AM I BEING BADMOUTHED BY AN ATTORNEY?
The last attorney I had refused to answer or return my phone calls. She made a decision, without informing me, to withdraw two appeals via her "contact" at the St Petersburg VA Regional Office that I had submitted for hearing loss and tinnitus I revoked her legal representation. This attorney refuses to waive the legal fees. I have tried, without success, to obtain new legal representation by other law firms. Once I send the law firm the letter they request showing where I released my former attorney, usually in a day or two, I get contacted informing me they will not be able to take my appeals. One attorney told me he was goin…

CUE
Hi, I called Peggy a few days ago to check on my NOD and during our conversation I brought to her attention that my 2016 C&P increased my MS bladder to 60% and my 2017 C&P reduced it to 40%. She asked if I received a letter re: reducing to which I said I never received a letter. She looked further and said my disease is static to which I replied "yes I know." I have been 100% P&T for 15 years. She said "CUE---my static status was overlooked" I agree, that is why I filed the NOD to dispute the reduction. Peggy encouraged me to opt into RAMP and to compose a letter which addresses the CUE. I have read about (from Berta and Alex, and others) how c…

BVA Changes ,faster decisions
"Strengthened by innovative tools, VA recently issued a record number of decisions for Veterans appealing their disability benefits claims. As of July 11, VA’s Board of Veterans’ Appeals has issued more than 64,025 decisions for fiscal year 2018, a record high tied to several efficiency innovations, including a new interactive decision template and a specialty case team, which have allowed the Board to serve more Veterans. “Decisions made by the Board affect Veterans’ lives and it’s up to VA to keep improving this process,” said VA Acting Secretary Peter O’Rourke. “We will continue to innovate throughout VA even while employing the new tools that are already mak…

mY condition worsens while at the BVA and 2nd remand
mY condition worsens while at the BVA and 2nd remand. The doctors are running tests to find out what new liver disease I have and good possibility of big problems, as several of my diseases are already fatal. Pancreas, liver, etc. But now they have to continue with more than cat-scans, but now more biopsies, etc. Do I need to send them any new diagnoses while my appeal is at BVA< or will they get the papers from my records while still at the BVA? These new diagnoses and diseases are related to my claims. The VA surgeons as the disease progresses that they will be happening, because of the diseases I have it is natural progression for the other organs getting diseased…

AMC denial remand
so I received the AMC denial of my DVTs in service related to my TBI/COMA. I had dx in 2007 mostly and multiple paperwork I submitted in with my claim in the original appeal that remanded this issue to the AMC. I also experience random leg pains and experience times of heaviness in one or the other leg causing me to fall. I've had more recent an MRI of my spine and lumbar which was searching for an answer to the leg issue but found no DVTS again 10 years later. Now I had the past in service dx of my DVTs so how can the RO/AMC deny my claim based on no new dx and not even citing the old dx in there evidence? Do I need to do another Support statement to the BVA directly ask…

Question about Appeal NOD
Been trying to get a straight answer to this but no one seems to know. Maybe you guys can shed some light on this and what I should do. I Recently won an appeal for Headaches and TMJ. I originally filed back in 2010. Since 2010 I've been having multiple symptoms of these conditions. In June 2018 I received the case decision letter in the mail. I was granted 30% for tmj backdating to 2015-2016. and 10% from 2016 to present. I didn't receive any back pay because the BVA altered my dates so it wouldn't be any backpay even though I've been treated for these conditions since 2010. My question is, can I file for a NOD asking for a DRO to take a look at this, along wi…

FEEDBACK FROM THOSE WHO HAVE HAD DRO HEARINGS
The DRO hearing, if things go well, will take years off the appeals process. For those who had a good outcome, what were your success strategies? Did you present new nexus letters/IMOs, new and material evidence, refuting bad C&P exams to win on getting service connection? Did any of you present new VA 21-4138 forms, lay statements at the DRO hearing as a strategy? For the unfortunate vets that did not win, would you be kind enough to offer an opinion as to why you think that you failed to win at the DRO hearing? BTW, I just received a notice of an upcoming C&P exam for erectile dysfunction. How in the world am I going to prove my ho…

ATTORNEY & FREE ADVICE WHICH IS THE BEST
I don't post that often but when I see things going on which cant be correct I will say this if you hire or try to hire an attorney they maybe take your case or maybe not. If they do, don't you ever disagree with his decisions about your claim from the same u hired or what he files for you either you trust him or trust free advice which ever is best for you. Attorneys get paid to win. VSO get paid either way from yours truly . At least I can do a background check on my attorney , but can you do the same for free advice ???
