vern2 got a reaction from paulstrgn in when does the VA compensaation actually start?
Thanks for the comments. I was so excited to get my pay and some retro, that did not notice that my effective date was middle of month, so I did not get a participial month either. Feel like the VA is cheating us out of partial months pay.

Its always been my understanding (and in application with my pay at various times for ratings changes) that the month OF the award you don't get paid for, it starts the next month. If you have back pay that comes, but it isn't actually the disability award. It confuses some veterans, understandably so, because they calculate X for what their disability pay should be, or what the letter says, and then a backpay amount shows up that is nothing like the amount in the letter for their actual pay.

@paulstrgn is correct and was probably done to keep the accounting as simple as possible.

If I am not mistaken, here's how they determine when payments are made. The criteria appears to vary depending on some situations.
38 CFR § 3.31 - Commencement of the period of payment

It's a shame the VA rips off veterans by not awarding partial month payments. I wonder if any law firms have ever sought to challenge this. If we are late paying our taxes, the IRS charges interest for each day late. When it comes to paying veterans, they can get away with not paying up to 30 days of payments. Could be a lot of money for veterans with higher ratings.

The VA pays after the fact, Octobers pay comes in November. It is my understanding that that the partial month (9/2 is considered a partial month) you do not get paid for, only for full months. So in your friends case October is the first month he is paid and November 1st is the pay date.
I ran into the same situation, it stinks but it is the way the VA does it. I am happy to hear your friend did get 100% to begin with.

Behind the times. Was not aware of the AMA took effect on 19 February  2019. PLEASE DISREGARD MY POST. GO TO ASKNOD for latest on AMA, and how to appeal.
I have created a  sample NOD to use in your response to the VA denial of benefits letter. Please ensure that you use the correct VA form, 21-0958 dated Sept 2018, or later. It would be helpful if some of the senior moderators would review my post and comment on it.

Since March 25th, the only place to submit new evidence are the approved intake centers in Cheeseville, Wisconsin and Newnan's own in Georgia. If you are filing an Extraordinary Writ of Mandamaus, however, the need to inform the pukes at your Regional Office demands you send them an invitation (in duplicate) to the hanging personally. We're going into a whole new world of VBMS litigation. Everything is going to be in a word-searchable .pdf format to help the poor raters find that which you file. For some reason no one has been able to determine, VA raters have poor vision and even poorer sleuthing skills when perusing your c-files. This is why you sometimes have to submit evidence several times for them to catch on and get it.

Anything you file from March 25th on, has to be in their format-i.e. Form 21-526EZ for any claims filing of any sort, the 21-0958 for all Notices of Disagreements, the Form 9 for all substantive appeals after you (finally) get the Statement of the Case asking you what part of "no" you do not understand. To answer a SSOC, I suspect the old standby 21-4128 is still the approved vehicle. If I am wrong, I would appreciate someone's correcting me. Remember, this is new, uncharted territory we are entering. VA considers it Boldly going where no Vet has gone before. I suspect it's simply more of their Boldly going nowhere fast.

Has anyone used him for an IME/IMO. found his name through a directory on Haddit. My ortho C % P exams  did not go very well. The first one was by a PA , the 2nd one was by a QTC nurse, with no ortho experience.

Anyone have any experience with this VA application? Downloaded it to my Samsung notebook.  Looks good, but you have to know your dates in country and where your were at and were there any burn pits, contaminated water, etc that you could have been exposed to.

Yes, but make sure and check the actual award date of the newest award. I got retro, from DFAS, but they took 20% out for taxes. Got most of this back when I filed my taxes. I did not have to do anything to get the retro from DFAS. Remember, this is different than retro from VA.

Seattle (VBASEAT346) is the only Regional Office that handles RAMP. They do all  56 of the ROs . Nashville does Camp LeJeune claims etc. etc. Welcome to the National Work Queue.

What about age> I was awarded 100% P & T in December 2015, and letter stated no more exams. I will be 69 in November. I thought there was some protection if you were over 65?

I do not trust the DAV. If I had trusted the DAV, I would be at 0% compensation, instead of 100% SC. It appears that VA appealed your 10% rating a 2nd time and brought this back to 0%. You need to get copy of your VA claim File and proceed from there. You may be owed compensation back to 1988.  If the VA appealed your 10% rating from 1991 in 1994, there should be some record in you C file. When you get your C file and review it, then post again on forum with any questions. Yes, you may want to file the 21-4138, but not until you see what is in C file. This is just my opinion.

Agree with Buck. I used eBenefits for long time, but never trusted what was in it. same for Peggy. In fact, if asked question of Peggy and then eBenefits, never got the same answer!!

I used to submit eBenefits questions if I was bored and nothing to do- (I am retired), just to see what weird response I would get.

I agree with Buck, but to remind your self, you need to tattoo this on your arm:
It can go from "preparitng for decsion" back to "gathering of evidence", sometimes, 3 times or more.   I have responded to posters where something similar happened in ebenefits.    This is at least the second time I have been in the status, "With Veterans law judge" on ebenefits.

Wow, very German. Frank1959, the batteries that I get from Denver DALC are made in Germany! So Germany is going to tax you on a product that the VA buys from Germany and then sends to you in Germany. Does not sound right to me. The German Company is VARTA Microbatterties, Daimherte 1, 73479, Ellwangen, Germany. Please check and see if you can contact this company directly and see if they will assist you.
