Remanded back to st. Pete
Even though we had wavier, for decision be made at bva. The docket number is14-41 036A. From what I understand they want the ro to make decision if renal failure is due to cads. It is like they are totally over looking that we filed it has secondary to Diabetes, because hubby was not diagnosised withcads until 2013,and va granted it in July of 2014.he was diagnosised with renal failure in 2011.?? that is the reason for filing secondary to diabetes. Let me know what you all think. And hubby did not file for iu,but now they are telling him to? What are his chances.

4th of July appeals
Well I hope everyone has a good and safe 4th of July. I’ve come to understand the 18008271000 really nice do not have accurate info on your appeal my appeal was remanded to the RO/AMO. I received there decision and denial on June 1st and mailed back the page two to avoid delays and be sent back to the BVA. They give me the scripted answer well your appeal has been remanded I said sorry sir it has already been decided you can see page to of the decision entered into my appeal to waive the RO review and goto the BVA. He said I see your point the other pages haven’t been entered I laughed, question is will my decision be entered into my appeal or will it just be sent to the …

Respond to the Va in 30 days
I received a letter in the mail from the Va stating that my claim is under review and that additional info will be needed in order to make a decision. I got out of the military on a Chapter 10 discharge. The Va is stating that no info can be found about my discharge anywhere. They’ve reached out to many different outlets and came up short with little to no information. The Chapter 10 was granted instead of going to a court martial. I’ve hired a lawyer to help me in this situation as far as clearing my name and helping my situation. I am confused and really need help.

Missed obvious medical documentation during C&P exam
Hi All, I appreciate any tips or advice on how to win my claim! Here is a basic overview: 1. Got denied for Lumbar condition even though I clearly have it documented from '05 until my retirement in '12 with diagnosis of Lumbar strain and chronic pain shown. I literally have two medical records that give a summary of my history of pain going back for 4 years since the initial ER visit in '05, with no prior history of back issues. 2. Are Missed Lab Reports/Diagnostics New and Material Evidence? Really wanted to thank everyone for their help in advising me. Since the last time I`ve posted I have went from 20% (for 30 years) to 80 %. My original claim for kidney disease was denied, with the help of a VSO, and is with the DRO to date. I decided no one would have the time to look at the 6000 plus pages and filed my other claims pro se. Following the guidance in this forum I was service connected for migraines (50%) tinnitus (10%), and left ventricular hypertrophy (30%) in addition to my original service connected HBP (20%). Effective Date Question
I submitted a claim for an increase on my VA disability on 12/5/17. I was NOT granted the increase in a decision letter dated 1/15/18. My local VSO submitted a reconsideration on 4/10/18 at the same time informing me of a veteran's event at the regional office on 4/26/18 where I could submit my new and material evidence to support my claim. On 6/28/18 I was awarded the increase but the effective date was 4/10/18. I was thinking the effective date would be 12/5/18 since I am still within the 1 year time frame and the reconsideration was for the exact same condition. Denied Service Connection
I applied in 2016 for High Blood Pressure, Sleep Apnea and Diabetes and was denied “not service connected”. In 2017 I applied for PTSD and was approved for “Service Connection” I reapplied in 2018 for the previous denials, as a secondary to PTSD. Again I was denied because they stated the conditions occurred prior to my service connection for PTSD. Not sure what to do at this point. Appeal?

7 Year Appeal, When will it end?
Recently I just hit my 7-year mark for an appeal that i file back in 2011. At the end of last year, I was granted everything I appeal expect Headaches and TMJ. Earlier this year I had to go in front of a board explaining my case on why I think i should be compensated for these two disabilities. Long story short I won the case. It's been over 3 months since I received the letter stating that I won and that my file is going to be sent to my regional office for the final review which determines my monthly amount. Secondary disabilities and pyramiding
Here is my question: Given two ratings, one primary and one secondary to that primary disability, is the VA required to evaluate the overall symptoms in the most favorable way? Rating using the secondary disability results in a vastly higher rating and both ratings cannot be evaluated due to pyramiding. I am service connected with "Raynaud's syndrome with Chilblains Syndrome and Hyperhidrosis": 40%. The VA lumped my secondary disabilities of Chilblains and Hyperhidrosis into the Raynaud's rating. Good Evening Fellow Comrades! I've recently filed a NOD for several contentions that were rated service-connect with a 0%. According to the letter that I received today, the VA received my written disagreement on June 2, 2016 (I thought that was rather quick).
