I have a S Rating but I also have been thinking that I probably do qualify for a R1 rating for A&A. This is not my wheelhouse but I will give my reasons and ask the Hadit experts to comment. For almost 3 years the Dallas VAMC has provided me with a nurse who comes to my house once or twice a week to check vitals and help me with my medications. Three times a week an aide comes out who helps me bathe as U have a lot of problems with lower half of my body. The aide also makes sure that house is picked up and offers to change linen on bed. As many here already know, I have a claim for SMC "s" award, on appeal, from the CAVC, to the BVA to the AMC, at present. The claim was filed in late '99, and would be retro to '89. Last wk I had the C&P exam at my RO. The AMC called stating they are ready to certify it back to the BVA for a decision. She stated that they mailed me the paperwork, along w/a waiver for me to sign, if I had no more evidence and wanted to waive the 30 day period, I could fax it to them. I just received another BVA remand on my 1999 SMC "s" award claim, for HB/A&A, inferred issue, back to 1989. This is getting to be fun! You'd think I'd be tired of it but I'm not. This gives me time to add an IMO, if I can find a physician or shrink that can give me a possitive IMO. In the remand decision I discovered I was granted s/c, for nonproliferative diabetic retinopathy of the right eye, effective 9/8/10, considered a complication of diabetes mellitus, but was never notified of the decision. I initially submitted a claim for SMC-K, Loss of creative organ, Erectile Dysfunction due to diabetes. Afterwards, I had my prostate removed due to prostate cancer. Based on what I have read, the prostate gland is a creative organ. Should a second claim be submitted? I am curious about it because the prostate gland and the penis are on the same reproductive track.

You appear very knowledgable on VA matters, enough so that I'm guessing you're a VA employee sharing your knowledge here. Can you explain how the VA uses the Combined Ratings Table(CRT), once a claimant reaches 100%?? Also with reference to the 100%+60% "s" award?? Do they use the CRT in making that decision, even tho it penalizes the claimant "again" for the same disabilities?? Thank you for your time! pr

So, this is now about the 5th time the VFW has not only not helped in my case, but misinformed to the point that I now believe my entire claim is in jeopardy. I was recently awarded 100% TDIU for PTSD and I also have enough ratings besides that that I am close to being schedular. In any case I meet the requirements for SMC-S. When I went to my VFW rep, they had no idea a person with TDIU could get SMC-S. Once she found out it could happen, she decided not to go with what I had said (me being the person who did all the work on these claims with the knowledge you guys have given me) and she decided we should file an NOD as opposed to a CUE. After the Caretaker denial I scheduled an exam with my new, (5th in 2 years) VA PCP. He is actually a NP but whatever. Anyway I began asking asking about his communication with the Caretaker rep. and as some of you know, because I posted it somewhere else, he said he never spoke with them, sent them an email, or even commented on whether or not I needed a Caretaker.
