Entitlement - Veterans Compensation Benefits Claims
Once you know you are eligible for Veterans Disability Compensation, the question then becomes are you entitled to it by law. This is where to post those questions. it's OK, if you are feeling confused this is not at all unusual it can be a very confusing system. If you were injured in service and have a question about whether you are entitled to file a claim, post it here. Law 38C.F.R.3.4 (a)

New VA disability claim question
Looks like I had posted this in the wrong section so I am re-posting here. I have a couple of questions I was hoping I could get some help on. Background: While on active duty, my PSA was elevated, it was 5.7, then later it was 5.8. (High number is above 4). Other than PSA tests, only digital exams on my prostate was done while in the military. (This data is in my military medical record along with seeing a urologist while on active duty). No diagnosis was determined. I retired in 2013, and my PSA has been elevated ever since I retired. About 7 months ago, I had a biopsy and no Cancer was detected, I also had a MRI of the prostate and no cancer was detected, jus…

Dumb Question about SC
Hi all, I have a dumb question about service connection. Backstory: Apparently, I did not do myself any favors upon my retirement and initial VA claim-I did not claim several conditions (just choosing the worst ones) and the VA rated me pretty fairly (60%) in my first claim. I then did nothing for 9 years as my health deteriorated-put simply, I just felt like it was too much to ask. After having a Gulf War exam with a letter of admission for presumptive conditions from the examiner, and then having double knee replacements and needing both hips, I am finally ready to go after what I feel I deserve. It is unfortunate, since all of this compensation won't be effecti…

Privacy of Medical Records at the VA
Hi All, I wasn't sure where to post this question but here it goes. How private is our medical records at the VA and when submitting VA claims? When we are employed by our future employer, do they have access to this? What if we were looking for a position at the VA Hospital itself? Can the VA hospital look up our medical records and rating?

Renal Cell Carcinoma (Kidney Cancer) Moderates Thoughts
Hello, I need advice and help. While in the military I had Kidney stones and was admitted to a hospital. Fast forward to 2012 and developed Renal Cell Carcinoma (Kidney Cancer) and had to have the same kidney removed. Do you think this is/could be service connected ? Should I file a claim ? One of the MOS's I had in the military was as an X-Ray Technician. Is there any former X-Ray technicans out there that have developed Renal Cell Carcinoma (Kidney Cancer ) ? Thanks.

Total and Permanent Question
I did a FOIA request and got a copy of my code sheet. I was curious if I should be total and permanent based off my disability ratings. All are static except for one but if I just use the calculator on all the rest, I get to 100% as well. Thanks for your input. 9434 MAJOR DEPRESSIVE DISORDER WITH ANXIOUS MOOD AND INSOMNIA DISORDER Service Connected, Gulf War, Incurred Future Exam April 2021 70% from 03/01/2018 5237 LUMBOSACRAL STRAIN (CLAIMED AS MID BACK DEGENERATION AND LUMBAGO) Service Connected, Gulf War, Incurred Static Disability 40% from 03/01/2018 8513 RADICULOPATHY, RIGHT UPPER EXTREMITY ASSOCIATED WITH CERVICAL STRAIN (CLAIMED NECK DDD) Service…

VA disability, COE, and a new OTH characterization- will this eliminate existing benefits?
I hope this is the correct place to put this, if not- my apologies. I was in the Army Reserves. In 2012 I had two periods of active duty. During the first period of active duty I had what I know now to be amyopathic dermatomyositis. This condition still effects me to this day. In 2013 I was rated for this condition and a few others, totaling 80%. In 2017 I was reevaluated and I am now at 90%. I have two DD214s, one for each period of AD and each with an honorable discharge. Here's my problem- I went to apply for a COE for a VA Home Loan. They asked for a statement of service as the Army Reserve does not issue a DD214 at the end of contract. I contacted m…

Chapter 35 Payments
Hello Folks. My kids are still awaiting for their 1st Chapter 35 payments to be processed. Because the new law drops the months of edibility from 48 to 36 months, how does the VA usually calculate the dates within a non full month the kids are in school? For example, the attendance for son submitted by the school was between August 29th to December 19th. Will he just be paid for 2 days in August AND that would count against him as an entire month? Thanks,

**invade Testicle**multiple Lipomas Linked To Gulf War Report***
Hello: :D In January 2006 I wrote a post that detailed my scare with the many cases of the Lipoma disorder I had found in Veterans medical records. I posted my scary experience below this post so please read before you go on. I must say that it's been almost 4 years later and I've found some interesting evidence that should be looked at more carefully. On one occasions I did find a case that ruled in favor of a veteran being service connected for multiple lipomas. I also found another who was exposed to agent orange in 1996 and was denied. Not sure if that person appealed. However, I did come across this "ANNUAL REPORT TO CONGRESS" in 2002. It lists the …

P&T Veterans and hospital emergencies
Hello there. Can not find it anywhere in the regs but heard it from a few sites. Is it true that now I am a P&T 100% status, I am now covered in case of emergencies? For example, I fall outside my driveway and break my leg, an ambulance picks me up to the nearest NON-VA hospital. VA will cover? As of now, my only source of medical needs is solely from the VA.

Scars from surgery reduced from 20% to 0% rating
Ok I received my denial letter for my claim, which also was added why they took the 20% away from my disability rating for scars. The reason why is the VA has changed their requirements in service connected for scars, they are now rated 0% so the 12 inch long scar running down my leg for my last knee replacement no longer qualify s for a percentage rating but only 0%. so my disability rating page for scars for service connected went from 20% to 0%. so my 60% rating went back to 40% The only way to get a rating on the scar if it causes Constance pain and it can't heal or there is too much nerve damage around the area but then again you have to prove that, b…
