Very Depressed, And Was Wondering If There Is A Time To Throw In The Towel.

Question

I have been waiting for over 820 days for a claim that is still in gathering evidence. Appeals that no one knows about. P&C exams that I'm suppose to take, but the VA and QTC have no clue about this. The 1-800# were you make an appointment for them to call you back, but they do not. You can not get your Law Firm to call you back. My Parkinson's, DMII, PN, PTSD, etc. are taking its toll on me, and was wondering if there? What the crap am I talking about? Quit? My ass!! Never Never Never!! Just want to choke someone at the Houston RO.

I feel the same way! But look at it this way...... At least you are sc and some of us are still waiting to get that. Btw, how long did it take you on your initial claim at Houston? May 23 will be 16 months for me at Houston Varo. And May 14 will be 5 months in the decision phase! And this is my initial claim. And nothing out of Houston in Success Stories. The 800# did tell me that they were through with all the " living' Nehmer cases. I really don't know what to believe anymore though. Hang in There!

I know there may be a lot of people that would say that if you did this then VA would just hold up your claim more but, I would do it anyway. I would 1st call my illustrious Congress person and if I did not get any results then. Hello, TV stations, radio stations, 60 minutes, newspapers any and all. Let them have to get on TV and explain why it takes so long.

When dealing with the VA if you want it bad enough you can get it. You may have to fight like hell but you will get there. It is like that with most things in life. If you really want it you can get it. You may have to pay your pound of flesh.

Hey Papa!

The biggest problem is we have to deal with Houston. I say we, because my claims go to Houston as well.

They waited over a year to do a second C/P exam on my eyes then basically denied the claim in less than a month after the exam. So of course since they didn't get it right the first time, ( and they almost never do), I had to appeal.

For me it has been 17 months since I requested a De Novo appeal, I remember when a de novo appeal took less than six months. I remember that it was always smarter to keep appeals at the local level.. but I think when dealing whth Houston you have to toss out all logic because they sure have a nack for screwing up wet dreams.

As to being lucky that you have a rating already, I have used the same line in a few instances, but when I read it from someone else I realized how terrible a line it really is. The fact is at one point in time we all waited to get service connection, (none of us are lucky for it)... if some one is still waiting for initial service connection, I feel for you but we all had to wait its part of the process...

820 Days I would strongly consider a Writ of Mandamus and also ask for an inquiry as to where and why the claim has not bone anywhere.

As far as being depressed many here have gone through it and you really should consider talking to a Doc about it.

Veterans deserve real choice for their health care.

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
