Video Hearing
Well I finally am going to have my video hearing on the 12th of Sep....It says to report at noon....kind of surprised there is not a set time. I guess you check in and wait your turn? Any tips I need to know about? I am kind of nervous, but it will be nice to finally get an answer and move on. Would love to get my claim awarded but will be nice to get some closure. LOL

tinnitus Lijust For Kicks Who Wants To Take A Stab At What My Rating Might Be Hmm!
I have a claim in for serveral disabilities. I'm on step 5 ( I think that's preparation for decision). Not taking this serious but I know some of you are really good at this by now so if anyone would like to take a crack at what you think my rating will be I'm interested in hearing it! here is a list of my disabilities that are on ebenefits: 1. Sleep apnea w/CPAP (sleep study on file) (New), Had the CPAP almost 2 years now, did 3 sleep studies to get it. 2. Bilateral heel spurs (New), (Dr.s while I was active duty said they were freakin huge, same with the VA doc) 3. Bilateral ankle instability (New), (related to the heel spurs/achilles tendon and plantar f…

What Happened To Carlie?
I notice Carlie rarely, or never has posted in the past couple months or so. Gee Carlie, my wife misses you, because when you are not available to argue with, then I have to argue with her instead. Years ago, my Dad had to make a trip out of town for work. He stopped for breakfast at the same resteraunt, with the same waitress. One day he said, "Gee, I am homesick...could you nag me some?" The next time he went for breakfast the waitress complained: "How come you didnt take the trash out...where were you last nite, by the way...have you been smoking?....your clothes are dirty and your hair is messed up.." My father responded, "Thanks..it feels like home." …

Still Waiting For Retro!
I haven't posted anything lately because I have been dealing with other issues. I continue to wait for the retro and hope that it will come soon. This is a eight year old claim that was granted by the BVA on January 2012 and rated by the RO on June 7, 2012. At this point, the most recent information that I have is that the claim is in its final stage and was sent to the finance department on August 29, 2012. Hopefully, I will get something soon because the waiting is a monster in disguise Sometimes, I feel as though I'm going around in circles. Has anyone here at Hadit had any dealings with the Columbia, South Carolina Regional Office? Thanks in Advance, …

tdiu Extra Schedular Consideration For Iu Retroactively
As many of you know, I recently got a BVA remand/denial/award. The remand portion is to remand consideration back to the RO for TDIU retroactively. In other words, I applied for TDIU back in 2002, and it was not adjuticated until 2008, where it was denied as it was "moot" as I was awarded 100% schedular. However, my schedular rating only went back to 2006, so the Board is remanding my tdiu claim back to the RO meaning I have a potential to be awarded TDIU from 2002-2007. I am in a pickle as to what to do. My choices are: 1. Do nothing and wait to see if Tdiu is awarded by the RO, per the BVA remand, which specifically states I should be referred to VACO for …

Copd Question
I would be very interested to know if there are other VN vets who've had similar experience with copd, as I have. Within six months leaving vietnam -1970- I had the first of many lung collapses ( spontaneous pneumothorax). Civilian docs diagnosed me with bullous type emphysema - diffuse and in both lungs. I was only 20, and had only been smoking for 3 years. At 25 -1975-, after 3 or 4 more collapses, I had to have top lobe of left lung removed. It was done by civilian docs, ( got operation covered by medicaid ). Never filed on it back then because - well frankly, it never even occured to me. There is more to this, but I began this post on an anxiety high, and now I have b…

Claim Moved Back To Pending Decision Approval
Just when I thought things were finally moving on, I logged on to ebenefits yesterday and saw where my claim went from Preparation for Notification back to Pending Decision Approval. When I called the 800 number I was told that a new claim had been added to my claim. The claim was for Peripheral Artery Disease or PAD. The claims rep said that apparently someone had submitted PAD as part of my claim. It wasn't me. Anyway, she said that usually in these situations, the people at the RO typed up what they had decided up to that point and sent it on with a note that the claim might be adjusted later after review of evidence. Has anyone had this experience? If so, did they do …

Movement After A Phone Call
I called the 800 number yesterday, (actually I had to make an appointment for them to call me back) and the rep was pretty decent. She noted that nobody had made an entry like they are supposed to when I called in the past. She said she would send a referral to my VARO and get things moving, as well as note that I needed a C&P exam and other things. Well this afternoon on e-benefits I see a new date has been logged for info from a 3rd party, the date was TODAY. Wow, I guess somebody lit a fire under someone. Now, proof is in the pudding, but at least I was helped as is supposed to happen.

tdiu Tdiu As Moot; Bva Partial Award, Partial Remand.
To: Vet geniuses, such as Hoppy, Berta, PR, John and Carlie (there are more, sorry if I ommitted your name) Received a BVA decision. Decision was remanded, denied, and partially awarded..all 3. Highlights... 1. Appeal of RO denial of TDIU because it was moot was remanded. "In a 2009 rating decision the RO determined that the claim for TDIU was moot because in the same rating decision, a 100 percent rating was granted, which fully resolved the issue in the Veterans favor. However the Board notes the CAVC has recently held that VA has a "well established" duty to maximize a claimants' benefits. (Buie vs Shinseki, Ab v Brown and Bradley vs Peake) A …

Sleep Apnea
I had a sleep study done 4/30/2012. After waiting til today for my cardiologist to contact me about the results, I went to ROI and got a copy for myself. (see attachments) I am already at 100% P&T; 40% DMII, 30% IHD among other things. Should I file a claim as secondary to DMII or should I just accept treatment and let sleeping dogs lie. I realize that there is no more money involved. Just the peace of mind in knowing that all bases are covered and the wife will be taken care of if I pass before her. Any advice or past experience in this area greatly appreciated.
