Hi everyone, I've been gone for awhile. I just maxed out on facing this stuff after 20 years, and just received two Board decisions yesterday for my husband that immediately jarred me back into it. Anyway, I thought I'd share this with anyone who's interested. In late 2010 or early 2011, I filed a claim with the VARO for my husband who is rated 100% schedular, P & T, with one of his ratings being 60%, another being 50%, plus the others that make up the difference to 100% schedular per the combined ratings table, plus above that, he's got a 50% rating for sleep apnea and a 30% rating for bilateral cataracts (=70%). Hello I am rated 100 P&T % for Dysthymia with generalized anxiety disorder and agoraphobia. DAV representative discouraging me from asking for increase of SMC. It seems to be a reoccurring problem. They say that if I ask for an increase, they will/could reduce my compensation rating which is at 100%. I currently receive SMC-S.

I'm rated 10% IHD, 80% Parkinson's and 100% IU. I can't drive safely, so I quit driving, in order not to harm anybody. My wife or friends have to take me to my VA appointments and other appointments. I don't sleep but 3-4 hours per night, a VA sleep study confirms this. Right now I am 90% SC(70% MDD, 60% CFS, 30% GERD, and 10% Hypothyroidism). If I can get them to award me TDIU for my Depression would I qualify for SMC S then? Just confused about it. Thought I would ask.

Can i file for smc after winning a FTCA in 2008. I have a claim for 1151 sitting with the Law Judge in Washington DC waiting for my final answer. I've been denied like four times on the 1151 1st was because of progression of my disease second time same thing. The third time they denied me saying there was no proof in my records I had hip surgery which I never had I would know. DH has a claim in for SMC-K, for his erectile dysfunction. While he could very likely win a claim that his ED is secondary to his PTSD, it will be much easier and simpler if he claims based on his PTSD and his pain medication. For SC rated conditions he is taking: Lorazepam Venlafaxine Meloxicam Gabapentin Based on our research on Web-MD, all of these meds have sexual dysfunction as common/possible side effects. While he's mentioned his ED to his VA providers, both mental health and primary care, he hasn't sought treatment for it (this goes back to his PTSD), so there doesn't seem to be much in his VA records about it. So, I receive a brown envelope from the BVA today. My appeal for smc "s" award, inferred, dating back to 4/89 is due for a decision. It was remanded by the CAVC, twice, to the BVA for a decision, where it went to the AMC and then back to the BVA. Bergmann & Moore (B&M), LLC, law firm, won my remand, at the CAVC. They, B&M, sent me my records and said that I should not need them anymore. The BVA sent me a letter about 3 months ago requesting any new evidence I might have, within 60 days, or if none received they would decide. My question here is, I have a claim in for A&A that was submitted through the PVA. So if I am unhappy with them for what ever reason and I decide to change my POA to D.A.V. or American Legion, ect. Will that change have any effect on my claim? The other question then, if that has no effect, is what is the best way to go about changing my POA for a claim? Thanks.
