The Trick Of Clearing The Back-Log

Rate this question

Question

Well it seems they know how to clear the back-log. No surprise, but by just claiming errors in the claim process.

In my case that would be, after checking E-Bennies, that they have basically closed all because I did not submit my prescribed medication in time (2 years I think). I did not submit this information, because ALL my prescribed meds are via the VA. That information should be readly available to them when they recieved the paperwork from the VA (which I know they did recieve it).

I do not know if I can "fix" this, but I plan on going up to the RO in Indy (good thing I am only 30 minutes from it) this coming week.

I thought maybe I would at least get a C&P for at least one of my claims where I could possiably "straighten" out anything that maybe "not be properly" filled out or missing. Guess they do not want to even do exams to avoid the costs of that all togather.

I am sure in time I will get this straighten out, just po's me that they are looking for the short cuts to clear the backlog!

I say this is part of clearing backlog because my claims have been in for over two years (I know many here have or are waiting longer, just going by what they are saying). And, they just closed these claims out on the 13th of this month.

Guess what. Prescribed medication issues dont have a damned thing to do with adjudicating a claim.

Now you get the meds from the VA and INDY (One of the worst regional offices inthe US) doesnt recognize this, they are violating their duty to assist as it is on them to get records and info in VA's posession.

Write these idiots a 21-4138 and let them have it. They are delaying and stalling you. They do this type of crap to a lot of vets. They will even send you other vets medical info and when you try to give it back, they will try to arrest you. They did it to another Hadit member.

These folks play dirty.

A Veteran is a person who served this country. Treat them with respect.

A Disabled Veteran is a person who served this country and bears the scars of that service regardless of when or where they served.

Treat them with the upmost respect. I do. Rejection is not a sign of failure. Failure is not an option, Medical opinions and evidence wins claims. Trust in others is a virtue but you take the T out of Trust and you are left with Rust so be wise about who you are dealing with.

They can clear a lot of the backlog by doing it right in the first place and getting rid of the deadwood that does not finish claims.

Veterans deserve real choice for their health care.

I made a claim for reimbursement for dental work one time. The VA worker just threw it away. I found this out from his boss. The worker was angry that he had to do my claim because their was some work involved. I was pretty shocked the VA admitted this. It took 6 months to get my money. The VA practically called my dentist a liar and a crook. There is a ton of deadwood in the VA at every level. I did work at the VA about 25 years ago at the lowest level. Even at that level there was politics and back stabbing.

Then I got lucky and got a job at the USPS. Out of the frying pan and into the fire.

There is no way the RO Indy should not have your medication list. What I think happened is they lost it. And like jbasser said the RO Indy is one of the most inept RO's of the 56 or so that work claims. They have gone from 330 days wait time, to 417.2 in just a few months. And I bet they don't work OT either. Maybe on paper, but not really worked.

Unfortunately, I could see them doing mass denials for small omissions or procedural errors. It restarts the clock for them and (on paper) shows them bringing down the backlog. All it'll do is kick the can down the road, which the VA is pretty good at.

I'm not here to feed your ego.

    • These decisions have made a big impact on how VA disability claims are handled, giving veterans more chances to get benefits and clearing up important issues.

      Service Connection

      Frost v. Shulkin (2017)
This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected.

      Saunders v. Wilkie (2018)
The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

    • Caluza Triangle defines what is necessary for service connection
Caluza Triangle – Caluza vs Brown defined what is necessary for service connection. See COVA– CALUZA V. BROWN–TOTAL RECALL

This has to be MEDICALLY Documented in your records:

Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • Do the sct codes help or hurt my disability rating
    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.

They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.

      This is not true,

      Proof:

About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends.

Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken.

A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did.

I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
