responded that I only needed one to qualify and any more that two was excessive. So, my record is jacked too.   16. Two points, First, I believe to correct either your 214 or your Discharge you would use the BCMR. And there is a cutoff of how long they will go back. In both my cases before them, (both denied) they made an exception and waived the cutoff. In both my cases, I had compeling evidence, but because they were related to my time in the National Guard, they stated that local govenments (State Departments of Military Affairs) do and did overide there decisions. Second, I must have researched upwards of 2 to 3 hundred cases in the archieves, and there was about 1 out of 10 wins to loss ratio. Very hard to win. And there was absolutely no wins for any discharges related to positive drug tests. And most of the cases where that. "I tested positive and was discharged but am a good person", etc. Some of the case I read, the applicant did not even state his/her case, just wanted thier discharge changed, again for a positive test. Also, a lot of the wins were where the Military made a gross mistake and then you would find a bunch of Veterans making the same claim and winning with the same evidence, usually a administrative error for calculating years of service for ROTC or something simular, etc. Anyway, in my experience, hard to win, Hamslice P.S. Buck, both my cases took about 7 months start to finish, so at two years, I think they might be working yours, I hope that is the case and good luck.
  17. I have said this somewhere before, but in my world, if you file a claim, and the VA investigates, and the VA, denies, but later you win, you get "treble damages". For one, the VA would do a little better job during the C&P, And there would be less denials. Just saying, Hamslice
  18. When you saw your pending claims at the bottom of the disablilities page, were both PTSD and Tinitis listed seperately? I did get a pending claim decision and when it came, one was decided and the other referred. But they both stayed on the bottom of the disabilites page.   19. I have had this happen to me. During my C&P the examiner stated that I should file for my left shoulder (arthritis) because she saw it during my claim for my right shoulder. The VA took xrays of both shoulders for comparison. I waited til my results came back on my right shoulder, which was service connected, then I claimed (new claim secondary to) for my left shoulder with the with only the VA's own xray of my shoulder. I did write in plain English that the C&P examiner suggested that I claim my left shoulder in my written statement. I was service connected secondary my left shoulder 10% arthritis by xray. Anyway, thats how it worked for me. If your concerned about the start date, then you could just add more to your current claim, but I don't like gumming up the works and let my claims go to fruition before I start up again. Which, by the way, must start working on my appeal. Merry Christmas, Hamslice
  20. Why do I have to lock my house, or car. Because they do not punish the bad guys hard enough. Thats why. If I would have took something that was not mine when I was growing up my mom would have killed me, and then when dad got home from work, same thing again. Now, everyone wants their "safe space". Identity theft. Life without parole if caught. Just sayin, Hamslice And Buck, don't forget at least one number, capital letter and a symbol......, and no names, etc..
  21. Michael, I had to look it up because I had not heard of it before, "Reactive arthritis can affect the heels, toes, fingers, low back, and joints, especially of the knees or ankles. Though it often goes away on its own, reactive arthritis can be prolonged and severe enough to require seeing a specialist. Effective treatment is available for reactive arthritis. Reactive arthritis tends to occur most often in men between ages 20 and 50. Most cases of reactive arthritis appear as a short episode. Occasionally, it becomes chronic." "Reactive arthritis is a painful form of inflammatory arthritis (joint disease due to inflammation). It occurs in reaction to an infection by certain bacteria. Most often, these bacteria are in the genitals (Chlamydia trachomatis) or the bowel (Campylobacter, Salmonella, Shigella and Yersinia). Chlamydia most often transmits by sex. It often has no symptoms, but can cause a pus-like or watery discharge from the genitals. The bowel bacteria can cause diarrhea. If you develop arthritis within one month of diarrhea or a genital infection – especially with a discharge – see a health care provider. You may have reactive arthritis." So, I believe that your C&P examiner probably did not know what it is either. That said, did you get the letter (denial) back from the VA (rater) yet? By your post, I think you will get denied, however, you may not, so nothing is anything until you get the letter. Now, we do know that you are service connected for it at 40%, so what and how is/was that rated? Do you know the code they used to rate you in your original award letter? That will help determine where to go from here. You will need to appeal, but you may need help from a doctor that has experience with the VA, etc... I have not done that yet, but plenty have on this site, so you should get some good advice here. From what I read in the definitions, and that your have been SC'd for it, if my finger hurt, I would claim a secondary for it. Just sayin, Hamslice

  24. Really it all depends on your raw score. You say you are 90, but are you actually 90? Anything from 85 to 94 could be a 90. So, if you have a raw score of 85-92 the plus 30 would get you only up to 94, which would be rounded down to 90. If your raw score is 93, then a 30 will get you 100. And if your raw score is 94, then all you really need is a 10. Would need to know all of your disabilities you currently have to see what your raw score is before VA math. FWIW, Hamslice
