Requested Female Examiner. Got A Male Examiner.
It is not possible to record the C&P exam with an audio recorder. While state law does allow for recordings in some states with one-party consent, there are many states that require consent of all parties to the recording. In Maryland law, as long as both parties are aware of the recording and consent to it, it is legal. If one is unaware it is illegal in most cases. DC is completely different. In Washington, DC, you can record whatever because it's one-party consent. But this is Federal law, not state. There's a statute that forbids recordings or attorneys present because the exam is investigative in nature, not judicial. One thing, though, can …

Initiating re-evaluation for SC issues
I have just started the process to re-evaluate my disabilities and am seeking advice. I claimed issues with knee after ACL reconstruction, and got 0%...I understand that my ROM might have been fine, but not without pain...they also said I could walk with normal gait. I got 10% for lumbar strain with degenerative changes, and got 0% for bone spur with degenerative changes. The problem is that I did not have enough pain for them to rate higher than 0 for several of my issues. They did however do x-rays and noted that there were a few issues that I did not claim that I should get service connected....most of them are the other appendage (ie. I claimed left knee, they not…

Re-Evaluated claim
What can one do if the VA Dr. made statements that I never said? This is very concerning to me to read the evaluation and to see the Dr. flat out lie and state word for word that I said something that I never said!

C&P Clinicians Guide
Below is the C&P 's "Clinician Guide" link dated March 2002, off the VA website. I know it has probably been posted in the past but I figured just as a refresher. https://www.benefits.va.gov/warms/docs/admin21/guide/cliniciansguide.doc

False Statements
I have just recently had a re-evaluation at the VA for a condition I have been 30% for the past 3 years. Just tonight the C&P VA Doctor that did the C&P made statements saying that I said things that I never said. This is a clear lie as the Doctor says I told him specific information that I never told him I cant believe he is saying I said this when I did not. I am going to appeal it and fight this to the end. No way there should ever be a Doctor at the VA making fictitious statements that were never told to that Doctor.

C and P exam Intent to File a Claim 2017
Hello fellow Veterans, I am trying to figure out, if I can pursue a couple of service connection claims, that I was examined for during my C and P exam/ Persian Gulf exam. The first one is Esophageal Conditions: It states EROSIVE GASTRITIS OF THE GASTRIC CARDIA IS A SECONDARILY SERVICE CONNECTED CONDITION AS THE RESULT OF SERVICE CONNECTED HIATAL HERNIA. Do I file a claim for this diagnosis from my C and P exam/ Persian Gulf Exam? This was the diagnosis from the C and P examiner! Second One is for MIGRAINES....The Opinion was MIGRAINE HEADACHES IS THE DIRECT RESULT OF GULF WAR MILITARY SERVICE....stated by the C and P examiner. Do I file a claim on this one as well?

Which is better?
Hello, I hope all is well. I started to use the ebennies to fill out my worsening conditions but the ebennies pooped out on me. Seems like a waste of time. Any opinions on whether I should ask a county VSO for help or call whomever about ebennies? Thank you. HG

C&P Glass is Half Empty
I just had two C&P exams this morning and am trying to keep a positive mindset, but the glass looks half empty to me. Maybe someone else can offer some insight on my situation. Since April, I have been rated at 60%; 50% for PTSD and 10% for tinnitus. The claims process for those went pretty smoothly, really, and I was awarded my disability ratings in very short time. I have since then filed three additional claims. My intent to file was back in April, but I submitted the claims on July 25. These three claims are for hypertension secondary to PTSD, sleep apnea secondary to PTSD and for hearing loss. Today I had my C&P exams for the hearing loss and hypertensio…
