Peripheral Neuropathy
Service connected for left leg radiculopathy due to spinal fusion, stenosis, degener, spondylolithesis, arthritis, yada-yada. *During EMG exam at VAMC to ascertain if increase in rating was warranted for leg radiculopathy, EMG physician now identifies "polyneuropathy" of the leg in addition to radiculopathy. **Has any one ran into this or read about this before. I am sure the VARO will use this nonservice connected diagnosis of polyneuropathy to deny an increase. I don't quite understand how they differentiate between the two, like which one is predominent? EMG diagnosed both conditions. The radiculopathy is from my sc spine, the polyneuropathy cause (etiology)is un…

Ao Dmii Vets
AO DMII vets who developed CAD or heart disease before they developed DMII should now be Nehmern class members. The VA denied many Heart claims for that reason. Now the AO Presumptives for IHD may open the door for a re-open with an Effective date of the original claim if it falls within Nehmer Criteria or to the date the Date of the Nehmer decision. J

My Iris Response-
(My August 4 th 2010 IHD claim per 800 # did go to Togus in late August but they are checking that one per this Iris. The claim they are mentioning here that is in Philadelphia on appeal is my SMC accrued CUE claim. That has been pending since 2004 .The VA is right in that the IHD CUE claim must be resolved before the new IHD claim and as I stated in the Togus IHD claim- a proper award on the CE will render the newer claim moot.) Has anyone else been told their AO claim is being handled in Phila or Togus? "This is in response to your inquiry to the Department of Veterans Affairs dated November 6, 2010, regarding your appeal. Our records indicate your claims file…

Ao Payment Update
Update in part: Though the first batch of payments did go out midweek, the relatively small number — about 1,300 claims worth $8 million — reinforced the fact that the process for calculating retroactive payments is timely and complex. The VA expects to produce a steady stream of rating decisions and payments each week for these diseases, perhaps in the thousands. But there will not be a November geyser of checks as some veterans had hoped. Most of 163,000 veterans or survivors with pending claims for these diseases should expect a longer wait, at least several more months. The VA goal is to have all these claims processed and paid by October next year. htt…

The Eagle Has Landed
I have been reading this forum for about a year. I am a boots on the ground grunt in Vietnam. I filed a claim for IHD in Febuary 2010 going back to June 2008 on a denied claim. I recieved the big envelope today. 100% temporary till April 2010 and 60% with IU from then thru present. Everything went smoothly, I filed with the local county veterans service officer, All treatment has been with the VAMC in Palo Alto. They are paying 100% retro back to June 2008. My EF is 35-40% and MET's are 4.8 This should be in success stories, but I know that the AO vets are anxious to hear about awards. WAHOOOO!!!!!! This is already relieving a LOT of stress.......I'll change m…

Payment Of Agent Orange Claims
An article released by Tom Philpott on 5 November 2010 states that the VA's goal is to have pending Agent Orange claims processed and paid by October 2011. It looks like some of us have many months to go. A link to the article is proved below: http://www.jdnews.com/articles/new-84466-disease-orange.html

Ao Ihd Claims
Hi all. Just got back from a meeting with my veterans advocacy group (Texas Veterans Commission) at the Houston RO. We were discussing my different appeals. They mentioned that everything at the Houston RO was on hold except for the agent orange claims. This apparently means that everyone is working those issues to get them done. One of the reps stated that it might be a 3 month delay while they work thru this mess. My own case is ready to be rated and I doubt it will happen until next month at the very earliest. Who really knows?

Iom Committee Meets In Chicago Nov4Th
My Vet checked his eBenfits page today(nothing new), but while he was online, they sent him a notice of the public meeting tomorrow in Chicago to discuss the health effects in veterans associated with the herbicides sprayed during the Vietnam War. "The report from this committee will be provided to the Dept of VA to help advise officials on policy decisions regarding compensation to veterans for service-related illnesses." (Hotel Allegro 1pm central) "The primary purpose of this meeting is to hear from Vietnam veterans about their health concerns. All Vietnam Veterans are invited, and anyone who wished to share a personal experience with the committee are encouraged…
