Member Carlie with the Angels - A Huge Loss for Veterans

Brothers and Sisters - Our CarlieCash had a heart attack Thursday and flatlined at home, 911 was able to get a heartbeat again, but to much time had passed. She is in a coma and recovery is not possible. Her wife Lucy has been handed the difficult task of letting her go and her decision is to wait until Veterans Day to honor Carlie and to let her go to her reward then. I am sure that Lucy and Carlie would appreciate all prayers and kind thoughts sent their way. I am heartbroken.

I've had a few challenges, perhaps the same as you. I relate them here to demonstrate that we can learn, overcome, and find purpose in life.

Maybe Carlie's mate might have some kind of legal case for DIC since it was impossible for them to be legally married in Florida until recently.  This might be a case for the ACLU.  The ten year rule for DIC for 100% vets spouses is a crime.   Was Carlie SC for Heart Disease or could any of her SC disabilities have contributed to her heart attack?  A autopsy is probably in order.   It is hard for those in grief to do these type of things.  She was a good person who took no BS.  I met her a few times since I live in Tampa.  Carlie, Commander Bob, my wife and his wife and I all met once when Bob was passing through the area.  These sudden heart attacks killed my father and mother.   When a person who is not even 60 dies from heart disease it is really a shame.

John, someone here (I think it was Seattle Shay) posted that they had a common law marriage in another state (Massachusetts maybe?) that could possibly  bolster a DIC claim because they were married only since July 2015 in Fla.

Her spouse needs to file  for DIC and would be eligible I am sure for some burial benefits, but I don't know how VA will consider the common law additional marriage.VA Regional Counsels are going to handle these types of same sex VA claims.

The SSDI has already awarded survivors benefits to same sex couples, when one becomes deceased, but I think their marriage criteria is at least 9 months and the VA's is 1 year.

I dont know if Carlie was sced for heart disease, but am very sure the 100% P & T status was over 10 years.

Yes I agree Ms Berta , carlie SC CONDITIONS were all over 10 years and chronic p&t

I believe Massachusetts  Recognizes common law, carlie probably knew florida did not recognize it & maybe her reason for being married in Mass?  carlie was a smart cookie but if no autopsy is performed   (what then) ? 

Lucy needs to file the DIC benefits soon (or maybe she has a year to file?)..but maybe she can't or won't  or don't know? but I am sure Ms T will let her know.

 carlie did mention these benefits after they were married in case anything happen to her  she wanted Lucy to be taken care of..

hopefully Lucy will know what to do

These things are very to do after we lose a loved one  but its something that needs done  or get some to help with it.

I've sent Lucy information regarding DIC and I know Carlie talked to her about it. I've let her know that we will do whatever we can to help her. If she calls and asks for help with the DIC issue I will pass along her questions.

Carlie was the computer person in the family, Lucy let me know she can look at her pictures and manage email a bit but that's where her computer knowledge stops.

I sent a lily from HadIt.com to Lucy and she wanted me to say thank you to everyone. For now I'm on standby if she needs me/us. Carlie had a friend ready to step in and help Lucy through this. I can't even imagine how hard this must be for her.

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
