I have a question: My nml payment is scheduled to be made on the first and it is the rated amount, but in my decision it states "Entitlement to special monthly compensation based on loss of use of a creative organ is granted from 01 May, 2012". How do I get the SMC, 99 dollars a month I believe. Do I have to apply for it special or was this just missed when scheduling my payment? I am grateful for any help. Take care Bob

Am I entitled to SMC since I had a hysterectomy & my ovaries/tubes removed (due to endometriosis), EVEN THOUGH I HAD A TUBAL LIGATION A YEAR BEFORE THAT?

I am currently SMC M1/2 and I was just awarded, entitlement to service connection for neurogenic bowel and bladder, as secondary to treatment for service-connected post traumatic stress disorder (PTSD). My question is can one go straight to R1 or do you need to be rated O/P before you can be given an R1 rating? Rich

im 30% hearing loss and 10% tinitus. I applied for smc k two years ago on the basis that I cant use the phone or order food at restuarantes ect. And my wife and children do this kinda stuff for me. Ive submitted letters frm my wife and children as well as a friend. My coworker and supervisor also wrote letters saying that they aid me at work on a daily basis. I know my combined 40% rateng is low but trust me when I say 40% for your ears is very very hard of hearing. Severe hearng loss but still not deaf. Im in the preparation for decision phaze and expect the big envelope in a week or so. You think I fit the requierments for he k award?

Can someone tell me whether I have the SMC P rate or the SMC L 1/2 rate, as this is what is stated in my decision...and what would be the next rate available should I prevail on appeal?? I have been rated for numerous conditions since 1999 including Aid and Attendance at the L rate but was recently rated a higher percentage, so I now have a 100% P&T for PTSD and a 60% rate for incontinence plus the other conditions for my back, legs and diabetes all rated at 40%. What they did in effect was increase my monthly compensation rate $69 more dollars per month and that is for the increase from L rate to L 1/2 rate. Well it is official last week some lady from va called me to tell me my claim would be denied, I guess the bitch got some kind of charge out of telling me this over the phone... It was not unexpected however I haven't seen the Houston Regional office do anything right the first time in the over 5 years I have been dealing with them. Reason for denial: ( Save some typing for myself denial explains CUE) then goes on to say.. My claim is moot because Bradley v peake does not apply to claims prior to that decision, unless the claim was made prior to bradley v peake and was pending at the time of bradley v peak.. it states va guidance on this subject is not retroacti…

this may seem silly but for those who do, how many of you have received your veterans health benefits handbook? if you have received your handbook, please check chapter 2, page 7 entitled your eligibility. does it indicate you are receiving either a&a or housebound under the benefits you are eligible for? if it does, how is it listed? i ask because i have a pending smc claim. i have sent all my info in. my ebenefits account claims regional never received the info i sent. but in said booklet, it lists aid and attendance as one of my benefits. i need to double check this monday. but i am curious which is why i have asked. thanks.

I have going thru some old documents 1977 as I prepare some new. When I was discharged it was for benign positional vertigo and back pain caused by lumbar punctures. In 1979 they added a rating for anxiety but opted to roll the vertigo with the end ear organ disease into one item. I was too frightened of the bureaucracy at the time to challenge it. Shouldn't they be seperated and rated as seperate conditions?
