I sent an email to Ms. Hickey last night concerning my latest decsion for increase. One of my contentions was for a suprapubic cystotomy performed in September 2014. That contention was never even considered in my claim. The superpubic cystotomy was mentioned and documented in my C&P exam but never was evaluted in my decision. If the suprapubic cystotomy was evaluted then it should have followed the regulations of: Title-38 Chap-1 Part-4 subpart-b 4.115b Ratings of the genitourinary system—diagnoses. 7516 Bladder, fistula of: Rate as voiding dysfunction or urinary tract infection, whichever is predominant. Postoperative, suprapubic cystotomy 1…

I called my VSO about my latest decision I recieved last week. He proceeded to tell me he was asking the RO to reconsider their latest decision and raise the one rating of 30% to 60% for neurogenic bladder. However after talking to him more about that rating I told him that it should really be 100% for the bladder. The reason for that rating is because in September of 2014 I had a suprapubic cystotomy performed and under diagnostic code 7516 the rating should be 100%. He said he would ask them to reconsider this and get the rating changed to where it should be. I think he seemed like he never heard of that before but he agreed with me after looking it up himsself. So …

Would appreciate your feedback on my math. I've request SMC evaluation in a NOD, and I need to get it right in my head, and document it with rationale so when I put it away for two years or so, I'll be able to understand it when I need it. Any thoughts or corrections would be very much appreciated! Scenario: (am TDIU now, scenario assumes sought increases fm NOD approved as below) 70% SC single condition verified sole basis for my current IU, P&T paid @ 100% 40% SC single condition 20% SC Lower Right single condition 50% SC single condition R Knee 20% (5828)+10%(5828 associated pain)+10% (5003 limitation of movement) L Knee 10%+10%+10% (as above) SMC Bas…

I got my BWE today with a decision. I understand most of the ratings except the last 1. It states Issue/Contention: Entitlement to special monthly compensation based on loss of use of creative organ. The explanation says: Entitlement to special monthly compensation is warranted in this case because criteria regarding loss of use were met from March 17, 2014. However it does not say what creative organ or the percentage? If I am giving a SMC for LOU of a creative organ, shouldn't it show? None of the dates are correct that they gave me. How do I dispute those? I have 1 contention that was deferred for VA examination. So that is probably why when I log on to E-Benefits…

I am still trying to figure where my claim is heading. My claim just went from Preparation of Notification back to Gathering of Evidence. There are several new contentions added to my disabilities however there are 2 that are not added. Those 2 that are not showing are: neurogenic bladder with urinary urgency due to multiple sclerosis (also claimed as suprapubic catheter) (Increase) and, diplopia (Increase). Do you think those 2 are the reason why it went back to gathering of evidence? If so I guess there will be a new C&P scheduled soon to justify those 2 other contentions? My other question to this matter is, I noticed the dates on these new added disabiliti…

I was trying to figure out what the results of my latest request for increase is? If I already have 100% for LOU of lower extremities bilaterally and LOU of upper right extremity rated {70%} then if another disability gives me 100%, where does all that put me? So these are my contentions, VBMS (New), left upper extremity weakness due to MS (New), neurogenic bladder with urinary urgency due to multiple sclerosis (also claimed as suprapubic catheter) (Increase), diplopia (Increase). The 100% I stated as another is for the suprapubic catheter which was put in me in July last year after several bouts with uti's and a couple of hospitalizations for the same problem. U…

Any thoughts on what increase if anything I should go to next? I have my C & P next week and currently I am rated SMC M+k. I asked for an increase after my 1st bout of uti's that I have been having and was told to start catherizing myself daily, due to urinary retention. Self catherization did not work and I ended up with another uti at which time I was hospitalized and then had to start using a foley catheter. That was okay for about 2 months. Now I have been with a suprapubic catheter since. I have been hospitalized 1 more time with uti and also been treated 3 other times as out-patient for uti's. My original dx is neurogenic bladder 20%. Just wanted any tho…

I am wondering what the criteria is for the different types of SMC that vets are entitled too. I went on the va.gov website and seen the rates but I am not sure what I'm looking at in regards to criteria and eligibility. Any resources as to where to find or download this info would be greatly appreciated. May no veteran stand alone.

As the title says, my wife applied for the Caregiver program around the 1st of December. We had the pre-screening, the in person evaluation and are now waiting for the in home inspection. Our worker went through all the questions with my wife and have us a "score" of 28. I don't know what that means or if it's bad or not. But has anyone else gone through this and provide a little light on what else to expect and what the difference between this program and aid and attendance is? Being now an unemployed 100%-er with smc-s, and waiting to hear from ssdi, she needs to know what we will have coming in monetarily. Thanks guys. -Mario

Hello I am 100% s/c p/t. My original claim began in 2001. I filed for aid and attendance in 2011. My questions are how far retro will the va pay and how long do appeals take. Thank you in advance
