Newly rated veterans 100% TDIU. I am rated at 70% bi-polar disorder, 10 tininitus with open claim for hearing loss. I am presently receiving care from the VA for my mental disorders and have just been placed into a VA program call MHICM (Mental Health Intensive Case Management) b/c I have had 4 suicide attempts and three 51/50's this year. I have a team of social workers that come to my home twice a week to make sure I am taking my meds. and that I am not in a major state of decompensation. I got the paperwork today on the VA's decision on my SMC "S". They called it a CUE. I guess it was a CUE since they should have granted the SMC when they became aware that I was IU plus 60%. I did not claim it as a CUE. They sent a copy to my lawyer who is doing my CUE going back to 1971. I think he might get mad that I cut him out of this, but it was my money and I did not need him since this was not an issue we were dealing with at the time I hired him. Get the CUE claims out since every IU vet plus 60% has a claim. You know before this I had IU plus 5 ten percent ratings. It was not until I got 60% for the heart that I got the SMC eligibilty according to the VA. I am …

Hello I am new :D I was Dig.with ALS in Dec. of 2009. I got my 30% and had my C&P exam beginning of Jan. I don't know If I will get 100% with SMC. I walk with a cane, my left is worse then my right, I can not walk up stairs without asst. ,can not get up off floor. I have no reflex in my legs and arms, and my hands are weak. I have no bulbar sign...I was wondering if there is anyone out there that would know or have a general idea. I have the PVA in ATL helping me I am just waiting and curious!!! Oh and I really can't work because my body gets very fatigue...Yuck Thanks Martina

In Chapter 17, Note 261 of the 2010 Edition of the VBM, NVLSP makes this statement referencing the CAVC Bradley decision: "the effective date of payment for Special Monthly Compensation is not when the issue was specifically raised by the evidence,but when the evidence first suggested a need for this benefit." This could give a veteran some leeway on any EED for SMC. It is hard to interpret this statement however- The VA had to send the VA van here to pick up and deliver my husband to their VA day treatment program due to his SC disabilities.The med recs from Day treatment verify that. I guess that might be example of "suggesting" a need for the "S" award. …

Im trying to figure this out. I was awarded 100% for depression, and SMP housebound. I dont get any money for housebound. I thought being 100% P and T, I am not eligible for Pension, so I am guessing I should get SMC for Housebound. The decision, which awarded 100% for depression states: 5. I got a email for lawyers at the NLVSP and they say Bradley is settled law. There was an attempt by the VA to upset it in 2009, but it failed so if you are IU plus 60% go for it.

Last year I filed for a higher or enhanced level of Aid and Attendance and was denied...I am now in my 60 day notification to file for a DRO or Appeal decision and just recently filed for an extension of the 60 days certified mail return receipt requested. Hello to all my comrades! I finally got my rating back after 8 months. It spent 4 months in review before they finalized it on Sept 21, the day before my birthday Sept 22. I am 100%. I think my overall percentage was 220 but there were 7 things i did not get a rating on, so imagine what my total would have been. I have always told people to be patient and things will happen. We recently filed for A&A for my husband because he needs help on a daily basis in the following areas - getting in and out of bed and chairs, getting to and from the bathroom, getting dressed, etc. He also has a lot of instability in his legs and back and has fallen on several occasions. My husband (the Vet) was hospitalized for Atrial Flutter and extremely Low Potassium........VAPCP phoned me and instructed me to take him to the nearest hospital to have potassium injected for fear of a stroke or heart attack.
