Ao Korea New Reg
This is big for some vets denied because they didnt fit into the older time frame. Source : VA Media email WASHINGTON - Veterans exposed to herbicides while serving along the demilitarized zone (DMZ) in Korea will have an easier path to access quality health care and benefits under a Department of Veterans Affairs (VA) final regulation that will expand the dates when illnesses caused by herbicide exposure can be presumed to be related to Agent Orange. "VA's primary mission is to be an advocate for Veterans," said Secretary of Veterans Affairs Eric K. Shinseki "With this new regulation VA has cleared a path for more Veterans who served in the demilitarized z…

Agent Orange Question
Hello Everyone, I'm helping a family member who has already been service connected for Prostate Cancer as related to Agent Orange Exposure. He has recently had issues with thyroid disease (Hashimoto's - aka: hypothyroid disease) and now wonder if it could have something to do with the AO exposure. I haven't been able to find anything except for Thyroid cancer. Any tips on which road to go down ? He is 70% sc for the prostate plus depression as it relates to the loss and ED. Thank You, VetsLady

C & P Ihd
Had a C&P exam this last week for my heart. I had a heart attack when I was 49 years old and a five way by-pass. They awarded me ten percent compensation 2009 (which was 11 eleven years after my heart attack). The C& P should increase the percentage? I filed under Agent Orange and Nehmir but was turned down. The Nehmir Attorney ask for my records and will reviw the case for me. I don't expect that I will win and never have, as that is the Goverment job is to only support there cause. I just keep fighting untill the end as I have lived the nightmare, they have not. This will help my wife in the long run,as she is the one that I saw on my return from V…

diabetes Dmii Retro Under
Some time ago we had a question here from a DMII vet that asked why the VA gave him a retro date of May 8,2001. I don't recall being able to answer him adequately but I believe someone else did-and the information bears repeating for any veteran who did not get the June 1, 2001 retro EED ---depending on the initial date of their DMII claim. “Liesegang, et al v. Secretary of Veterans Affairs On December 10, 2002, the US Court of Appeals for the Federal Circuit issued a decision in the case of Liesegang, et al v. Secretary of Veteran Affairs. The Court held that the correct effective date for our regulation adding Type 2 diabetes to the list of presumptive disabi…

I send my IRIS responds that denied my claim and received the following; The National Veterans Legal Services Program is looking out for Veterans. We are writing you to follow up about the claim for benefits you previously filed with the VA. Based on what you told us, we now believe the VA may have made a mistake in your case. In this letter, we first explain the Nehmer lawsuit and why we believe VA may have made a mistake in your case. We then explain the steps you can now take to allow us to help ensure that you receive all of the benefits to which you are entitled under the Nehmer lawsuit. The Nehmer class action lawsuit In the class action lawsu…

Ihd Originally Claimed As Secondary Condition--Is It Retro?
Perhaps someone here can answer my question. I claimed IHD in 1999 as secondary to preexicitation syndrome ( heart condition). The IHD was denied as not being related to the syndrome but it was agreed that I had IHD (coronary artery disease) not service connected. The syndrome itself was rated at 0% but service connected. Now with the AO presumptives I have filed a claim for IHD in June 2010. Question is: Will they consider my previous claim for IHD for retroactive purposes even though it was filed as a secondary condition? My case is being handled as a Nehmer claim but my concern is that the IHD was originally claimed as being secondary not primary in and of itself. …

Veterans Lawyer Foresees Long Waits After Agent Orange Case
This article was posted today 12/28/10 on LawFirmNewsWire.com http://www.lawfirmnewswire.com/2010/12/veterans-lawyer-foresees-long-waits-after-agent-orange-case/ It makes this allegation: "More than 163,000 veterans or survivors of veterans have a pending claim related to these diseases. The VA hopes to have them all paid out by October of 2011. To meet this goal, some believe the VA has given special attention to the new cases and other veterans may see longer waiting times as a result. We have been hearing from the VA that the U.S. Court of Appeals for Veterans Claims has told it to process these claims prior to ruling on other claims," said James G. Fa…

ptsd Reopening Agent Orange Claim Due To Prostate Cancer
I was recently diagnosed with prostate cancer (Dec 10) after 4 biopsies beginning approximately 5 yrs ago. I'm also service-connected at 0% for residuals of hepititus and alpecia areaota. I served in Vietnam 69 - 70. I also applied for other disabilities including PTSD approximately in 1994 and was denied. I was compensated by the chemical company that sprayed ao during that time and applied to VA for residuals of ao such and was denied. I would like to know with this diagnosis if it can be used to reopen the initial claim. Thanks for your help in advance.
