Hi all: You may know from previous posts that I am TDIU T&P since 2002 for PTSD. I am a VietNam vet who served during the Easter Offensive of 1972. When I found out about Bradley v Peake, I filed for Housebound benefits because I am substantially self-restricted to my home. (Bradley v Peake) allows TDIU vets to be granted SMC Housebound benefits. Anyway, my question is: What is this VA C&P Psych gonna ask me? Is Housebound for PTSD not for real? I mean, their are many other vets in much much worse shape (physically) than me who are truly Housebound. I feel guilty about even filing for Housebound 'cause I know it is all in my head. Anywa…

I recieved a denial and statement of the case from the regional office in August for special monthly compensation for loss of use of lower extremities secondary to my service connected cervical and lumbar disease. The reason and bases was on Mar.11th,2010 I had Two compensation and pension examinations for loss of use,the first one stated i had mild peripheral neuropathy affecting both lower extremities and a cane is required for balance. The physician stated that mild peripheral neuropathy of my lower extremities is not sufficient to cause a problem with ambulation. That is the reason my claim was denied.I use crutches, cane and a walker all issued by the VA…

# [DOC] M21-1MR Part 4 Subptii Change Document Dated 09/29/06 File Format: Microsoft Word - View as HTML Sep 29, 2006 ... Change numbers will no longer be assigned to M21-1MR changes. .... entitlement to SMC under 38 CFR 3.350(f)(4) must be a permanent disability ... A.2.l. To add the reference to M21-1MR, Part III, Subpart v, Chapter 4, ... www.warms.vba.va.gov/admin21/m21_1/mr/part4/.../09_29_06.doc - Similar This is very extensive.I found what I needed for my IHD claim. One 100% SC that doesn't need A & A plus another Independnt SC that does require A & A equals SMC at the M level. I think this reg will come into play with some Nehmer vets under …

When I filed a 1151 claim last year I had one surgery and could walk with crutches. The granted the 1151 and said "Your current disablity is due the Negligence and Carelessness of the VAMC" so I am service connected for a Cervical Trauma with a spastic gait. I filed April 2009 I got the award April 2010. Since the the first surgery I was told in June 2009 that I needed another surgery I had to wait until March 2010 for, in July I was told that the March surgery collapsed so I had another surgery. That makes 3 spinal cord surgeries on the same spot since April 2009, since then I have gone from ambulating with crutches to using a wheel chair outside the house. If I la…

Hello I am new to this area of the board I am currently rated for DDD of the lower back and had a 3 level lumbar fusion for my SC injury that has left me with nerve damage in both Left and right legs both feet (toes burn) and I am unable to do daily personal care. I had surgery on May 5 2010. I had surgery outside of the VA but it was granted fee basis but VA never would return surgeons calls or mine so I used my own insurance. I am unable to get around the house without help it is terrible in the mornings as I am unable to dress myself ( I am unable to bend anymore since surgery without pain I cannot put on my own socks or shoes other than flip flops without help). I hav…

Its amazing how if you don't ask the VARO they sure won't tell. I have foot drop in my records and spinal stenosis and whole lot of other things that still have not been addressed as a result of an active duty accident. Now I am thankful that I am TDIU. There are other benefits that I am entitled too as well as alot of you out there and it seems like the VARO will make you say rumplestilskin until you figure out you can receive them. Well that brings me to the question of the foot drop that is noted in my records at the VA facility that I am seen at. I also have a medical exam form that states it by my VA doc. Can I apply for the SMC K for foot drop. I mean I fell in…

I have a spinal cord injury left me partially paralyzed below the waist. I can walk some but one of two things happen it becomes VERY painful, the alter gait is messing up my joints that will result in even more damage if I continue.(I have to take extra extra meds to do this) its not fun for me at all but I have 3 small children that need me to be there for family events. After a short time of walking my right leg quits working, I drag it behind me as it were dead. What I can do: I can bath myself most of the time, some days I need help lifting my feet into the tub. I can do the SSS myself Dress myself..some days I do need some help putting on shoes and sock What…

I've had my 2nd digit on my right toe fused because of a hammer toe. This was the result of my tib/fib open compound fracture in 1999. Am I eligible for SMC? I've read on this board that loss of a joint would qualify me for it. Is this correct and will a fused toe be enough to be granted SMC? Thanks again! Side note, Thanks Carlie for helping me this morning!

Hello, I am new to this site and am here hope to find help w/my claim as the VA/VBA will not help me. I am aware I can finish filing things myself so that is what I would like to do. I am out of AF on MEB/TDRL for PTSD, Fibromyalgia, Migraine HA's. combined compensable at 80% but can only draw 75% under title 10 chptr 61 as I have only 7yrs 2mnth `5days of AD service. I also had to waive that as I am unable to draw concurrent receipt unless congress passes laws in Nov 2010. GOD willing. My PTSD is Combat Related and am going through TDRL eval currently and having Migraine HA's and TBI that I have had since 04 but never examined nor identified while in AD after hea…
